Mr. C.Thrie's existing septic system has been inspected and appears
to be functioning correctly. Ample area for future expansion has
been included on the lot.
Septic system testing on Lot 2, Block 1, Holly Acres, which is in^-ended
to be combined with Mr. Guthrie's remaining parcel, has been tested
and approved for a standard septic system. Note that testing on this
lot is generally at the crest of the ridge down the center of the lot,
and any driveway constructed should skirt this area.

A portion of the access change involves filling and the construction
of a retaining wall. The following list is a summary of findings
to be reviewed for the Conditional Use Permit:
1) Amount of fill - 376 cubic yards - 37 dump truck loads.
2) Proposed contours cited and to be reviewed by City Engineer.
3) Length of wall - approximately 50'.
4) Wall - concrete
above proposed grade - 7-1/2'
railing - 42"
Plans are being reviewed by the MCWD and City Engineer.
STAFF UPDATE - AUGUST 21, 1979
Please review the enclosed letter from the applicant's design firm
discussing the drainage issue. The letter confirms points cited by
the applicant at the previous meeting.
1. drainage directed towards County Road 51
2. garage floor elevation higher than center of County Road 51
drainage will flow towards highways drainage corridor
3. old parking area to be sodded, affprding absorption and
alleviating some of the erosion of gravel road parallel to 51
I have discussed these points with our City Engineer and he concurs.
His reviewing letter will be presented at the meeting. The LMCD has
not been heard from to date. As requested, we have enclosed copies
of the Minutes for a previous variance application.

The watershed is for the new driveway which is going to be directed toward
County Road 51.
This is possible since the garage floor is slightly elevated above the
center of County Road 51 and that highway has a drainage corridor that
will adjoin the new driveway.
Watershed in old parking area will be an improvement since it is hard
cover and will be replaced with black dirt and sod.
This watershed will be an improvement and will reduce the constant erosion
on the gravel easement road which parallels County Road 51.
If you have any further questions in regard to the watershed please do not
hesitate to call me.

ft?Mr. Noll is requesting «pproval of a variance
from our 75 ft. hardcover lakeshore setback
requirement for a concrete patio and sidewalk
which he has already installed.
He has installed approximately 740 sq. ft. of
concrete hardcover within the 75 ft. setback
limits.
On ilay 29, 1975, a representative from the D. F.
Vizecky Consc.*'action Company made application
this same pioject. He was denied the permit
for the hardcover and informed that crushed rock
or open wood hype v;alk and deck v/ould be permitted.
He was also informed of the option and procedures
for a request of a variance. Hr. Scheller
reported the project partially completed. A
violation tag was issued.
Mr. Noll pleaded guilty in District Court on
August 19,1975, conditional upon word from
the Orono Village Council,
Mr. Noll was then informed that the illegal
hardcover would have to be removed. He requested
an opportunity to make this application for a
variance before removing the concrete walk and
patio.
Planning Commission Action - October 21, 1975
The Planning Commission recommended to the Council
denial of the variance application of Richard
Noll due to the 75 ft. hardcover setback 'equire-
ment, because they felt added hardcover v. .s not
the only solution to the drainage problem and
because he had been made aware of the hardcover
restrictions and variance procedures, been denied
an application but proceeded with the work.
Mayor Searles stated that the variance apnlication
v/as after the fact and that there are other
alternatives to solving drainage problems within
^5 ft. of the lake and that applying hardcover
« was not a vicible solution.
V'/elsh moved, Butler seconded, to deny variance
to the 75 ft. hardcover setback. Motion,
Ayes (4) - Nays (0).
Mir. Harry Johnson asked the City Council vrhy water
runoff to Lake Minnetonka was such a vital issue.
Mayor Seeurles replied that storm v;ater runoff
is the greatest source of pollution to Lake
Minnetonka and that the degree of nutrients
determines how polluting storm water really is.

1. The requirement of a residential structure is a "leftover"
from a predominantly farming community to assist the farmer in
transferring lands to offsprings. The City has approved metes

Robert Van Tassel, 1170 Loma Linda Avenue
The Van Tassels propose redesigning the roof of their boat house,
from a peak design to a flat roof with a sitting area. The new
roof will afford a better view of the lake for neighbors as well
as the applicant. The building was inspected and found to be in
excellent condition. The proposed change will not effect the
hardcover calculation.
The structure is located within the 75' lakeshore setback and is
recognized as a legal non-conforming use. Ordinance prohibits
the extension or intensification of non-conforming uses.
31.108 Normal maintenance of a building or other structure
containing or related to a lawful non-conforming use is
permitted, including necessary non-structural repairs and
incidental alterations which do not extend or intensify the
non-conforming use. (Ord. 172, 12-19-74, effective 1-1-75)
Please review the following ordinances:
32.210 When Required A zoning ordinance occupancy certificate
shall be required for occupancy and use of any buildings hereinafter
erected or structurally altered; for new occupancy and use of an
existing building when the new use is of a different zoning
classification; for occupancy and use of vacant land, new use of
vacant land when new use is of a different zoning classification;
for any change in the use of a non-conforming use. Where appropriate,
the zoning occupancy certificate may be issued as part of building
permit.
32.410 Conditional Uses; Purpose In order to give the district
use regulation the flexibility necessary to achieve the objectives
of the Zoning Code, in certain districts, conditional uses are
permitted, subject to the granting of a use permit. Conditional
uses include those uses generally not suitable in a V^^ticular
zoning district, but which may under some circumstances be suitable.
When such circumstances exist, a conditional use permit may be
granted. Conditions may be applied to issuance of the permit and
a periodic review of the permit may be required. The permit shall
issued for a particular use and not for a particular person or firm.
Because of their unusual characteristics, conditional uses require
consideration so they may be located properly with respect to the
objectives of the Zoning Code and with respect to their effects on
surrounding properties. In order to achieve these purposes, the
City Council is empowered to grant and to deny applications for
conditional use permits and to impose reasonable conditions upon
the granting of these permits.

2. To recognize the change in use for the records. Planning
Commission to set limitation on new use (no future expansion,
no additional hardcover, etc. etc.).
3. Nature of reguest too sensitive for staff determination —
requires Council review.
The variance portion of the application, dealing with the request
to construct an 8' X 29.9 deck at the lakefront side of cabin, is
reviewed under the normal variance procedure - see enclosed.

for wetlands variance proposed as design is not

The applicant proposes construction of an office building in the
Navarre Area just to the east of uho Good Shepherd Church. A review
of the profile of the property poses r;.,un.lar concerns raised with the
Navarre State Bank application. In cases whore commercial and residential
zones intersect a property, it is the City's policy to limit the entire
commercial operation to the commercial zone.
In reviewing the site plan, I find a discrepancy in the supposed zoning
line presented in the application and the one designated in the Zoning
Code. See Exhibit A.
Legal description: "all of Lot 7 and the east 200 feet of the north
100 feet of Lot 6, Block 7, Towns!te of Langdon
Park; except wetlands."
I suggest that before an indepth review of this application is made by
staff, that the applicant must decide if his operation can function
within a 200' by 100' area.
Applicant's alternatives:
1. Present a new plan for 200’ by 100' area.
2. Request rezoning from LR-IC to B-1 for rest of area
to the north of the wetlands.
