Mabusth, Zoning Administrator DATE:August 31, 1979 SUBJECT: #508 Paul A Scherber Subdivision/Variance 1420 Bohns Point Road Zoning District - LR-lB (1-acre minimum) Total Area - 2.7 acres, sewered Subdivision - 2 lot plat SKETCH PLAN REVIEW The applicant proposes dividing 2.7 acres into two lots. The property consists of a main house, guest house and carriage house. Mr. Scherber requests a lot area variance for the lot with the guest house and garage. The existing driveway serving the guest house runs in an east-west direction and ideally a lot line continuing along the southern edge of the driveway would be preferred. I would advise against an area variance. The prop>osed lot line must meet the setback of the accessory structure (10*) and the main house (10* side yard). The preliminary plan must show a defined east-west division line, setback of existing structures, dimensions and area noted. Only the lot with the main house is to have riparian rights. PUBLIC INFORMATION MEETING - OCTOBER 15, 1979 Review of Preliminary Plans - The applicant has complied with the directions of the Planning Commission and submitted a preliminary plan designating the necessary 1 acre area for the northern lot. All existing structures meet the necessary setback for the LR-lB zoning district except for the shed. Applicant must decide if shed is to remain. If it is to remain at that location, the structure will be recognized as a non-conforming use with a zero lot line setback. Staff recommends for approval the subdivision of Paul Scherber subject to the following conditions: 1. Only one lot (southern lot) is to have riparian rights. 2. A park dedication fee of $400.00 for the newly created residential lot (northern lot). 3. Existing accesses to remain - northern lot to deed access easement in favor of southern lot - owner wishes to retain loop driveway. 4. Subdivision SKETCH PLAN REVIEW Zoning District LR-IB Area - 1 Acre The applicant proposes a P.R.D. Subdivision of Lot 3, Block 1 of the recent Navarre Cove Plat. The subdivision will consist of lots formed by a division line through the existing duplex with a corridor of land around each unit. I question the amount of land included in each owner occupied lot. The remainder of the lot will exist as an open space outlet excluding the original dock area outlet shared by all Navarre Cove residents. Originally, the Kelly Avenue Duplex Company proposed a P.R.D. that was approved never noting the lack of required acreage. The original plat would have required 6 acres for the 6 units. In this case the application would require 2-acres for 2 units. Council is very much in favor of P.R.D.'s that promote owner occupied units. This application would affirm that policy. The following are variances that should be noted: 1. Area Variance - 1 Acre or 50% 2. Plans must be submitted before preliminary review by Council. If this application meets with your approval, your recommendation must contain the following conditions: .* 1. Park dedication fee for new residential unit of $390.00. 2. Each individually owned lot is of a 75* depth to allow new structure to meet 35' street setback. 3. Area variance - 1 acre or 50%. 4. A RESOLUTION APPROVING THE PLAT OF MCCULLEY FARM WHEREAS, the City of Orono is a municipal corporation organized and existing under the laws of the State of Minnesota; and WHEREAS, the City Council of the City of Orono has adopted subdivision regulations for the orderly, economic and safe development of land within the City; and WHEREAS, the City Council has considered the application for a subdivision plat by Graydon McCulley, the subdivider; and WHEREAS, the subdivider has completed all requirements of the platting regulations of the City, including: 1. Dedication on the plat of rights of way for public streets and roads, shown as County Highway No. 6. 2. Creation of a new private road shown on the plat as Outlets B & C to be known henceforth as Deborah Drive. I have asked the City Engineer to review how other cities handle the question of compact cars. Planning Commission may decide an amendment to the Code is necessary at this tiir noting present and future trends for car manufacture and sales. VII. Loading Berth At least one loading berth 12* wide X 25' in length for any office building of 6,000 s.f. or more. Area for loading berth must be exclusive of required parking area and landscape buffer area. VIII. Signs 200 s.f. of signs would be allowed. IX. Access Hennepin County Highway Department recommends the access be moved further east to avoid turning movement conflicts with approved access on north side of CSAH 15 of Hussman Development. The new centerline of the access will be approximately 260' from west corner of lot. The County is concerned with the mature tree growth along edge of lot near recommended access. Boman, 951 Spring Hill Road - Conditional Use Permit Zoning District - LR-lA Area of Subject Lot - 2.3 acres (Revised 10-9-79) WORK SESSION Mr. Boman seeks a conditional use permit for the construction of a 58' high radio antenna for hobby use. The operation in no way involves a commercial use. The required setback of 58' from all property lines has been met according to the survey. I would recommend the antenna be moved 10' from the house to satisfy the accessory structure minimum setback requirement. Radiotelegraphy in the frequency bands 3700-3750 kHz, 7100-7150 kHz (7050-7075 kHz when the terrestrial station location is not within Region 2), 21,100 21,200 kHz, and 28,100-28,200 kHz, using only^ Type AI emission. 