I RESOLUTION NO. A RESOLUTION APPROVING THE PLAT OF SPRUCE ACRES WHEREAS, the City of Orono is a municipal corporation organized and existing under the laws of the State of Minnesota; and WHEREAS, the City Council of the City of Orono has adopted subdivision regulations for the orderly, economic and safe development of land within the City; and WHEREAS, the City Council has considered the application for a subdivision plat by George L. Osgood, the subdivider; and WHEREAS, the subdivider has completed all requirements of the platting regulations of the City, including; 1. Dedication on the plat of rights of way for public streets and roads, shown as Willow Drive. 2. Dedication on the plat of drainage and utility easements. 3. Creation of a new private driveway shown on the plat as Outlet A. 4, Payment to the City of a Park Dedication Fee of $300.00. 5. Payfnent to the City of engineering and legal review fees in the amount of $50.00. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Orono hereby approves the plat of Spruce Acres, Hennepin County, Minnesota; subject to the following conditions: 1. Lot 2, Block 1 shall have temporary access on the existing driveway and/or farm road through Lot 1, Block 1. Before a building permit is issued for Lot 3, Block 1, a new driveway shall be constructed in Outlet A to serve all three lots. Upon completion of the new driveway, all direct access from Willow Drive to Lot 1 shall be eliminated. 2. The aforesaid plat shall be filed with with the Hennepin County Recorder's Office on or before March 11, 1980 together with a certified original copy of this Resolution. The approval granted by this Resolution shall expire if the plat has not been filed by the date specified above. (Conley Brooks), Sixth Avenue North SUBDIVISION I have reviewed the soils report from Braun Engineering and find the results acceptable. A mound system can be developed on the subject 2-acre parcel near the south end. The accompanying system design has some minor technical flaws (tank sizes, sand absorption area, depth of rock) which will be rectified at the time of construction. Note,that Orono's On-Site System Design Manual dictates every design aspect of the mound system and effectively eliminates variatiotis in design which may have adverse effects on proper functioning of the system. Box 66 Crystal Bay, Minn. 55323 •X^ Dear Jean: After innumerable delays, a multitude of phone calls, much confusion but steady persistence on my part, I have ob­ tained fr jm Braun Engineering & Testing a Soil Boring md '^ercolatioa Test on the 2-acre parcel east of Brown Boad ana north of County Road 6 on which you and I have corres­ ponded and talhed a number of times. The report, ade­ quately signed in duplicate and with a vast array of charts and scientific data, indicates that we now have a site for a sewage disposal area and that this has been 9 proved by Mr. Mike Gaffron for the City of Orono. 1 have an understanding with the State of Minnesota and their representatives that they will permit access to this 2-acre piece from the dirt road which goes into the Wols- feld property just east of the site in question. There­ fore, there will be no need to go through the red tape of getting approval for a road from that 2-acre piece onto County Road 6. The property owners have been surveyed and all of that is conq>leted,- and I believe (and hope) that the necessary docu­ mentation for your approv^ of this site as a separate par­ cel has now been acconplished. Hy only remaining problem is to try to find someone who will pay me enough for'the 2-acre site to cover all of the Ex­ penses incurred to put it in merchantable shape. I hope all goes well with you. We have just sold our house with 2^ acres (Lot i) with a possession date for mid- October. We plan to keep the rest of our land and build a smaller house on the property's SW corner (Lot II). Ue will grant the new owner a per^tual easement to Lot I using the present driveway, extending it westward to reach our new house. In reviewing the enclosed ordinances, I will assume the following findings to be correct. 1) A conditional use permit is required for all antennas up to a height of 65' (Ord. 3A.033). 2) A conditional use permit is required to increase the height from 65' to 96.5' (Ord. 38.900). 