Regular Meeting of the Planning Conmission, May 19 1975 The Planning Conraission met on the above date with the following members present: Chaiiman Guthrie» Van Nest, Curtis, Kallestad, Hannah, McDonald, ^sent: Gasch, Pesek, Hake, Wooley, Dunlap. Guthrie opened I^iblic Heaiiijg on vacation of a portion of land on Lake View Ave. Mr. Spears set forth his request for the vacation of this small triangle of land. Van Nest stated that the City Attorney would like the Plaiming Commission and Council to consider what pro­ vision for docks would be across the street from this street vacation. He suggested a trade of parcels with Mr. Spears receiving the triangle he requested in ex­ change for giving the Village the small triangle on the lakeshore. Mr. Spears did not feel this would be a fair exchange, and plained that when the Park Comnis- sion was offered this property at an earlier date, they did not think it was worth anything. The IHiblic Hearing was clnsed at 7:50 p.m. Van Nest moved, Hannah seconded recommendation to the Village Council for approval granting this vacation on the following conditions: 1. That staff confiim that this vacation will not cause any future problems with right-of-ways, streets, or utility easements. 2. The Village wants legal descriptions confirmed by our City Attorney. 3. If this is approved by Village Council, applicants attorney-would draw upaQuit Claim Deed. 4. Because of statements made during the preliminary approval of this plat indicating that some dockage would ^ allowed on Stubbs Bay, and b^ause the road now is not in the locaticHi as represented during the preliminary plat approval, and because we are vacating to applicant on the north side of the road, and strip of land remaining on swth side of the road is smaller than \dien we gave pre­ liminary approval, that this releases us from any moral or le^l obligation that we may have to grant a dock and we are making no coomitment at this time vdiether or not docks would be permitted on this strip; the land being only 8' on the west boundary tapering down to 0* on the east boundary line. Motion, Ayes (6), Nay (0). MINUTES Muhich gave background on application by Mims. Cleon Hildens for variance for lot size and street setback. Van Nest moved, Kallestad seconded, recamnendation to Council for approval based on the condition that no variance be required for side yard, lakeshore, or street setback with the exception of the existing garage vdiich is at present 3* from street and side yard lot lines, and that we would allow a variance for the existing garage. Motion, Ayes (6), Nay (0). It was also suggested that a survey be submitted before building permit is issued. VARIANCE Cleon Hildens 1240 Spruce PI. Jerry Bailey and Paul Beman from Bailey and Associates, Mr. Lou Oberhauser, and Mr. Norm Nafstad presented the new Herrick Circle proposal. The new plan provides for only six structures and eight living units rather than the originally proposed ten structures and ten living units. The sewer, which will be brought in and paid for by the Contractor and connected to the Wayzata sewer, will be billed through Orono. It was brou^t out that this proposal consists of 6.1 acres, not the S^i originally thought. The dedicated right-of-way on Old Crystal Bay Road is not included m this acreage. There is apinoximately 151 hardcover including all structures and driveways, and all houses will be of similar architecture. Van Nest moved, Kallestad seconded that we hold a IHiblic Hearing at the earliest possible date on rezoning and PRD conditional use. The date for the public hearing was set for June 16, 1975. Motion, Ayes (5), Nay (b). Abstain (1), McDonald. Mr. ^thrie stated for the record that Planning Com­ mission menbers tdio are unable to attend the meeting advise the Village office as far in advance as possible. Van Nestf explained that an application for variance in the Apple Hill area by John Famham had just been sulmiitted to tte Village office and that since other similar situations in this area had been approved by council recently, perhaps the Planning Commission could recomnend approval without having a packet on same. HERRICK CIRCLE Riblic Hearing Set VARIANCE John Famham 2655 Lydiard Ave. i m c Regular Meeting of the Planning Comnission, 5-19*75 Kallestad moved, Guthrie seconded recomnendation to the Council for approval of the variance request of John Famham for area and width with no other var­ iances provided they meet all other requirements. This is assuming application from Famham as submitted to Building ^ Zoning Director is in order. Motion, Ayes (6), Nay (0). Mr. Eckert has made a request for public hearing to vacate a strip of land along the right of way vJ^g Orchard Park Road over which the Eckert residence was previously constructed. The Planning Comnission called for a public hearing for the proposed vacation for June 16, 1975. Muhich stated the Council would like conments from the Planning Comnission on the Hennepin County Trans­ portation Study. Members felt they had not had enough time to study this and would give conments at the next meeting. Muhich stated the County has submitted a plan for land scaping the public access at North Arm to follow in line with idiat is being asked of the marinas. Muhich stated that five of the marinas had been issued licenses.
