The Planning Commission met on the above date with the follow'ng members present: Guthrie, Hays, Kullberg, Paurus, Ryerse, and Searles. Absent; Poisson, Elliott. Gasch, Kokesh, and Van Nest. Ryerse moved. Hays seconded, that the iUnutes of the Regular 44eeting of June 18, 1973, be approved. Motion, Ayes (6) - Nays (0). MINUTES June 18, 1973 Ryerse moved. Hays seconded, that the Minutes of the Regular Meeting of July 16, 1973, be approved. Motion, Ayes (6) - Nays (0). MINUTES July 16, 1973 Commissioner Gasch arrived at 7:35 P.M, Searles moved, Kullberg seconded, the nomi­ nation of Mr. Paurus as chairman of the Planning Commission to fill the vacancy created by the resignation of Mr. Poisson. Motion, Ayes f7) - Nays (0). NOMINATION OF CHAIRMAN Norman Paurus The Wayzata Country Club has presented a proposal to the Village of Orono to construct 20 townhouse units on 8,6 acres. Approximately 16 of these units will be in Orono on 7.4 acres, (3.5 acres of which is marsh), with the remainder being in Wayzata. The land involved in tliis request is Lot 8 of Allo-Rae Terrace and the southeast portion of Parcel 3040, which is presently used for the golf course. The request by Wayzata Country Club involves a rezoning from R-lA (two acres) to R-ID (»j acre), and a variance of three units per acre. The units would be constructed in compliance with tile Village Planned Residential Development ordinance, which allows the clustering and attaciiing of tiie units in an R-ID zone to preserve open space. Justification given for the rezoning is that the lots in Allb-Rae Terrace are 25,000-30,000 sq. ft., lots in Plymouth are designated as h acre, and the property in Wayzata is zoned for one acre lots. Mr. John Goodacre, representing the Wayzata Country Club, claimed that the reason Lot 8 of Allo-Rae Terrace was purchased was to provide access to the southeast corner of tae golf course. Goodacre felt tliat this particular project would be less objectionable than some residential development because there would be no children under 18 allowed and a great deal of the property would be left in its natural state. Commissioner Elliott entered the Council Chambers at 8:15 P.M. The major concern expressed by the residents in the area of the proposed development is the location of the access. Because so many children use Ferndale Green for bikes, etc. and becuase the Ferndale Green and Ferndale Road intersection is dangerous, the residents feel that access to the project should be sought elsewhere. Searles suggested that since there is concern regarding access to the proposed site, and because the Country Club is claiming that access is impossible from the west, stakes saould be placed to indicate their present property line. If the property line were clearly indicated, all interested parties would then better understand the potential costs of moving a golf green, golf tee, and cutting into a hill for a road. Gasch suggested that the Village Engineer review the possibility of providing access from the west for the potential building site and also advise the Planning Commission of any traffic hazard at the Ferndale Green and Ferndale Road intersection. Kullberg moved, Ryerse seconded, that the Wayzata Country Club "PRD" request for a rezoning and a variance be tabled until Mr, Mills has had the opportunity to respond to Gasch*s questions. HAYZATA COUNTRY CLUB (Continued) WAYZATA COUNTRY CLUB Mr. Duncan's request for a variance of 79* from his side property line was tabled at the July Planning Commission meeting to allow the Commission members an opportunity to inspect the property. Since the July meeting, tne Village Engineer submitted a written report stating that other sites were available to Mr. Duncan that would require little or no variance. VARIANCE 4760 West Branch Road Mr. Dean Gommer, the property owner to the east of the Duncans, has also submitted a letter to the Village objecting to the variance of 79* (Continued) rtINUTES OF A REGULAR MEETING HELD AUGUST 20, 1973 Hays ■oved, Guthrie seconded, that the requested variance for the location of a stable be denied, based on the report from Engineer and the letter from the adjoining property owner. Motion, Ayes (8) - Nays (0). * j \ j Page 3 VARIANCE (Continued) Mr. 8 Mrs Rovick requested that a variance be granted from the required IS' side yard setback and a 50' setback from the road right- of-way, Although the area is zoned for IJj acre lots, the lot is only 3/4 acre, and due to its irregular shape, and »^he need to maintain a 50 setback from th. ; «r.e, it becomes difficult to design a home without a variance. The Rovick*s architect, Mr. Alexander, informed the Planning Commission that with a minor nodificationp the need for a side yard set* back variance could be eliminated, leaving only a IS* variance from the road setback requirement. The Zoning Administrator informed the Planning Commission members that no final plat had filed for this property, according ^ to Village records, although the County did record the division. The Zoning Administrator advised the Planning Commission that they could take action on the requested variance, but they should be aware of this discrepancy. Gasch moved, Guthrie seconded, that upon approval of the division by the Council, a variance for a 3S* setback from the road should be granted, subject to a determination by Mr. Mills regarding the type of s<>wage system that would be adequate of this lot. Motion, Ayes (8) - Nays (0). VARIANCE 104S West Ferndale Road Searles moved. Hays seconded that the Followell application for the division of 1.2 acres into two lots be tabled in accordance with Ordinance No. 149 and until the final Village Comprehensive Plan designates this area for either acre or one acre development. Motion, Ayes (8) - Nays (0). DIVISION 8 VARIANCE 4641 Tonka View Lane Searles moved. Hays seconded, that the Kermit Knutson request for the creation of seven ^.^building sites be tabled pending the receipt t.yof a preliminary plat and comments from the Park Commission. Motion, Ayes (8) - Nays (0). DIVISION 3640 Bayside Road MINUTES OP A REGULAR MEETING HELD AUGUST 20, 1973 Page 4 to. Cross has aade application to divide 3.ZB acres into lots of approxiutely 1.17 acres end 2.11 acres. Since tjiis request is in confonumce with Section 39.021 of the ordinance, it is not necessary to coaply with the fomal platting procedures. Since the Zoning Adainistrator's report has not been conpleted, action by the Planning Commission regarding this request night be premature. VARIANCE 2341 Shadywood Road Searles moved, Elliott seconded, that Mr. Maravelas* request for a variance from the sign ordinance be tabled. Motion, Ayes (8) - Nays (0). • j \ j Searles moved, Elliott seconded, that the Planning Commission go on record favoring signs no larger than two square feet for any hone occupation or other coamercial uses in a residential area. Motion, Ayes (8) - Nays (0). • f \ f RESIDENTIAL SIGNS Indoor Tennis, Inc. would like to construct an athletic club for tennis, swimming, hand­ ball. etc. Such a use in a residential zone requires a conditional use permit. CONDITIONAL USE PERMIT 885 Wayzata Boulevard Searles moved, Gasch seconded, that a public hearing be called for the September 17, 1973 Planning Coaaission meeting 'regarding the conditional use. Motion, Ayes (8) - Nays (0). Chairman Paurus suggested to the Zoning Adainistrator that a sheet summarizing the request and the issues involved be available for the public. Although the Village has not received any written notice of action taken by the Minnehaha Creek Water­ shed District or the Lake Minnetonka Conservation District, Mr. Mixa, the U-ICD Director, informed the Zoning Adainistrator that both bodies denied the request. The Zoning Adainistrator was told by the DNR that the old pemits, which were not dated, usually received reviewal in ligi.c of present standards and guidelines. Kr. Fredendall was encouraged to consult with the DNR about updating the perait. Searles moved, Gasch seconded, that the request fjr a dredging permit be tabled until the recomaendation of the DNR and the MCND are available.
