The requirement of a residential structure is a "leftover" from a predominantly farming community to assist the farmer in transferring lands to offsprings. The City has approved metes and bounds divisions before in the absence of residential structures. Staff will schedule a.Public Information Meeting as soon as the septic test results are received and reviewed. PUBLIC INFORMATION MEETING - SEPTEMBER 24, 1979 (STAFF UPDATE) Staff recommends for approval of the proposed metes and bounds subdivision of William Pearce based on the following conditions being met before final approval by Council: 1. Applicant supply a site plan for the 10-acre lot designating the proposed driveway, house location and approved drainfield area. 2. Certificate of survey designating the following: a) legal description for each of the two parcels involved. b) two designated wetlands as drainage easements per legal description enclosed. c) creek running through Parcel 1 to be designated by a 20' drainage easement. 3. Amendment of original driveway easement agreement serving the three parcels. 4.Quit Claim Deed for right of way for CSAH 6 to also include extended ditch area — to be deeded to County. 5. 6. However, at this point, I do not yet have a site plan indicating the proposed house and driveway location. These factors are critical in that logical location for driveway on the lot may occur near or within the tested.drainfield area. Item 11 > •* 1, The property was acquired with the sole purpose of upgrading to make a permanent residence for our family. The dwelling unit has been completed and represents a substantial improvement to the property, the neighborhood, and the City of Orono. The existing shed (which would be torn down upon completion of the garage) is an eyesore and is inadequate for a garage and storage area. The dwelling has no basement; therefore I would have to rent space elsewhere to have adequate storage for a permanent residence. 3. The existing shed is right on the property line, creating aestheti cally displeasing site lines. 4. Due to the poor soil conditions, I will have to construct the garage on footings some four feet below grade and the closer I get to the trees and root systems, the more likely the odds of destroying same. 5. Without the setback variance, the garage would be too close to the dwelling, creating a visual nightmare and causing a potentially dangerous fire condition. 6. The gas and telephone lines would have to be relocated if held to the setback requirements. 7. This area is currently under a moratorium for all buiiai g o^^Uonron substandard lots. The Huber residence currently houses five people in two bedroom. Based on a standard 75 feet. The house has 500 square feet of drainfield existing now which appears to be handling the Huber’s needs adequately. current standards for a four bedroom home, essentially only , one-fourth of the area required for one alternate or future drainfield would be left. Invariance and both had substantial area in which to expand the existing S: nrp;;Ao ,rlatly’ expand their family, that the existing substandard size drainfield is currently handling the existing sewage load, and that the Hubers expect to remain in the house indefinitely. All these factors are of course subject to change. The Planning Commission must decide whether or not to allow the addition based on the above facts and statements of facts below: 1.The subject property is within the Stubbs Bay Moratorium Area. To prevent the premature extension of costly municipal sewer and water services consistent with the adopted Comprehensive Land Use Plan of the City. It is just such proposals as that of the Hubers that have a high potential for causing premature extension of sewers. 3.The intent of the code is. to preserve adeq^.ate land area suitable for use as future drainfield in the unsewered areas. The code sets standards for the amount of area to be preserved. Also Section 22.20 3ubd. 5, states in part that: "No building permit, plumbing or mechanical permit shall be issued by the City for any expansion or alteration of a building or use connected to an existing on-site system, until such system has been inspected and certified by the City as being in compliance with this code. Whenever the addition of bedrooms, lumbing fixtures or mechanical equipment, or a change in the character or intensity of the established use is proposed, the City may require the review and/or replacement, repair, alteration or expansion of the existing system or any portion thereof." 1 I conter.d that the lot in question does not and cannot meet the intent of the code in preserving adequate area for future drainfield.