97.1 1 Application for Operator License. a) An application (FCC form 610) for a new operator license, including an application for change in operating privileges, which will require an exam­ ination supervised by Commission per­ sonnel at a regular Commission exam­ ining office shall be submitted to such office in advance of or at the time of tlic examination, except that, whenever an examination is to be taken at a dcsi^ated examination point away from a Commission office, the applica­ tion, together with the necessary filing fee, should be submitted in advance of the examination date to the office which has jurisdiction over the examination point involved. b) An application (FCC form 610) for a new operator license, including an application for change in operating priv­ ileges, which requests an examination supervised by a volunteer examiner under the provisions of 97.27, shall be submitted to the FCC field office near­ est the applicant. Applications for the Novice class license should be sent to the Commission ’s offices in Gettysburg, PA 17325. All applications should be accompanied by any necessary filing fee. c) An application (FCC form 610) for renewal and/or modification of license when no change in operating privileges is involved sh^l be submitted together with any necessary filing fee, to the Commission ’s office at Gettys­ burg, PA 17325. an unexpired license, no license with reference to any activity of a continuing nature shall expire until such ap­ plication shall have been finally de­ termined. e) If a license is allowed to expire, application for renewal may be made during a period of grace of one year after the expiration date. During this one year period of grace, an expired license is not valid. A license renewed during the grace period will be dated currently and will not be backdated to the date of its expiration. Application for renewal shall be submitted on FCC form 610 and shall be accompanied by the applicant’s expired license. 0 When the name of a licensee is changed or when the mailing address is changed, a formal application Ut mod ­ ification of license is not nquired. However, the licensee shall notify the Commission promptly of these changes. The notice, which may be in letter form, shall contain the name and ad­ dress of the licensee as they appear in the Commission ’s records, the new name and/or address, as the case may be, the radio station call si^ and class of operator license. The notice shall be sent to Federal Communications Com ­ mission, Gettysburg, PA 17325, and a copy shall be kept by the licensee until a new license is issued. Operator License Examinations 9%.9 Eligibility for New Operator License. Anyone except a representative of a foreign government is eligible for an 97.13 Renewal or Modification of Operator License. a) An amateur operator license, ex­ cept the Novice class, may be renewed upon proper application. b) The Novice class license will not be renewed. c) The applicant shall qualify for a new license by examination if the re­ quirements of this section are not ful­ filled. d) Application for renewed and/or modification of an amateur operator license shall be submitted on FCC form 610 and shall be accompanied by the applicant’s license. Application for re­ newal of unexpired licenses must be ^rnsdt during the license term and should be filed within 90 days but not later than 30 days prior to the end of the license term. In any case in which the licensee has, in accordance with the provisions of this chapter, made timely and sufficient application for renewal of 97.19 When Examination Is Required. Examination is required for the is­ suance of a new amateur operator license and for a change in class of operating privileges. Credit may be given, however, for certain elements of examination as provided in 9725. 