Mabuath, Zoning Administrator July 17, 1979 SUBJECT: #493 D. D, Frink, 385 Tumham Road - SUBDIVISION Frinks propose a metes and bounds division of 39 acres into a 5 and 32+ acre lots. The sketch plan does not account for the 4 acres to the north of the main parcel (see plat map). The designated wetlands are not quite one acre. We will require a Flowage and Conservation Easement. Access to the larger lot f^ill also be via Tumham Road. Note the .08 acre of land involved in the Ring Route at the northwest comer. PUBLIC INFORMATION MEETING - AUGHST 13. 1979 Staff recomnends preliminary approval of the metes and bounds division of the D.D. Frink property subject to the following conditions: 1. The wetlands within the 26 plus acre lot to be designated in a future plat. 2. Park Dedication Fee of $100.00 IAvn nr^t Ken Chapman 2695 Shadywood Road Subdivision Page 3 #428 STAFF NOTE - JANUARY 19, 1979 Please read enclosed letter from Ken Chapman, The applicant has asked to reschedule his subdivision application for preliminary review before the Planning Commission meeting on February 12, 1979. Staff has completed the lot area survey requested by Commission member Hurr. If there are any questions please contact the City offices. PLANNING COMMISSION MEETING - FEBRUARY 12, 1979 Mr. Chapman was again advised of the fear of precedent setting if Planning Commission was to recommend approval of a subdivision where both lots are substandard. The applicant stated there is a possibility that his neighbor to the south has additional land for acquisition which would bring his lots up to standard. The applicant was informed that the plat would now involve the neighbor’s lot to the south. Planning Commission tabled the application until Mr. Chapman contacts staff. STAFF NOTE - AUGUST 4, 1979 Mr. Chapman has asked staff to schedule his preliminary subdivision (plan dated September 19, 1978) for action by the Planning Commission. He has decided against involving his neighbor.to the south in a three lot plat. Please read his enclosed letter. Mr. Chapman will require a decision by the City before he proceeds with expensive remodeling and an addition to his existing residence. If the property is platted, the existing house would have to be removed and a new home built closer to the lake affording Adequate setback from the division line. Review of Issues 1. At the sketch plan review. Planning Commission gave conceptual approval of the division and requested specific changes be made to proposal before preliminary review (see Minutes of October 10, 1978). It is at this stage that the area variance should have been noted as a concern and the applicant made aware of the Planning Commission's reservations before preliminary stage. 2. Majority of lot areas in surrounding neighborhood are substandard (review enclosed survey). 3. The surrounding neighborhood does not contain another "borderline lot" of two acres. 4. There is only one sewer and water unit charge against 2695 Shadywood Road. 5. .^ouse on lakeshore lot must meet 50' setback from private driveway and 75' from lakeshore. F f.-zy iTiTn itr*T^ %*• > • I MINUTES OF A PLANNING COMMISSION MEETING HELD ON OCTOBER 10, 1978 Page 3 It was noted that Don Murphy, Hennepin County Highway Department, after a preliminary review, advises that he would prefer a shared driveway using the existing entrance. This will require a driveway easement through the western lot to serve the east lot. Planning Oonmission indicated conceptual approval of the U>t division with a front and back lot with only the front lot having riparian rights and no construction variances would be granted. WORK SESSION - Mr. and Mrs. Noble and their contractor, Mr. Alexander, were present. It was noted during lengthy discussion that the wetlands had not been taken into considera tion of the lot area variance. It was felt that when tbe wetlands were included the variance would be approximately 70X. Staff will re- estimate the dry buildable area and hardcover calculations. The pond on the property is only a part of a more extensive wetlands, therefore, the reaction of the Conditional Use Permit was not very favorable. The applicant has requested holding tanks. Staff will review the sewer situation in the area in relation to this request. It was also noted that maybe the house was "too ambitious" for this lot The applicant questioned whether a neighboring division met the setbacks. Staff will review the setbacks (McDonald division), however, this application is asking for several variances, some of high percentages. a • Hammerel arrived. Wilson left. A RESOLUTION APPROVING THE PLAT OF NAVARRE COVE WHEREAS, the City of Orono Is a municipal corporation organized and existing under the laws of the State of Minnesota; and WHEREAS, the City Council of the City of Orono has adopted subdivision regulations for the orderly, economic and safe development of land within the City; and WHEREAS, the City Council has considered tiff application for a subdivision plat by Kelly Avenue Duplexes Company, a limited partnership, the subdivider; and WHEREAS, the subdivider has completed all requirements of the platting regulations of the City, including: 1. Dedication of Drainage Easements and Drainage and Utility Easements on the plat. 2. Dedication to the City of a Flowage and Conservation Easement (Exhibit A) providing for limitations on the use of "wetlands" as shown on the plat and as described therein. 3. Creation of an area designated on the plat as Outlet A to be used as a Joint use dock area for all three (3) lots, which outlot is to be owned and sjalntained by a homeowners association comprised of the owners of all lots in this plat. 4. Creation of an area designated on the plat as Outlot B which area is a lagoon and open water connected to the main body of Lake Minndtonka, which outlot is to be deeded to the City of Orono a public body. 5. The aforesaid plat shall be filed with the Hennepin County Recorder's Office on or before February 14, 1980 together with a certified original copy of this Resolution and executed copies of the Flowage and Conservation Easement, Exhibit A. as noted above, and a quit claim deed to the City of Orono for Outlot B attached as Exhibit B. 2. Public Notice that the existing duplex on Lot 3 is a legal non-conforming use of land pursuant to the current Zoning Code of the City of Orono. The approval granted by this Resolution shall expire if the plat has not been filed by the date specified above. J .• i / I • •# EXHIBIT 7 #5 TO:Jeanne Mabuath, Zoning Administrator FROM:Michael Gaffron, Septic System Inspector DATE: August 6, 1979 SUBJECT: Jerry Gustafson, 200 Bederwood Road Septic System Reconstruction In August, 1978, Mr. Gustafson called in and said he would like to add on to his existing dralnfleld system as mainly a precautionary measure. During my site inspection, I noted that the ground was fairly low and at that time required that a qualified person do a soil boring to determine soil types and depth to the water table. The boring log subsequently indicated that due to high ^Sfonn'a and generally clay soils a mound system was in order. Vk. Gustafson s contractor submitted a design which was approved by myself and verbally by the City engineer. Work was to commence in the Spring of 1979 after proper license and permit were obtained. I did verbally allow Mr. Gustafson to bring in sand fill for the system in the Fall of 1978 before a permit was issued. In Spring 1979, Mr. Gustafson brought in plans for a structural addition to his basement, presumably for a pump pit and added laundry area. As in all addition permit applications, a suwey was required. The survey showed that the existing house and proposed addition encroach upon the zoning setbacks. Mr. Gustafson is applying for a variance to allow the structural addition. In my opinion, successful completion of Mr. Gustafson's mo^d sewage system does not depend upon the proposed addition becoming a reality. The pump or pumps required in the system can be installed and Mde operable without the addition. Therefore, I would suggest that the addition ba reviewed based on Its own merits rather than as an integral and necessary component of the septic system.
