o o CITY OF ORONO Regular Meeting of the Planning Commission, June 16, 1975 \ The Orono.Planning Commission met on the above date with the following members present: Chairman Guthrie Van Nest, Curtis, Hake, Hannah, McDonald, Dunlap. Absent: Pesek, Wooley, Kallestad The Public Hearing was opened with the request for the vacation of street right-of-way by Mr, Bill Wagensteen, attorney for the Eckerts who explained the background of the house and the reason for this request. The house extends into the street right-of-way easement 7-8 feet. Mr. Guthrie read the letter from City Attorney regarding this matter. After discussion on the different ways of handling this matter and no one else in favor or opposition attending, the Public Hearing was closed at 7:55 p.m. Van Nest recomnended that the Village Council grant an easement for the house for as long as it shall last or until the Village needs the street, but that we would consider a trade of not more land than the house sits on on the east side of the road. Hake moved, Curtis seconded tabling the matter until Mr, Eckert or his attorney can come back with more information. Motion, Ayes (7), Nay (0). The Public Hearing for Herrick Circle request for re- zoning and PRD was opened. Mr. Lou Oberhauser, attorney for Herrick Circle explained the request to the audience Mr. Bailey of Bailey and Associates presented their concept of the PRD on this piece of property. Ray Dittrick stated his interest and concern whether this layout will start the Village advocating less tl^ two acre settings as was originally layed out in the Comprehensive Guide Plan for this area. Guthrie explained that the two acre requirement was for those ^eas which are unsewered. This will be a sewered area. j favor of open spaces as in the Comprehensive Guide Plan and again ex* pressed his concern of setting a precedent. Van Nest stated we are trying to keep the more dense development away from ihe Lake because we need the filtration to keep from polluting the Lake. Richard Petrin stated he agreed with hfr. Dittrick about whether or not this would set a precedent. Dunlap moved. Van Nest seconded approval of the Minutes of the June 2, 1975 meeting. MINUTES Discussion followed on the request for PRD and rezoning for !ferrick Circle. HERRICK CIRCLE Van Nest moved, Dunlap seconded, that the Planning Coiiinission reconinend to Council that Iferrick Circle be rezoned R-IA instead of the proposed R-IB and fiirther that the Conditional Use be granted for PRD based on six single family detached dwellings, meeting all requirements of the PRD zoning code provided that developer provide sanitary sewer at his expense connecting to the Wayzata system. This sewer connection will meet the requirements of the Village of Wayzata and Orono. Further recomnendation that the project be done on a contractual basis, also con ditioned on verification of the Village Engineer that six acres do in fact exist, further that sewer be provided before any units are completed and no occupancy will be allowed until such time. Motion, Ayes (7), Nay (0). Guthrie pointed out that his term of office expires July 1. Van Nest nominated Paul Pesek for Vice Chair man, John Hake for Chairman, John Guthrie for liaison. Dunlap seconded. Ayes (7), Nay (0). NOMINATION OF OFFICERS Hake moved, Guthrie seconded that starting at the next meeting (June 30) through the meeting of Septanber 2, meetings will begin at 7:00 p.m. Motion, Ayes (7), Nay (0). SUNfiER SaiEDULE TIME aiANGE Richard Petrin presented his request for a variance from front and side yard setbacks in order to build an addition with garage on his home. Van Nest stated this lot should be considered as one acre not two as the lot has only a 50’ frontage vhich would be a variance of 3’ side and 15’ from the road. VARIANCE Richard Petrin 1520 Long Lake Blvd. Guthrie moved. Hake seconded recommendation to Council for approval of this variance. Motion, Ayes (5), Nay (2), Dunlap, Curtis j I I i # o o Regular Meeting of the Planning Conmissicn 6-16-75 Mr. Compton presented his request for variance from side setbacks in order to construct a bam to house his animals. He also rec^ested a Conditional Use to allcM 15 animal units on his land. Van Nest moved, Hake seconded recomnendation to Council for approval of the variance due to the shape of the lot and concurrence of ne labors and approval of the Conditional Use for additional animal units, subject to continued concurrence by the neighbors. Motion, Ayes (7), Nay (0). Ms. Overby and her nephew presented her request for a variance from lot size. Hake moved, Hannah seconded recomnendation to Council to grant this variance because of nonavailability of land on either side and front setback to be confoiming with neighboring homes. Motion, Ayes (7), Nay (0). Mr. Toman, Duke Schneider from Fredrick Herfiirth Real Estate, and Mrs. Backstrom presented their request for lot split and combination. Van Nest mo>^. Hake seconded recomnendation to Council for approval of this request. Motion, Ayes (7), Nay (0). Mr. and Mrs. Wright made their request for variance. Muhich explained the background for the request for lot size variance. Van Nest r,oved. Hake seconded approval provided that Lots 4, 5, 6 be combined into one and no other variance be granted. Motion, Ayes (7), Nay (0). Dr. Woellner and Mr. Stone explained the request by the Wayzata Yacht Club for a conditional use permit to operate a playground, picnic area and dock on pro perty leased from Mr. Stone on Big Island. Vsm Nest moved, McDonald seconded recommendation that Council grant this Conditional Use for the life of the lease with annual review, that no permanent structure be erected with the exception of a portable chemical toilet, no permanent mooring or docking of boats either sail or motor with the exception of the owner, who has the right to his own dockage. Motion, Ayes (7), Nay (0). The Planning Commission, upon recomnendation of Council made further comment on the Hennepin County Transporta tion Study in relation to population and growth. The rate is out of line. The Table #4 household forecast should read as follows: 1980 TiFn 1990 37174 2000 37874 A complaint was registered from a member of the audience on business being run from the home of Paul Nabb. Muhich explained that Nabb had been advised that he could not have outside storage and Mr. Nabb had cleaned up this problem, however he may have again started storing his merchandise outside since that time. Staff was directed to look into the matter again and have this item placed on the next agenda. IXmlap inquired if a letter had been written to North Star Marina. Muhich stated he had not had the time to pursue this. Upon inquiry from Curtis, Van Nest suggested that a list of attendance by members of the Planning Com mission be compiled and distributed. ^!uhich explained the survey progress for North Shore Marina.
