Regular Meeting of the Planning Comission,
February 20, 1973 7:30 P.H.
The Planning Coauaission »et on the above
date with the following Bembers present:
Chairman Poisson, Elliott, Gasch, Hays,
Kokesh, Nicholls, Ryerse, Searles, and
Guthrie. Absent: Kullberg and Van Nest,
Gasch moved, Elliott seconded, that the
Minutes of the Regular Meeting of February 5,
1973, be approved. Motion, Ayes (9) - Nays (0).
MINUTES
No one was present to represent Mr. Ray
Bechtle who is requesting a division of
slightly more than one acre from Parcel 3S00,
Sec. 34, Totmship 118.

Searles moved, Guthrie seconded, to recommend
approval of the division. Motion, Ayes (9) -
Nays (0).
Bob Searles brought to the attention of the
Planning Commission members that the Council
granted permission to fill this property for
landscaping purposes a number of years ago,
and it was not their intention to create
building lots.

Mr. Gerald Guetzkow appeared before the
Planning Commission to request the division
of his property on the southeast corner
of County Road #15 and Orono Lane. The
request is to divide a part of Lot 1,
Auditors Subdivision #169 of Sec. 2 into
2.4 acres and 2.6 acres. Although the U.S.
Geodetic map does not show the lot in
question as being a wetland, there are
cattails and other aquatic forms of
vegetation growing on much of the property.
Gerald Guetzkow mentioned that previously
they had received provisional approval for
three building sites, and now they were only
requesting two sites. To avoid any septic
system problems for the proposed lot on
Orono Lane, Mr. Guetzkow suggested that the
effluent could be pumped to an area on the
adjoining lot where the land was high enough
to allow the construction of a suitable
drainfield. Mr.Searles questioned whether
the amount of high land was sufficient for
two drainfields.

The Zoning Adainistrator subaitted three
additional factors for consideration.

1, Ordinance No. 138 adopted the Lake
Minnetonka Conservation District guidelines
of stora water runoff which suggests that
the first SO' froa the shoreline should be
left in its natural state. This would
essentially force the construction of a
hoae in an area which is now covered with
aquatic vegetation.
2. Ordinance 22.020(2) states that "No
soil absorption systea shall be installed
in an area where the «a*er table is at any
time less than 6%' below ground level or
4' below the bottom of the drainfield trench".
Soil borings indicate that it would be
impossible to create a sufficient drainfield
on the proposed lot on Orono Lane.

Gasch moved, Searles seconded, that the
request be tabled until the Zoning Administrator
is able to determine whether a permit was
given to fill this land for landscaping
purposes only as was suggested by Searles
previously. Motion, Ayes (9) - Nays (0).
Mr. Brad Van Nest's calculations regarding
density and traffic generation was submitted
by Poisson to the Planning Coamission.
IDS PROPOSAL
Searles moved. Gasch seconded, that the
Planning Commission adopt the figures
submitted in the Van Nest report. Motion,
Ayes (9) - Nays (0).
The Planning Commission is requesting input
on the following matters from the Park
Commission and the Village Attorney.
1. Froa the Park Commission, a reoort is
desired on the possible uses of the land
IDS intends to donate to the Village. Since
the Village may have to absorb sewer assess
ment changes, the Planning Commission would
like to determine the potential recreation
or ecological value of this property.
2. From the Attorney, an interpretation of
whether our Village ordinance will allow a
developer to accumulate density credts from
parcels of land separated by roads and located
in different zones.

Poisson asked that the Planning Coniission's
evaluation of the IDS proposal be coapleted
as soon as possible ana forwarded to the
Council. Searles felt that no recoaaendations
could be Bade until the Village adopts its
coaprehensive plan. Poisson suggested that
a work session on Saturday, February 24, 1973
at 9:00 A.M. was in order to discuss soae of
the issues before the conission.
Mr. Ray O'Neal, representing IDS, felt that
if the Village was going to accept the
figures for density and traffic generation
that was presented in the aeeting, that it
night be in IDS's best interest to withdraw
its request.
Searles noved. Hays seconded, that the IDS
proposal be tabled for further discussion.
Motion, Ayes (9) - Nays (0).
iiassengale brought to the attention of
Poisson that the Planning Connission should
select a chairman for 1973 in conformance
with Ordinance 7.030.
Searles moved. Elliott seconded, the name of
Poisson for chairman. Gasch closed the
nominations. : Motion, Ayes (9) - Nays (0).
Poisson expressed the need for more detailed
information from the staff so that the
Planning Commission can make a more accurate
evaluation of the application before then.
It was felt that changing the format of the
Planning Conission a'ietings would give the
staff more time to prepare a detailed report
on an application, and allow the conission
to make better decisions.
Searles movsd, Elliott seconded, that hence*
forth the Planning Conission hold its
public meetings on the third Monday of each
month and have work sessions on the second
Tuesday of each month. Motion, Ayes (9) -
Nays (0).
Poisson moved, Ryerse seconded, that the
meeting be adjourned at 9:35 P.M. Motion,
Ayes (9) - Nays (0).

Mr. Stanley Guth. representing Mr. James
Fullerton, appeared before the Planning
Commission requesting a subdivision.
Because the lot that was being divided off
was being sold under a contract for deed, the
Fullertons did not want it combined vit.h
RIS 727, which is owned by Mr. § Mrs.
William Lurton. Searles mentioned the
possibility of landlocking the parcel in
question unless some easement was granted.

Searles moved, Ryerse seconded, that the
Attorney be consulted about the access
problem before an approval is granted.
