Gasch. Kullberg, Guthrie. Paurus. and Ryerse. Absent: Elliott, ilays. Kokesa. Poisson, and Van Nest. Guthrie moved. Ryerse seconded, that the Minutes of the Regular Meeting of April 16, 1973. be approved. Motion. Ayes (6) - Nays (0). The Acting Chairman announced that this was the time and place for a public hearing concerning the vacation of Hill Street from Parcel 2100 to Tonka Avenue. The Zoning Administrator presented the Notice of Public Hearing, the Affidavit of Publication and the Certificate of Mailing to affected property owners. The Ramstads request to vacate Hill Street was initated because of a need for an additional 10* to build a garage. The Planning Commission members were in aneement that Brook Street, to the north of Hill Street, would more logically provide access to the property west of Bayside Addition to Lake Minnetonka. Ryerse moved. Kullberg seconded, tliat Hill Street, between Parcel 2100 and Tonka Avenue, be vacated, with the Village retaining a 20* utility easement down the center of the street. Motion, Ayes (6) - Nays (0). Gascn expressed a concern about the applicability of the PRO ordinance to this particular situation. Gasch also felt that other people in similar situations had not been informed of this alternative. Paurus moved, Guthrie seconded, that the Conry PRD application be approved with an easement to the east as was desired by Orr-Schelen* flayeron, as well as a utility easement to the west. Motion, Ayes (5) - Nays (0). Gasch abstained. The Zoning Administrator reminded the Planning Conunission that the area Mr. Sweetser wanted to dredge was not shown on the U.S. geodetic map. Kullberg questioned Mr. Sweetser about his letter where he states the depth of the pond will be S' plus. Mr. Sweetser assured the Planning Commission that because of the cost, he would go no deeper than necessary to prevent the regrowth of aquatic vegetation. (Continued) 7:40 P.M. Motion, jAyes (6) - Nays (0). Ryerse moved, Kullberg secouded, that a variance be granted in the widtn and acreage requirement for Parcels 2700 Q 2S00 in Tonkaview Gardens because such a request is coapatihle with the character of the neighborhood and because it would be impossible for Mr. Hill to acquire any more property. Motion, Ayes (6) - Nays (0). Page 3 VARIANCE (Continued) VARIANCE Hill Mr. Starkey explained that the road that would DIVISION provide access to the new lots curved as it Starkey approached County Road 16 because of the terrain. Mr. Starkey was also agreeable to extending an easement to the south lot line as well as move the east-west easement shown on the preliminary plat S' to the south to allow the existing home an adequate setback for a side yard facing a street. Paurus moved, Ryerse seconded, that approval of the division be granted, subject to the adequate dedication of the 50' easements for present and future roads and utilities. Motion, Ayes (6) - Nays (0). Gasch asked for an explanation of the VARIANCE percolation test supplied by Mills Engineering. Mondale Mr. Mondale claimed that Mr. Scheller, the Building Inspector, informed him that the test indicated that an adequate septic system could be constructed. Gasch moved, Guthrie seconded, that a variance be granted since this subdivision had been created before the present zoning ordinance and the Mondale lot was the same size as the surrounding lots that have been developed. Motion, Ayes (6) - Nays (0). Mr. Bohn explained that his existing home was destroyed by fire and he would like to move the location of the new home to meet the 10' setback requirement but not move it so far that a new well would be required. The new home would be 70' from the lake, which would be in line with the surrounding homes but because of the shape of the lot would require a variance of 60' in lot width. VARIANCE Bohn (Continued) MINUTES OF A REGULAR MEETING HELD MAY 21, 1973 Mr. Bohn also expressed a desire to hookup to ninicipal sewer. Paurus moved, Kullberg seconded, that a variance for lot size and width be granted, conditioned on the applicant's conformance with the 10' side yard setback requirement and maintaining a setback that is in line with the adjoining lots. Motion, Ayes (6) • Nays (0). Page 4 VARIANCE Bohn (Continued) Paurus moved, Ryerse seconded, that the "simple division" of Parcel 3420, be approved in accordance with Section 39. j d of the ordinance. Motion, Ayes (6) - Nays (0). DIVISION Winton Q Mr. Gobel explained to the Planning Commission that when he sold the guest house on Lot 7 of his property he consulted the Village and they required that it be connected to the sewer. By complying with this request, Mr. Gobel felt that he had met all the Village requirements. Now that he is selling his hone on Lot 6, he found that Lot 6 Q 7 are one parcel and must be divided. Because of the size of Lots 6 B 7, Acting Chairman Searles felt that the Planning'Commission should inspect the property and ask our legal counsel for his comments before any recommendation is made.
