cm OF ORCNO #Regular Meeting of the Planning Ccnmission, February 18, 1975. The Planning Condssion met on the above date with the following nenbers present: Chairman Guthrie, Van Nest (arriving at 8:00 p.m.) Curtis, Kallestad, Pesek, Hake, Woolley, Hannah, McDonald, Dunlap. Absent: Gas^ Hake moved, Woolley seconded approval of the Minutes' of the January 20, 1975 meeting. Motion Ayes (9), Nay (0). Lou Qbexhauser presented a request for lnc:ressing the density of Herrick Circle property north of Wayzata Comtry Club for a residential de^lopaient of units in the range of $150,000.00. r ^ Kallestad moved, Hannah seconded to convey to Council that it is the belief of the Planning Coamission that a project such as outlined for Herrick Circle by letter of January 14, 1975, would not be inconsistent with long range goals of the Con9>rehensive Land Use Plan provided sanitary sewer would be provided without cost to Orono and the specifics of any proposal would conqply with all requirements of the Zoning Code. Motion, Aye (! 'Nay (0) Van Nest moved, Pesek seconded reccmnendation to Council to grant a legal non*conf6rming conditional use permit to the Stubbs Bay Marina for the sale of soiq> and sand* wiehes, not to include full course meals. Sandwiches defined as food which is eaten with the aid of fingers only, without the use of utensils «id typically served at a drive-in food service establishment. The Planning Commission recoanmnds that no other special conditicms be incorporated with this conditional use permit. Motion, Ayes (10), Nay (0). Planning Coamission was informed that applicant was in the office earlier today for instruction on procedures. Ikmlap moved, CXirtis seconded that recpiest be tabled as property survey showing location of existing cottage and history of property ownership has not yet been submitted by applicant. The old building is not consistent with the new residence and the additional data as requested by the Planning CoHid.s8ion has not as yet been received. The recoinendatiGn included that ai^licant be instructed to remove the old stiucture as previously agreed within 90 days of this meeting. Motion, Ayes (10), Nay (0). Mr. Nielsen, Mr. Yngve and Mr. Roberts presented a request for consideration of rezoning of Gagne property and an estimated time table to complete the action necessary. The applicant was informed of difficulty in deteiminina a time table with the steps involved in the rezoning re<piest (Committee review. Planning Goomdssion study and recommwidation. Council approval. Notice of Public Hear ing, Public Hearing, Public input, possibility of revisions, and publishing). The inadequacy of these access lanes result in a traffic and parking hazard and create an im position on both nuurinas, and a possible Village liability problem. Motion, Ayes (10), Nay (0). Curtis moved, Hannah seconded, reconmendation to Council to adopt provisions for licensing of building contractors to provide some protection to the residents of the com- Binity as to quality and corformity of construction and procedures. Motion, Ayes (8), Nay (2), Kallestad, Pesek. Village attorney is in the process of investigating the history and reporting on present status of property. Van Nest disqualified himself on decision because of the conflict of interest. He did, however, interject that as a neig^ibor he had no objection to the nronosa; Oirtis moved, Kallestad seconded, recoamendation to Council to deny request on the grounds that the 75* lake- ashore setback requirement is a state and local regulation %^and the maximum pemitted hardcover relations along lakeshore was agreed iqKXi and adopted in our current zoning code and action contrary to these ordinances would only tend to set precedent for other requests idiere land hardships are not involved.