3) A conditional use permit is required to increase the height from 96.5' to _ _ _ (Ord. 38.910). • Mr. Petersen has erected an 85' antenna and proposes to erect a 120' ®ntenna. He requests a conditional use permit for both. A variance to Ordinance No. 34.033 is required since he plans to erect more than one antenna. All setbacks appear to have been met except for the one facing the street. Please review enclosed site plan. The applicant may provide a certification of setback by a surveyor. Petersen 280 Orono Orchard Road Conditional Use Permit/Variance Page 2 #500 STAFF NOTE - AUGUST 30, 1979 I note for the record the following information received from the staff at the Orono Golf Course. The top of the 85* antenna collapsed after a severe storm some time in June and remained in that state for a few weeks, Mr. Petersen repaired the antenna without clearing it with the Building and Zoning Staff. At the time the applicant repaired the antenna, he had not filed a formal application with the City but he had been notified by the Building Inspector of the need for a conditional use permit and received copies of the sections of the ordinance on May 31, 1979. (See enclosure) Conditional Use Permit - Portion Points to consider in review of the conditional use permit application: 1. 2. Dimunition in neighboring property v'alues. Adverse visual ^pact factor - at what height does an antenna become incompatible in a residential neiguborhood? 3.In a residential zone should the height of an antenna be determined by the applicant's desired range of transmitting or receiving? 4. Does the very nature of this hobby suggest a certain degree of preparation or groundwork before one as knowledgeable and experienced as Mr, Petersen moves into a community? Please review the following section of the Ordinance: 32.460 Conditional Uses: Granting of Permit The City Council may grant a conditional use permit as the use permit was applied for or in modified form, if on the basis of the application and the evidence submitted, the City makes the following findings: (a) That the proposed location of the conditional use is in accord with the objectives of the Zoning Code and the purposes o^ the district in which the site is located; (b) That the proposed location of the conditional use and the proposed condition under which it would be operated or maintained would not be detrimental to the public health, safety or welfare, or materially injurious to properties or improvements in the vicinity; and (c) That the proposed conditional use will comply with each of the applicable provisions of the Zoning Code. I have defined the B-4 district on the enclosed plan. The applicant will argue for an extension of those boundaries, but we must hold to the 935 flood plain contour line. The Chairman's recommendation of rezoning the property to B-4 showed go^ planning sense. The property would be permanently designated for office use and the less restrictive requirements of the B-4 district may be applied. If the applicant wishes to continue, at a future meeting we can get into some in-depth discussion on a feasible ratio of compact cars to total parking area. Mabusth, Zoning Administrator September 4, 1979 ■i SUBJECT: 1510 Halley Land Corporation - Rezoning/Subdivision SKETCH PLAN REVIEW Request to rezone 15.32 acres of RR-IB to a light industrial-commercial zone. It approved to subdivide total acreage into seven lots, each to consist of 2 acres. The property was involved in a rezoning requested by Van Dale in 1978. The proposal was tabled and to be included as part of the Comprehensive Plan Study. The applicant at that time withdrew the application. It should be noted that the rezoning to industrial involved sewer service. This application is very similar to the type of industrial zone requested in the Judd Ringer proposal. I have been notified that Mr. Ringer was advised that he must arrange for sewer service from Long Lake if the property is to be considered for rezoning to industrial. There is no sewer available for this property located to the east of Old Crystal Bay Road. I think a very realistic picture should be presented to the applicant - if it is continued, the costs involved and the odds against approval. Standards for new zoning district: 1. 2. 3. 4. 2-acre minimum lot size. Applicant suggests a conditional use permit be required with issuance of each building permit as a variance from municipal sanitary sewer requirement. Industrial use that will not involve industrial waste. Discharge on site must not exceed that of a residential home. Subdivision Review - if continued: 1. Access - to be off Old Crystal Bay Road only. Road to be 60' wide with 100' cul-de-sac. There is a 20' easement running along the south edge of the property that has not been shown. Plat road to be private. 2. Lot width to be determined - how much frontage on plat road would be necessary? 3. Setback from existing residential structure. 4. Drainage - extensive drainage plans involving retention area, site grading plans, etc. 5. Septic testing for each lot.
