Chairman Paurus called the meeting to order at ^30 P.M. !Hie following members were present: ^irm^ paurus, Gasch, Hays. Van Nest, Kullberg, miott arrived at 8:10 P.M. Absent: Guthrie, Kokesh, Searlea. Chairman Paurus opened the public hearing con- Corning a conditional use permit for a ski area on Parcel 2300 Plat 41331. At 7:33 P.M. the Zoning Administrator presented the Notice of Public Hearing, the Affidavit of Publication, end the Certificate of Mailing to affected property owners. The conditional use permit would involve 38 acres and four dual ski tows. Mr. Richard Primus, speaking on behalf of Ski Tonka said that expansion was needed to alleviate crowding on the beginner hill and would tend to compli­ ment the existing slope because of the topogra­ phy In the area. The following people appeared and were afforded en opportunity to speak: fcnor: PUBLIC HEARING Ski Tonka Conditional Use Permit Mr. Benhardus: 4360 Bayaide Road Nr. Richard Primus: Mrs. prank: Mr. Kramer: Mr. Poission: Mr. Minor expressed concern that the newly acquired property would be used for parking additional oars. Mr. Benhardus asked whether it would be necessary to construct a new, larger chalet, whether they had ski patrols, and how injured would be handled if it occured on one of the new mins. A petition was sub­ mitted listing those who oppose the expansion and existing Ski Tonka operation. The existing chalet would be large enough to handle any increase in business. Skl patrols are used cuid a Sprite would be used to carry the injured. Lives north of the Ski Tonka property and they are in favor of its expansion. They apprelcate the fact that the property is well cared for. A petition signed by the Orono High School students %rtio are in favor of expanding Ski Tonka was read. Increasing the tows will make skiing safer. There is H need for additional tows, especially beginner tows. Purther expansion of the operation would tend to increase the need for a buffer around the facility like most other major ski areas have. A large ski area Im- madlately adjacent to a residential area is not compatible. Mr. Brooks:Present Village ordinances have been violated by constructing the ski tows before approval had been granted for a conditional use permit. This is an example of Mr. Primua’ attitude and actions tdiloh have been a constant source of Irritation for the re'vhbors. Mr, Miner:No proof was submitted by Mr. Primus that expansion of the ski facilities is necessary. After all the people present were afforded an opportunity to speak Van Nest Moved, Elliott seconded that the public hearing be closed at 9:15 P.M. In the lli^t of the petition submitted by the adjoining property owners, Comalssloner Van felt that Coxinoll should review the con­ ditional use permit that was granted to the original operation. Van Neat also felt that Mr. Primus did not give adequate Justification for the need to expand the existing facilities. Raving a ski facility in Orono la in itself de­ sirable, but such an operation must be run in a way which is compatible with the residential area which it is in. Van Nest moved. Motion, Ayes (5) - Nays (0) Xullberg abstained. Chalman Paurus suggested that i-ather than the Planning Commission voting on a particular lot sise, that each member should express what they feel would be appropriate. Paurus, Kullberg, Van Neatp Oaaohp and Kays supported two acre lots while Elliott supported five acre lots in unsewered areas. Oaaoh moved, Haya seconded that a public hearing be scheduled for the December 17, 1973, regarding the Forth Star Marina's request. Motion. Ayea (6) - Nays (0) Cheyenne Land Ccnpany has submitted a pre­ liminary plat for 3k lota on 45.18 aorea which Is presently zoned R-1C. The compre­ hensive plan designates this land for large lot zoning, ihe developer would install a sewer line either to the proposed Metropol­ itan sewer line or to the Long Lake sewer plant. Mr. Knutson, who represented the engineering fins which designed the plat was asked If he oould redesign the plat excluding all the wet­ lands. It was realized that each lot would be something less than an acre, but that would be more desirable than having lots that were one-half wetlands and one-half bulldable land. Blllott moved. Oasoh moved. Hays seconded that a variance be ^granted due to the amount of bulldable land aha since the house would be oriented towards a wetland and not the road. Due to the shape of the lot it would be imposs­ ible to erect a stable without a variance, how­ ever the exact location was chosen because Mr. Oehxvan would like to have an existing tmter pump Inside the structure.