9721 ExaminaUon Elements. No airborne operations will be per­ mitted on this frequency. Transmissions by an amateur station niav be on any frequency witbin any aut)iori7cd amateur band. Sideband fre­ quencies resulting from keying or mod­ ulating a carrier wave shall be confined within the authorized amateur band. 97.6S Emission Limitations. a) Type A0 emission, where not specifically designated in the bands listed in 97.61, may be used for sliort periods of time when required for authorized remote<ontrol purposes or for experimental purposes. However, these limitations do not apply where type A0 emission is^ specifically de­ signated. \ b) Whenever code practice, in ac cordance with 97.91(d), is conducted in bands authorized for A3 emission, tone modulation of the radiotelephone trans­ mitter may be utilized when jntcr- spersed with appropriate voice in­ structions. c) On frequencies below 29.0 MHz and between 50.1 and 52.S MHz, the bandwidth of an F3 emission (fre­ quency or phase modulation) shall not exceed that of an A3 emission having the same audio characteristics; and the purity and stability of emissions shall comply with the requirements of 97.73. d) On frequencies below 50 MHz, the bandwidth of AS and F5 emiuions shall not exceed that of an A3 single­ sideband emission. e) On frequencies between 50 MHz and 225 MHz, singlesideband or double-sideband AS emission may be used and the bandwidth shall not ex­ ceed that of an A3 single-sideband or double-sideband signal respectively. The bandwidth of FS emission shall not exceed that of an A3 single-sideband emission. f) Below 225 MHz, A3 and AS emissions may be used simultaneously on the same carrier frequency provided the total bandwidth does not exceed that of an A3 double-sideband emission. 97.67 Maximum Authorized Power. a) Except for power restrictions as set forth in 97.61 and paragraph (d) each amateur transmitter may be operated with a power input not exceeding one kilowatt to tiic plate circuit of the final amplincr nage of an amplifier oscillator iraiismiiter or to the plate circuit of an oscillator tiansmittcr. An amateur transmitter operating with a power input ex­ ceeding 900 watts to the plate circuit shall provide means for accurately measuring the plate power input to tlic vacuum lube or tubes supplying power to the antenna. b) Notwithstanding the provisions of paragraph (a) of this section, amateur stations shall use the minimum amount of transmitter power necessary to carry out the desired coniinunications. c) Within the limitations of par­ agraphs (a) and (b) of this section, the effective radiated power of a repeater station shall not exceed that specified for the antenna height above average terrain in the table below.• • d) In the frequency bands 3700-3750 kHz, 71007150 kllz (7050*7075 kllz when the terrestrial location of the station is not within Region 2) 21,100-21,200 kHz and 28,100-28,200 kHz, the power input to the transmitter fmal amplifying state supplying radio frequency energy to the antenna shall not exceed 250 watts, exclusive of power for heating the cath ode of a vacuum tube(s). 69 Radio Teleprinter Transmissions. The following special conditions shall be observed during the trans­ mission of radio teleprinter signals on authorized frequencies by amateur sta­ tions: a) A single-channel five-unit (start- stop) teleprinter code shall be used wh.^^.a shall correspond to the Inter­ national Telegraphic Alphabet No. 2 with respect to all letters and numerals (including the slant sign or fraction bar) but special signals mav »»e employed for the remote coniiuk .j< ivceiving printers or for other purposes, in *Tigures*’ positions not utilized for numerals. In general, this code shall conform as nearly as possible to (he teleprinter code or codes in common commercial usage in the United States. b) The normal transmitting speed of the radio teleprinter signal keying equip­ ment shall be adjusted as closely as possible to one of the standard tele­ printer speeds, namely, 60 (45 bauds). 67 (50 bauds). 75 (56.25 bauds) or 100 (75 bauds) words per minute, and in any event, within the range of ±5 words per minute of the selected standard speed. c) Wlien frequency shift keying (type FI emission) is utilized, the de­ viation in frequency from the mark signal to space signal, or from the space signal to mark signal, shall be less than 900 hertz. d) When audio frequency shift keying (type A2 or type F2 emission) is utilized, the highest fundamental mod­ ulating audio frequency shall not exceed 3000 hertz, and the difference between the modulating audio frequency for the mark signal and that for the space signal shall be less than 900 hertz. 7.71 Transmitter Power Supply. The licensee of an amateur station using frequencies below 144 MHz shall use adequately filtered direct-current plate power for the transmitting equip­ ment to minimize modulation from this source. 97.73 Purity of Emissions. a) Tlie mean power of any spurious emission or radiation from any amateur transmitter or external radio frequency power amplifier being operated with a carrier frequency below 30 MHz sliall be at least 40 decibels below tlie mean power of the fundamental without ex­ ceeding the power of 50 milliwatts. For equipment of mean power less than S watts, the attenuation shall be at least 30 decibels.
