HomeMy WebLinkAbout10-15-1973 Planning MinutesVILLAGE OF OROMO Regular Meeting of the Planning Conmission, October 15» 1973 The Planning Commission met on the above date with the following members present: Cnairman Paurus, Guthrie, Searles, and Van Nest, Elliott arrived at 8:05 P.M Gasch and Hays left at 11:02 P.M. Absent; Kokesh. Kullberg, and Ryerse. 7:42 P.M. Searles moved, Guthrie seconded, that the Minutes of the Regular Meeting of September 17, 1973, be approved. Motion, Ayes (6) - Ways (0), MINUTES Searles moved, Guthrie seconded, that the Wayzata Country Club's request for a rezoning, variance, and a PRD, be denied on the following grounds: 1. The proposed density would be inconsistent with the surrounding neighborhood. 2. Access for the development would not be possible from the east because of the Village Wetlands Ordinance and because of the incompatibility of increased traffic on Ferndale Green, which is a minor road. 1^ Motion, Ayes (S) - Nays (0). A variance of 2* from the 10' side yard setback requirement is requested for the construction of a three-car garage. Tne applicant claims that because of the high water table on the lot, it is impossible to construct a basement; therefore, a three-car garage is necessary. Van Nest moved, Guthrie seconded, that a variance be allowed because of the soil conditions, the lack of objection on tite part of the adjoining property owner, and due to the size of the request. Motion, Ayes (6) - Ways (0). REZONING, VARIANCE § P Wayzata Country Club VARIANCE 27S0 Shadywood Road Van Nest moved, Searles seconded, that although the subdivision of Lot 49, Aud. Sub. 203, meets the existing and proposed zoning requirements for this area, tne approval of this plat should be witJiheld until it aas been determined that tliis area will definitely be sewered. In addition, an open space easement should be obtained for the lakesnore property. DIVISION 3640 Bayside Road MINUTES OF A REGULAR MEETING HELD OCTOBER IS, 1973 Page 2 It was the opinion of the Planning Commission members that minimum lot size in areas that do not have public utilities will not be more than two acres per lot. In addition, it was felt that the ISO* setback for stables did not apply in this situation. The interpretation was t lat the ISO’ setback requirement was passed to prevent one property ouner from infringing on the rights of another, and not to limit someone from dividing their property when tho setback is acceptable to all affected property owners. DIVISION 4665 Bayside Road Searles moved, Elliott seconded, that the division of 1.9 acres from Parcel 1412, Sec. 6, be approved, subject to a variance from the moraior'^m and tae Village Attorney's interpretation of the set- cack requirement for the stable. Motion, Ayes (7) - Ways (0). Elliott moved, Guthrie seconded, that a variance of 0.15 acres and 40' be granted from the size and width requirement as well as a variance from Ordinance Wo. 149 for Parcel 2680, Sec. 7, because the area was platted before tne existing zoning ordinance, and sewer is available. VARIANCE 1120 North Shore Drives Searles moved, Guthrie seconded, that the division of Lots 42>44 and parts of 45 and 64 of Spring Park, into two building sites, a variance of 5' from the width requirement of the westerly lot and a variance from Ordinance W«.'. 149, be approved, with the following conditions: DIVISION 5 VARIANCE 3133 Casco Point Road 1. A lake setback that is compatible with the homes to tiie east must be maintained. 2. A drainaee plan must be provided to avoid tne possibility of disturbing existing drainage. iiotion. Ayes (7) - Nays (0). Tne Kvalstens have submitted an application for a conditional use permit for the construction of a duplex on Lot 2, Block 1, of Apple Hill. Van Nest recalled that this property i/as originally zoned commercial and when it was rezoned to half- acre lots, the understanding was duplexes could be constructed there. Despite the fact that the Navarre Task Force has recommended the reclassification of the commercial property to the north of Lot 2, it was determined that another duplex would certainly fit in with the character of the area. CONDITIONAL USE PERMIT 2595 Lydiard Circle Searles moved, Gasch seconded, that the conditional use permit be approved, subject to the Council's approval of