HomeMy WebLinkAbout04-16-1973 Planning MinutesVILLAGE OF ORONO Regular^Mcetlng of the Planning Commission, The Planning Commission met on the above date with the following members present: Chairman Poisson, Gascn, Kullberg, Paurus, Ryerse, and Searles. Absent: Elliott, Guthrie, Hays, Kokesh, and Van Nest. Elliott and Hays arrived at 7:35 P.M. 7:30 P.M. Mr. Jouglas Jensen, 1080 Wildhurst Trail, requested a variance to build on a lot with 33,000 so. ft. and a IIS’ lot width. Mr. Jensen did try to contact the owner of Lot 4 to the north of his property to see if it were possible to acquire enough land to bring his lot up to the standard required by the zoning ordinance. Mr. Jensen explained that' the owner of Lot 4 was out of town until the end of the week. Searles moved. Hays seconded, that given the size of tiie marsh on Lot 4, which would undoubtedly prevent the construction of any home next to the Jensen residence, and the general character of this area, a variance was reasonable. Motion, Ayes (R) Nays (0). VARIANCE 1080 Wildhurst Trail © Mr. David Eiss, 770 North Arm Drive, would like to construct a home on Parcel 6020 of Auditors Subdivision 362. Parcel 6020 has approximately 29,000 sq. ft. and 60’ wide. Mr. Eiss was unable to contact the owner of Parcel 6010 to the north of his property to see if it would be possible to purchase tliis similarly sized lot. Since sewer is not presently available on North Arm Drive, there was concern tnat there would be seepage from the septic system into the lake. Kullberg moved that approval of this variance be granted if a septic system is located in a way that the effluent could not flow into the lake, or if a holding tank be used, or if Mr. Eiss could acquire Parcel 6010 in addition to 6020. Motion died for lack of a second. Searles moved, Ryerse seconded, that the variance be denied, and that any future approval would have to be conditioned upon Mr. Eiss acquiring Parcel 6010 or the availa­ bility of sewer. In 1969, the Village vacated the street adjacent to the Welter property end one of the conditions of vacation was that construction would b« allowed right up to the vacated street out not on it. Mr. Mills, the Village Engineer, reaffirmed the need to maintain the Village's original position. The Welters claimed that the watermain is not located in the center of the vacated street, and because of this, they could maintain an adequate setback from the main. VARIANCE 3309 Crystal Day Road :'ecause the proposed garage would also be tviilroad property, the railroad would hrve to agree to lease some land to the Welters. Ryerse moved, Gasch seconded, that the request be denied because of f'.e October 2, 1909, letter from fir. Scheller stating tlie conditions for vacating the street, and because the Villase Engineer feels that thij variance would not be in the best interest of the Village. lotion. Ayes (3) - Na/s (0). Searles moved. Hays seconded, that since sev.er and water are available, and there is no 'joining vacant land that could be accuired, that a variance should be granted for Lot 2 and Outlot 4, Block 2 of Walter's Port subdivision. Motion, Ayes (8) - Nays (0), VARIANCE Lydiard Avenue Mr. Tom Jack would like to serve Pizza, sandwiches, and soft . drinks in his billiard hall. This requires a special use permit. Because Mr. Jack operates a similar establishment in Maple Plain, Chief of Police Ross was asked to submit a letter concerning any problems they have had with Hr. Jack's operation. Although, there have been some ])rc!)lcms. Chief Ross felt that a place .;':iilar to what Mr. Jack has proposed is needed in the Navarre area and should be given a chance. SPECIAL USE PERffIT 3S80 Shoreline Drive The availability of parking was a major concerjx, but Mr. Searles recalled that the parking in the rear of the building was one of the conditions of approval for the building and therefore, this space should bs available for ftr. Jack to use. He •'^elt that any establishment that would have customers stopping for any length of time would not be abla to survive because of the limited parking. Chairman Poisson expressed the desire to table this matter until tne Planning Commission had received a statement from the owner of the property that adequate parking would be available for Mr. Jack's operation. Kullberg moved to deny the special use permit because of the parking problem that would undoubtedly be created. Motion died for lack of a second. Searles moved, Elliott seconded, that approval be conditioned upon no full-scale kitchen for the serving of food be established and the serving of food should be limited to reheating pizzas, sandwiches, and serving soft drinks. Motion, Ayes (7) - Nays (1). Kullberg Nay. The Planning Commission felt that there should be provisions so tho patrons will know tliat there is parking in the rear of the building. SPECIAL USE PERIIIT (Continued) The Planning Commission questioned the street vacation procedure which limits vacations to situations where there is a public purpose. The Ramstads explained that they would like the Village to vacate Hill Street west of Tonka Avenue so they could construct a garage on their property. The Ramstads explained that the present Hill Street runs directly into the home on Parcel 2100 and so it would not be feasible to ever extend the street. Chairman Poisson moved, Searles seconded, tiiat a public hearing be called at the next regular Planning Commission meeting on Monday, May 21, 1973. Motion, Ayes (8) - Nays (0). HILL STREET VACATION Mr. Richard Conry requested a division of Parcel 5600, which is 3.48 acres, into three building sites. This request requires a variance in lot width of approximately 40' for one of the lots. Gasen felt that granting a variance in an undeveloped area might set a dangerous precedent. Because of the street pattern around the lake and the shape of some of the old nlats, it is difficult to avoid some variances according to Poisson, Ryerse felt that it would be difficult to deny 3>i acres as three building sites. Kullberg moved, Ryerse seconded, that approval of the subdivision be based on the condition that a 50* road easement (rather than the 40' easement tn..c is shown on the plat map) be provided foi. Motion, Ayes (S) - Nays (3). Hays, Gasch, and Senrles Nay. Elliott departed the Council Chambers at 9:50 P.M. Mr. Winters owns a 50,000 sq. ft. tract of land on Tonka View Lane. He would like to create two building sites on the five lots that he owns. Since the lots are narrotv, Mr. Winters felt that a variance would not be unreasonable. A variance of approximately <^10' per lot would be necessary for the lot width requirement. Searles moved, Ryerse seconded, that given the amount of undeveloped land and the size of the variance requested, this request sliould be denied. Motion, Ayes (8) - Nays (0), Chairman Poisson moved, Ryerse seconded, that tlie Alan Sweetser request for a wetlands variance be tabled until mors information is presented to the Planning Commission. Motion, Ayes (6) - Nays (0). Hays abstained. The staff will consult with the Lake Minnetonka Conservation District to make sure that the Tanager Lake dock was not expanded or relocated onto the County Road fl5 right-of-way. Poisson moved, Kullberg seconded, that the meeting be adjourned at 10:10 P.M. Motion, Ayes (7) - Nays (0). .^Respectfully submitted.
