Mabusth, Zoning Administrator June 19, 1979 SUBJECT; #488 Mary C Staples, 860 Spring Hill Road Subdivision SKETCH PLAN REVIEW The applicant proposes a metes and bounds division of a 40-acre parcel into two lots: one a 10-acre parcel and the other a 30-acre parcel. The 10-acre parcel containing the original home and farm buildings will be sold to the Spring Hill Conference Center. The remaining 30-acre parcel will be for future development with sufficient access from both Spring Hill Road and CSAH 6. There are three relatively small designated wetlands Involved that we will require a flowage and conservation easement over. PLANNING COMMISSION MEETING - JUNE 25, 1979 Robert Mitchell represented the applicant. Planning Commission conceptually approved the proposed metes and bounds subdivision and advised staff to clarify the following concerns; 1) acceptable method of certifying setbacks of existing buildings for this large acre division. 2) Possible conflict with ordinances If both main house and guest house are subject to "llve-ln" use. 3) When to notify Spring Hill Conference Center of need for amending original conditional use permit filed with the City. STAFF UPDATE - JULY 16. 1979 < The applicant has been advised that a simple plan showing the existing structure setbacks 30* from the side property line will be adequate. The question of ’'live In” use by both the main house and the guest house should not be addressed In this application. This point would be covered In a future application by the Spring Hill Conference Center, amending their original conditional use permit. Ordinance requires adequate setback for the two structures and each building must have two acres. This would be no problem since the newly created lot Is 10 acres. Please review the septic Inspector's report. Staff reconmends preliminary approval of the metes and bounds division subject to the following conditions: 1. 2. 3. Gaffron, Septic System Inspector DATE; SUBJECT: July 12, 1979 Existing septic systems 860 & 900 Spring Hill Road #488 Subdivision - Mary C. Staples 860 Spring Hill Road - Main House - system consists of at least one septic tank and an amount of dralnfield. While the system probably does not meet current standards, it appears to be functioning adequately and no surface discharge was found. Adequate soils exist on the site for additional dralnfield, but the topography may make future repairs costly. 900 Spring Hill Road - Caretaker/Rental House - septic system consists of a tank and dralnfield both of which are in a low area of Hamel soils. While no discharge was observed, the system appears to be in poor soils and would be expected to fail if usage was heavy. I would suggest that if the Spring Hill Center wishes to renovate this house a new septic system be installed to comply with Orono codes. Halkerson: I had oood intentions of getting back to you after our last visit but current events have delayed my intended return visit with you, Charlie, apparently in 1973-74, discussions were held with the City Adrdnistrator and Spring Hill Center regarding a desire to initiate an agreement charging Spring Hill Center for services normally provided for all residents in the ^ity. Since Spring Hill is a tax exempt organization,‘the not recover its costs from Spring Hill through the tax struct , es we do other properties in Orono. Traditionally, tax exempt entities, as Spring Hill Center, have not reimbursed to their local City the cost to maintain public services and I do thin it would be to your advantage, as well as ours, to arrange an agreement providing cost'reimbursement to us for police ana fire protection that is available 24 hours a day. I have not the faintest idea of who dropped the ball on the discussions with the City, but we would like to renew these efforts when it is convenient for you. I will be at the University pf Minnesota all of next week, but I will be available after that to discuss this wfth you. It might be convenient to discuss this with your Board of Directors to determine how they would react to this arrangement. Thank you for your cooperation. Mabusth, Zoning Administrator IT jV: O' Ij DATE: SUBJECT: July 3, 1979 #489 KK & Kompany, 1140 North Arm Drive Conditional Use Permit - Change of Occupant involving a legal non-conforming use Zoivfi’g District LR-IB Keith Katcher and Tony Brown request a Conditional Use Permit to permit their boat operation in a residential district. The original use of an auto repair shop was recognized as a legal non-conforming use. The City requires a new conditional use permit when there is a change of occupant. The building inspector feels this operation is conducted under better supervision than the previous auto repair. The building and approximately 50' X 150' of land is rented by the KK Kompany from Leo Duehn. The company employs five full-time employees (3 for engine repair - 2 for boat refinlshing). In the Winter the operation slows down to two full-time employees. The hours of operation are 7:00 A.M. to 6:00 P.M. but in the summer It could extend to 8:00 P.M. depending upon work load. At the time of the Inspector's first call there were nine boats on the property; when I was out on a site inspection on July 2, 1979 there were only five. Please note the boats being stored to the rear of the property are not involved with this operation. STAFF UPDATE - JULY 12, 1979 Planning Commission advised staff to reevaluate this application for a conditional use permit. Planning Coiranission questioned "basis of authority for this body to act on the application" or could this type of request be simply reviewed by Sta>ff with the issuance of a Certificate of Occupancy. It is the Zoning Administrator's opinion upon review of the following ordinances and the issues raised by this new use that this application will require a new conditional use permit before a certificate of occupancy can be issued. All non-conforming uses actually and legally existing on December 1, 1974, shall be Issued a Conditional Use Permit upon application therefore not later than January 1, 1976. Such Conditional Use Permit shall allow the continuation of the non-conforming use to the same extent and degree as then existing on December 1. 1974. Such permits shall be granted without application fee and the Council shall. 1 *? limited in such permits to the full and accurate statements of the conditions pertaining to the existing uses. Such permits shall not be subject to periodic review. (Amended Ord. 172, 12-19-74, effective 1-1-75) Review of Issues to be resolved by Planning Commission: 1. Mabusth, Zoning Admlnistr .a DATE:July 16, 1979 SUBJECT: #492 Louis Smerllng, 2683 Casco Point Road Conditional Use Permit Purpose - restore lakeshore slopes to original grade and to control erosion. The applicant has held up his conditional use application until the Alexander Holzer permit was completed. The long delays involved with his neighbor's application and the heavy rains of this season have created a greater potential for additional erosion of the steep banks of his lakeshore property. Staff has called for action on the application for the July 23, 1979 meeting. The enclosed letters have been sent to both the City Engineer and MCWD for review. The project involves a 32' long area along the bank. The supporting timber structure or "retaining wall" will be subsurface with the necessary plantings above. It is true this site is well within 1,000' of lakeshore but the property is zoned B-5. The only commercial zone requiring hardcover consideration is B-2, lakeshore commercial. The hardcover factor is offset by the requirement that all B-1, B-3, B-4 and B-5 site plans include plans for runoff detention, sedimentation and erosion control, and grading. Issues to be reviewed: Application - Conditional Use Permit to allow retail operation covering 5,424 s.f. of building. Access -The access for the site shall be a shared one with the station at the most western portion of the lot. Access is to be at least 13' on the Zitzloff lot and 13* on the station's lot. I understand the iirfportance of a formal plat in most cases. Where many lots and many different potential owners are involved, a formal plat avoids inconvenience and disputes that could arise over descriptions and boundaries in all subsequent trans­ actions involving the property. Normally the costs of required surveying are small, especially when spread over many lots. Circumstances in my case are somewhat different. I propose to divide a tract of more than 35 acres into no more than two parcels, the smaller of which is larger than 10 acres. The costs of platting this property would be large -- three to four thousand dollars -- because the propeity includes more than 800 feet of shoreline. As matters stand I would bear all of these costs. On the other hand a survey required to establish critical lot lines and neces­ sary setbacks could be performed quite inexpensively.
