Zoning Administrator DATE:May 31, 1979 SUBJECT: #482 Loren KlitzVe 555/575 Oxford Road - Subdivision SKETCH PTJ^N REVIEW Zoning District LR-IA The applicant proposes realigning the shared lot line between lots 4 & 5 of the Stielow Addition. In the process of selecting a suitable house site for Lot 4, the original septic test locations became invalid and it proved necessary to test further south on Lot 5 for the only available and acceptable soils. The inspector has worked closely with the applicant and recommends the lot line change. Gaffron will report on the additional septic tests and Ihe effects on Lot 5 at our June 25, 1979 meeting. Staff recommends a shared access for both lots on cul-de-sac. An area calculation be requested for Lot 5 to determine need for area variance. Staff has scheduled a Public Information Meeting for June 25, 1979 at 7:30 P.M. planning COMMISSION MEETING - JUNE 11, 1979 Planning Commission conceptually approved the proposed lot realignment of lots 4 & 5 Stielow's Addition. The applicant questioned the extent of the wetlands designation on the original plat. Staff will reevaluate and stake the wetlands and drainage easements on both lots before surveyor calculates the dry bulldable area. Planning Commission has asked staff to review the effects of the realignment on the original septic testing for Lot 5. The Public Information Meeting will be held on June 25, 1979. STAFF UPDATE - JUNE 13, 1979 Staff made an inspection of the site and determined the designation of wetlands and drainage easements to be overly generous. The vetlands were staked, moving further west (toward lakeshore) about 100'. Lot 5 will show an increase of approximately 3/4 of an acre of dry buildable. The drainage easement could possibly be trimmed back but that should be determined by the City Engineer (see Exhibit A). Gaffron, Septic System Inspector DATE: SUBJECT: June 14, 1979 Loren Klitzke Subdivision (i?482) Lots 4 & 5 Stielows Addition This is essentially a lot line rearrangement which is necessary to allow a house and dralnfields to be located within the boundaries of Lot 4. Previous testing was approved on the lot in the area now proposed for house location. Additional soil testing has found suitable soils to the south of existing Lot 4. The line rearrangement will take advantage of these soils for use as drainfield. Due to a high seasonal water table, a shallow trench drainfield will be required. The alternate site would require a mound system. Movement of the property line to the south will also allow the driveway to be located on a ridge away from the alternate drainfield site. This lot line rearrangement will not encroach on the previously approved drainfield sites for lot 5. Due to the configuration of the house, I would recommend that 10' setbacks from drainfield to house and property lines be approved provided that roof drainage is channeled away from the drainfield. PLANNING COMMISSION MEETING - MARCH 12, 1979 Planning Connilsslon advised applicant that his application appears to be In violation of the Zoning Code. It was suggested that his 4>pllcatlon should be for rezonlng. He was advised to consult with staff concerning thg proper application for his proposed and/or existing use of property at 3220 Navarre Lane. STAFF UPDATE - APRIL 17, 1979 Staff met with Richard Proudfit and his attorney, Allan T. Quello. Mr. Proudfit reviewed the type of activities conducted on the premises. The company carries on a limited production schedule, preparation of "pre-production" samples and research and development activities. The firm employs five full time, day time employees and two employees on a night shift. The night schedule could run as late as midnight depending on the work load. There are usually three to four cars on the premises at one time and the U.P.S. makes deliveries and pickups during the week. We advised the applicant that this kind of activity could not continue In a residential-zoned neighborhood. Not only do the ordinances specifically prohibit such use, but the size of the lot In relation to the ambitious activities make It an Impossibility. The lot could * never afford the necessary parking. The City would allow the use as a temporary one. It was agreed that the developer would be responsible for phasing out the entire operation by May 1, 1980. The applicant felt the decision to be a fair one. Staff advised him to continue with the Conditional Use Application and to submit a current survey of the subject property. r ! Dear Ms. Mabusth: The undersigned represents Cardinal Tool which conducts a limited manufacturing operation at the above address. In our discussion at your office on April 17, 1979 we indicated to you that the company expects to continue the present use of the property for approximately one year and to thereafter phase out the manufacturing use and utilize the building for office space. Since occupying the building, the company has utilized the premises for research and development, limited production and the preparation of "pre-production samples". At the present time the company employs five persons who are fulltime, daytime employees, together with two employees who trork at night. Pour of these employees are local resi dents, and when I went to the plant, they told me that it was very convenient for them to be able to work locally. Mr. Proudfit is occasionally at the plant also; however, he does travel considerably. The hours worked as normal daytime working hours except for the two men who work nights. As to parking, there sre generally no more than three to fovir c^u:s on the premises at any one time; there is delivery and pickup by UPS during the week. 'it is the request of the company at this time to apply for an occupancy certificate for nonconforming use pursuant to the provisions of Sec. 32.250 of the Orono Code. I enclose herein a copy of a Certificate of Survey showing the boundary lines as well as the location of the building on the premises. The projosed brick trellis wall would be con structed in the nvanner indicated in the attached drav;ing and \iould be approximately feet in height. 'Ihe brick trellis wall would be constructed with the same brick material utilized in the existing front brick wall of the residence. The initial nine feet of the trellis wall as it emanates from the comer of the residence would be used to support an entry canopy extending over the front entry door of the residence. A rjortion of this entry canopy would also extend into the 35 foot yard set back by approximately 2 feet. DESCRIBE UNUSUAL PROPERIY COM)TTIONS: Due to the nature of this residential lot with respect to the extreme fedling topography in the rear portic»is of tlie lot as well as con sidering the significant areas of landfill previously deposited in an excavated area on this lot (both itesns shown on the attached drawings), it was necesscury to locate the residence in the location and to be positioned in the manner originally described on the site plan. However, it was barely conceivable to fit the residence on the site as required by the site conditions and still be in conformance with the zoning requirements, as indicated in the attached cor respondence from the surveyor, an error was made in interpretting the original site planned resulting in the residence to be staked out in error and subsequently totally excavated in error. The nature of this misinterpretation resulted in the residence being situated in a manner 20 feet closer to Partenvrood Road than originally contenplated in the site plan. Notwithstanding in this advertant occurrence the reside'nct’ itself still remains in conformance with the Orono zoning requ; r ^nents. Hewever, the proposed extension of the brick trellis Wcdl now extended in the manner s)xn>)n into the 35 foot yard setback as required. DESCRIBE UNDUE HARDSHIP C« PRACTICAL DIFFICULTY; Strict enforcement of the zoning regulations with respect to this matter would for one preclude the existence of an entry ceinopy. I believe a residence of this nature constructed within the City of Orono, or elsewhere for that matter, should be allowed to have a functioned entry canopy so as not to have the nain entry doors epen directly from an e)qx>sed outside area directly into the interior portions of the house. Further, strict enforcement of zoning regulations regarding this matter would also preclude the existance of any front entry defining mechanism which exceeded 42 inches in height. In this case, the dining room windows and entry doors and activities inwlving these areas inside the residence would be directly exposed to the street in frcxit of the residence. The proposed brick trellis vail is basically intended bo sipport the growth of vegetation (ivy) and oorresxond- ingly permit controlled visual contact from the dining room window and entry ctreas to the roadway at the same time attenpting to define the entry area as a sepeurate and private space frem the Partenwood Road right of way. : 1 li EFFT-CT OF PROPOSED VJORK: OKrr o <d> Tlie applicant believes that the request for variance in this matter should be taken in context with the proix^sod finished pixxluct as it relates to finish landscape emd finished grade planning.
