SUBJECT: #511 Fred Herfurth, 560 Old Long Lake Road - SUBDIVISION
SKETCH PLAN REVIEW
Zoning District - RR-IB
Area - 70+ acres
The applicant proposes dividing a 70+ acre parcel into two lots resulting
in a 2.5 and a 70+ acre lot. Mr. Herfurth refers to a subdivision request
of three years ago, the application file and the address file have no
record of such an application. The two acre lot with the existing house ■
as well as the Warner residence (exception on plat) are served by a 50*
width private driveway easement. We will require a road outlot with a
possible extension to the western edge of the property. While dealing
with adjoining plats. Planning Commission should consider a possible
loop road through to the Owen's property.
The setbacks on the existing structures on the 2-acre lot should be
designated. The septic inspector will review the proposed division line
for purpose of determining available land for septic expansion.
There is a total of 8.5 acres of wetlands that we will take a flowage
and conservation easement over. We will ask for a dedication of 66*
right of way for Old Long Lake Road. The property to the south of
Old Long Lake Road and the Luce Line will appear as outlets.
Mr. Herfurth has asked for a metes and bounds division, but Staff recommends
against this for the following reasons:

6.Payment to the City of additional sewer lift station
unit assessments consistent with the increased density
on the property beyond that originally assessed by levy
#5086^ as follows: 4 additional units x $192.60 lif^
station assessment - $770.40.
7. Payment to the City of a Pa*k Dedication Fee in the
amount of $2640.00 for 6 new units on the property.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of
the City of Orono hereby approves the plat of Northgate Two,
Hennepin County, Minnesota; subject to the following conditions:
1. Single family residential structures may be erected
anywhere within Blocks 1-7 inclusive with uo side-yard
setbacks required from those Block boundaries.
2.No structure shall be erected in Outlet C in violation
of the 'Open Space Easement referenced above.
3.All outstanding sewer and water assessment shall be
evenly divided among Blocks 1-7 inclusive.
4.The City shall assume ownership and maintenance of
water and sewer laterals up to individual residence
Stubbs upon satisfactory completion and formal acceptance
of these improvements.
5.The Home Owner's Association shall retain ownership
and maintenance of the Private Road.
6.The aforesaid plat shall be filed with the Hennepin
County Recorder's Office on or before April 30, 1980
together with a certified original copy of this Resolution
and an executed copy of The Declaration of Covenants,
Conditions and Restrictions as noted above.
The approval granted by this Resolution shall expire if the plat has
not been filed by the date specified above. In that event, it will
be necessary to file a new application with the City of Orono for
subdivision review.

The proposed driveway borders a pond's south side,
but the ordinance requires a mininum setback of
26 feet. Mr. Noble requested permission to alter

The plan was reviewed at the Planning Coinnission
meeting of October 10, 1978 (Work Session)
Commission members were advised after several site
investigations by staff that the designated wetlands
was much larger, almost 1/3 of buildable portion
of lot, and part of a more extensive drainage
system to the north and east. The City Engineer
recommends against any alteration of the pond and
proposes that sediment from runoff of the paved ^
driveway would be contained in the pond area and
not passed into the main drainage channel.
Staff was requested to complete additional reviews
before the next meeting.
For the November 27, 1978 meeting, a second plan
was suJbmitted by Hr. Noble which is basically the
S2une as the original submittal minus excess paving.
The house and pool remained the same. The house had
been turned around so that the garage was now on the
east side of lot allowing for a more efficient
entrance with less paving.(Continued)

The subject property is within the West Ferndale Sewage Treatment
Study Area and may be served with sanitary sewer or a collection
lateral as soon as 1980. Previous studies of the lot have in
dicated that no acceptable on-site soil sewage treatment system
could be installed on the lot. The site was previously approved
for use of a holding tank system since sewer was planned for the
future.
The current proposal also appears acceptable for a holding tank
system. Construction and location must adhere to Orono's On-
Site Code. The owner and builder should keep in touch with the
City as to current status of the sewer project. Pinal determination
of sewer lateral and stub location may influence the location of
the holding tank for future ease of hookup.

Murph and I are finally (I hope!) getting close to the point of
starting construction next door to you. And, as you might expect
at this stage, things are in a bit of a rush and we need your help.1
The surveyors have staked out our proposed house and I would like
to show it to you. Orono city officials have been very helpful,
and 1 believe we are within reasonable variances. Our house will
be rather modest compared with the Nobles' plans, and we are requesting
more conservative variances.
Where we might be a bit vulnerable is with respect to the setback
from the lake. We propose that the shortest distance from our
shoreline be 55', one and a half feet i<2ss than the average set-
L.icks of the Gaodtles' (59') and yours (48*). With your support, our
request for this variance would enable us to leave the north part
of our lot "pure" as far as the pond and wetlands are concerned.
Our biggest problem is that we have to have our variance application
in the zoning administrator's hands this Wednesday, October 17.
If you agree that our proposed site is acceptable from your stand
point, we would appreciate it ever so much if you would sign and
return a copy of this letter so that I may use it as one of my
eidiibits when I appear before the Planning (knmisslon later this

Zoning District - RR-IB
Mr, Whitman proposes dividing a 6+ acre parcel into two lots. The
division as presented includes approximately a 1.8 acre lot and a
4+ acre lot. Whitman requests a lot area variance for the 1.8 acre
lot. Holy Name Creek intersects the northern portion of the parcel
creating a natural division line. Staff has no problem since the
entire parcel contains 6t acres and the lot will be subject to
the required septic testing. The access to the two sites will
be via a platted road previously designated in a division by the
Whitman family. Planning Commission may request a site plan for
the 1.8 acre lot designating house location, main and alternate
drainfield.
There are no designated wetlands. We will require a drainage
easement over Holy Name Creek to be designated on the plat. A
flowage and conservation easement will also be required with the
platting.

In the process of reviewing the First National Bank of Navarre's
commercial site plan, the Council has required a plat dividing
the zoning districts. All commercial activity must be contained
within the B-4 zone. The B-4 property's (Lot 2) area is a little
over an acre and the LR-IB lot (Lot 1) is just over four acres.
The residential lot has a designated wetlands of about one acre
along the Kelly Avenue side. There is just one access point
available along Kelly Avenue touching southern property line.
The entire parcel is sewered. A Flowage and Conservation Easement
be required. A Public Information Meeting shall be scheduled
for November 26, 1979.

Dear Messrs. Pope and Delaney:
As you are aware, the Council tabled your building plan review at
their October 16, 1979 meeting with the following comments:
1. From cursory review of the proposal, the building size appears
too large or too ambitious for the size of the property to conform
to the zoning requirements, specifically the parking.
2. The terms of the zoning ordinance are not negotiable and must
be complied with as far as determining required yard areas,
setbacks, and number and size of parking spaces based upon correct
"net" building area. '
3. The Council will not spend any additional time in building plan
review until the plans are revised to meet code requirements and all
submittals are assembled in one package for complete review and approval
of the staff prior to sending back to the Council.
4. The Council will not consider any rezoning which means that all
commercial activities must be accomplished within the 250* B-4
District•
At our meeting Wednesday afternoon, I believe that we solved all of
the Council's concerns by reviewing the building area calculations,
parking requirements and by adjusting the parking layout and subdivision
proposal as follows:
1. Net building area was calculated as per 38.150 resulting in 81.56%
building efficiency and 58.06 required parking stalls. The parking
will be designed to accommodate between 59 and 63 cars, all of which
are at least 9 X 20 stalls (except the 2 12 X 20 handicap stalls).
