Regular Meeting of the Planning Conin»sion, April 14, 1975
The Planning Comnission met on the above date with the
following members present: Guthrie, Dunlap, Kallestad,
Van Nest, Hake, Hannah, Woolley, McDonald, Pesek - Gasch
arrived at 9:45, Atty. Malkerson 9:00 p.m. Hake left
at 10:40 p.m. Absent: Curtis
IXmlap moved, Woolley seconded that the Minutes of the last
meeting be approved as revised.
Douglas Lohmar represented himself in a petition to con
struct a 9* addition in the 75* lake setback zone. He
explained he bought the house from the Chases who did not
need nuch storage area since there was more property involved.
F^ly living dictated further storage of mechanized vehicles.
Since the area the addition was being placed on was already
blacktopped, he felt he wasn’t increasing hardcover. He also
had the okay of his neighbors. Van Nest felt he had excessive
driveway. Mr. Ix>hmar stated most of his driveway was on
easement and the diagram did not accurately portray the amount
of driveway. Muhich explained that while the existing house
was all within the 75* setback only 4* of the proposed 9*
addition would extend into the required setback of 75 *. It
would be impossible to add to the existing structure without
extending into the 75* setback requirement.
Halw wad, McDonald seconded to approve the variance because

virtually no increase in hardcover as the addition would be
wilt over the existing blacktop driveway hardcover area. Van

Ted Pierce and Qjrtis Greenley, the prospective purchaser,
represented the owner in a petition to obtain a variance
OTi lot area and width. He explained it was unimproved
property purcl^sed in 1968 and combined with adjacent pro
perty to a point \diere there is no fiirther property to pur-
(kithrie felt because of the steep terrain there should be
some diagrams showing the placement of the house. Mr.
Greenley explained that the house would be placed well
above the present house to be razed and well out of the 75*
lake setback. He stated that septic placement would consist
of 990* of drainfield.
Van Nest moved, Kallestad seconded recommendation of approval
because \diile the lot does not meet tlie zoning requiranents,

it does meet the requirement of Sec. 31.203 which allows
variance to the code. The approval should be based on
meeting the most stringent demands of the City Engineer
as to septic requirements. Motion, Ayes (9), Nay (0).
Kermit LaQuey, owner of subject property stated he bought
the lot in good faith when the requirement was one acre
zoning; further there was no land adjacent to add to the
property since it was all built on.
Kallestad moved, Pesek seconded, to reconmend approval
since there was no property t;* ^y to bring subject property
to code, also the subdivision w4s nearing full development
on compatable lots. The approval to be conditioned on the
engineer's approval of septic design since there vrere pro
blem soils in the area. Motion, Ayes (9), Nay (0).
Walter Lathrop presented some projections for a bike/hike
trail encompassing Midways #19, #15, #135 and connected
to the Luce Line Trail. He said by widening the shoulders
of liiese streets the cost of land acquisition could be held
to a minimum by using the present hi^way right-of-ways.
The shoulders would be widened 6' to acconplish this and
covered with a mixture of clay and limestone, vdiich exper
ience dictates was adequate for this usage. He felt this
cwld be accomplished by 65t federal binding and 35t muni
cipal. One drawback to the plan is that some filling of
wetlands would be necessary. Some of the existing right-
of-way would be through swanq)s. Widening the shoulder 6'
would require some filling.
Guthrie stated the concept fits in perfectly with the
guidelines of our new comprehensive plan. All members
reacted favorably.
Ed Lehman and Dick Edwards appeared to obtain conceptual
approval for land use on property owned by them west of
Keaveny Drug Store. They said the property once was granted
conceptual approval for an 80 unit apartment complex and now
was rezoned to residential. Van Nest ^plained that in the
rezoning process the property was zoned to LR-lC-1 idiich
grants a 50% density increase if the PRD concept is used.
Muhich explained that residue after rearrangement would leave
three lots, namely 1, 2, 3, Block 1 that would be short of
the one-half acre zoning requirement.

Mr. Lehman explained that he wished to build four single
family dwellings on his portion of the property. Members
felt he would have to have two full acres to accomplish this
and anything else would have to be granted under a variance.
Since the sketch shown in the presentation was not well defined,
there could be no computation of this accomplished until the
complete configuration was shown.

Guthrie moved, Hannah seconded, since there was no one to
present the petition, matter should be tabled until some
one appeared to answer questions. Motion, Ayes (10), Nay (0).

Rezoning
The City Attorney, Bruce Malkerson, presented some things
tliat needed clarification:
ATTORNEY’S REPORT
1. The matter of a vacation of public property fronting
the proposed division of Kermit Knutson on Bayside Road.
Mr. Reidel and Mr. Spears were present to represent their
client. Malkerson explained to members that any vacation
of public property carries an affirmative duty to hold a
public hearing. Spears stated the Council Minutes of
April 22, 1974, gave approval to place two docks on the
sliver of land across the street. Van Nest explained
because of the rezoning process decisions were in a state
of flux at that time. Now tliat the zoning is established,
decisions are firmed up.
Vacation of Public
Property
Van Nest moved, Kallestad seconded to have a public hearing at
the action meeting in Ma*' for the purpose of vacating a portion
of land south of Ba^ide Boad fronting subiect property. In the
meantine he asked that Malkerson clarify the many legalities
involved. Motion, Ayes (10), hfay (0).
2. Attorney stated he felt the matter of the variance
of Art ^m on his property at 1331 North Arm Drive could
end up in litigation and asked members to affirm or negate
their original decision to deny the variance as a matter
of record. Members were unanimous that the Minutes of
their last meeting stand.

announcing Council and Conmission matters and other informa
tional items be considered. Muhich felt this should be a
budget item and considered very carefully. We now have
boards in the Hall and the Chanbers announcing such items.
INFORMATICS SIGN
Gasch, chairing the Marina Licensing Committee, made a
presentation of findings and decisions that the comnittee
had arrived at through a series of meetings with the marina
ownere. She felt some progress had been made in these
meetings to bring the marinas in conformance with present
zoning requirements. City Attorney felt they should make
some film decisions as to what should be done and present
them to the owners and ask if they will comply. If this is
a four year plan, it should clearly show by plans what is
to be accomplished each year until the entity is accomplished.

It was brought out that there has been no answer from
Gayle *s Marina, some compliance with Windward Marine and
Minnetonka Boat Works. Discussion was held on North Star
Marina's chartered boat. Minutes were read on the original
permit allwing the dock, restricting its use to only one
dock allowing the boat for private use only. Questions were
posed insofar as if parking would be adequate ^en the boat
would be chartered and the (fiestion of safety crossing #51
to embark.

Van Nest moved, Kallestad seconded that !4orth Star Marina
be notified of brochure advertising the chartered boat which
shows the usage is an apparent violation of the agreement as
set forth in the Minutes allowing the dock. Include in the
notification Marc Whitehead's letter notifying them of the
violation in prior years. Motion, Ayes (9), Nay (0).

Since North Shore Drive Marina states there will be no compliance
insofar as screening, members recommend no license approval
should be granted.
Pesek moved, Kallestad seconded adjournment at 12:00.