a variance to Ordinance No. 149. Motion, Ayes (7) - Nays (0). MINUTES OF A REGULAR MEETING HELD OCTOBER 15, 1973 Paf?e 3 The North Star Marina has submitted plans to the Village to construct a new building for the storage of boats. The structure would be 20* from the lake and on their east property line. The building would be used to replace slips that have to be removed due to the new LMCD Dock Ordinance. In addition, the request involves the cons«-ruction of a seawall and dredging to increase tiie depth of the water in front of their prooerty. Tlie Planning Comissicn recopn’res that the nature of tae lakeshore commercial uses requires easy access and a close proximity to tiie water. Although, tae nature of the business requires that the lew building be close to the lake, the Planning Commission would like to see a SO* setback from the lake maintained, and in addition, more detailed plans regarding setbacks, parking, seawall and dredging specifications, and land- scaping. Once this has been submitted, the Planning Commission can consider giving preliminary approval, The Zoning Administrator was asked to contact the DWR and linnehaha Creek Watershed District for technical assistance. Floyd Sutter has applied to have Crystal Bay Road _ from Lot 2 of Wallace’s Addition to the Village ^ of Minnetonka Beach to tiie Orono-Minnetonka Beach Village limits vacated. The reason for vacation is the residents would like to eliminate the dangerous "S” curve. Mr. Sutter's application suggests that two turn-arounds would be provided instead of one through street. Such action on the part of the Village would in effect land-lock several parcels of land. Although access would be available for the land-locked parcels through the railroad property, no legal access would be provided. Van Nest moved, Guthrie seconded, that the request to vacate Crystal Bay Road be denied for reasons stated in the Village Engineer's memo. Motion, Ayes (7) - Nays (0). Van Nest felt that vacating streets along the lakeshore is in the best public interest, although in this situation, it is not possible to do so. Searles moved, Guthrie seconded, that a variance of 40' for lot width and one-half acre in lot size be granted for lots 11 ft 12, Skarp ft Lind­ quist's Fernhill, because of the character of the neighborhood, the availability of sewer, and the inability to acquire any additional land. Approval is subject to further inspection by Zoning Administrator and Council. Motion, Ayes (7) - Nays (0). NORTH STAR '!ARINA 3324 North Shore Drive STREET VACATION Crystal Bay Road VARIANCE 1199 Elmwood Avenue MINUTES OF A REGULAR MEETING HELD OCTOBER IS, 1973 Page 4 Discussion on lot sizes was tabled until the Novenber Planning Ccumission meeting, at which tine the Zoning Administrator would present additional information. HINIhRM LOT SIZE ?fr. Cliff Bjork presented the Navarre Community and Commerce Association plan for the Navarre area. Discussion of the proposal was tabled until all Planning Commission members had an opportunity to read the report. COMPREHENSIVE PLAN Ski Tonka has requested two conditional use permits. CONDITIONAL USE PERMITS One conditional use permit would be for the Ski Tonka construction of a pond. The second conditional use would be for the expansion of the ski tow facilities onto property that is presently being acquired. Searles moved, Elliott seconded,that a conditional use be approved since this was not a wetlands area and the excavating would not affect the drainage; but such approval is conditioned on the construction of a permanent fence around the pond, acquisition of the property to the east, and more detailed drawings showing the location, size, and depth of the pond. Ho:ion, Ayes (7) - Nays (0). 5 Elliott moved, Searles seconded, that a public hearing be scheduled for November 19, 1973, regarding the expansion of ski facilities onto the property that Ski Tonka is acquiring. Motion, Ayes (7) - Nays (0). PUBLIC HEARING DATE Ski Tonka Alendales request for a division and a variance was tabled until November to allow the Planning Commission an opportunity to inspect the property. DIVISION B VARIANCE Alendale Builders Van Nest moved, Searles seconded, that the sewer matter be referred to the Planning Commission after the public hearings. Motion, Ayes (5) - Nays (0).
