Niforopulos - Subdivision 250 Old Crystal Bay Road SKETCH PLAN REVIEW - Zoning District RR-IB 'The applicant proposes dividing 34.3 acres into two lots; a 16.3 acre parcel and an 18 acre parcel to be dedicated to the DNR. Last fall. Planning Commission approved the future park plans for this site. The lots meet all the requirements of the zoning district. We will recommend a metes and bounds division for this property. At the time of the original Dickey Subdivision, it was understood that the remainder of the property to the south would be divided by metes and bounds. PLANNING COMMISSION MEETING - APRIL 23, 1979 Planning Commission gave conceptual approval to the proposed two lot subdivision of Ann Niforopulos and set a Public Information Meeting for May 21, 1979. Zoning Administrator November 3, 1978 0 SUBJECT: #437 Larry Osgood, 365 Willow Drive North Subdivision SKETCH PLAN REVIEW Mr. Osgood proposes dividing 9.9 acres into a four lot subdivision. All lots meet the zoning requirements for the district (RR-IB). The existing building meets all setback reqviirements from newly created division lines. Mr. Osgood has fumished a septic report for Lot B, but we will require testing for Lots C and D, the septic inspector will inspect the existing system on Lot A. The ac.!ess road serving plat is located at the edge of a designated wetland along southern property line. The pre­ liminary plans should designate distance from road to wetland. A northern access would be out of the question because of the bridge approach and factor of zero visibility to north. PLANNING COMMISSION MEETING - NOVEMBER 13, 1978 Mr, Osgood was advised to consult with staff concerning t*'e eligibility of the property for a metes and bounds division, STAFF NOTES - NOVEMBER 16, 1978 Mr, Osgood was advised that to qualify for a metes and bounds division he would have to divide the property into two lots of five acres. He informed staff that he planned on deeding his son a two acre parcel only, Mr, Osgood will proceed with his original plan of platting a four lot division, STAFF NOTE - MAY 15, 1979 I Mr. Osgood will continue with a three lot division because of poor septic test results for original Lot 4. He will combine Lots 3 & 4. Lot 2 will use a temporary access through Lot 1. When the third building permit is Issued the access road must be constructed. Note the 50' corridor platted for Lot 3, Lot 2 is effectively land locked with this arrangement. The road must be platted as an outlet. We have set a Public Information Meeting for June 11, 1979. Gaffron, Septic Inspector DATE:May 15, 1979 SUBJECT:Septic System Site Evaluation 365 North Willow Drive - #437 George Osgood LOT 1 Existing house - septic system for the existing house has been inspected and needs only an inspection pipe installed in the second tank. The system is causing no visible problems and would appear to be entirely located within Lot 1. There appears to be ample room on the lot for future drainfield as necessary. LOT 2 i 1 Water table and percolation rates indicate a standard system will be acceptable for both primary and secondary areas on the lot. LOT 3 This large lot is combined with the formerly proposed Lot 4 due to poor soil conditions on Lot 4. A standard system will be acceptable for the primary system on Lot 3 and shallow trenches for the secondary. Note that both here and on Lot 2 the water table depth limits the suitable area for a gravlty*flow system and house placement may require use of a pump in the system. Please note that certain lots of the adjacent Woodhaven Subdivision to the immediate south of the Osgood property were approved by the City Engineer for mound septic systems in 1977. Testing on these lots found water table depths ranging from 12" - 17" much as were found on the previously proposed Lot 4 of Osgood's subdivision. Our present code states that a mound system generally is prohibited in any area where seasonal water table is not at least 2' below the surface. Development on the remaining Woodhaven lots will be carefully supervised by the City to ensure that ad quate sewage treatment systems are designed and constructed properly. The Marfields moved to Orono to take advantage of the quality of life afforded by Orono's "Estate Ares* and are very concerned about the effect of the Whalen's proposal on their privacy and quiet life style. The Comprehensive Plan for the City of Orono which was prepared in 1974 recognized the City's special attractions and the special desires of its residents. The establishawnt of zoning districts with generous performance standards provide the means of insuring that the goals expressed in the Cong>rehensive Plan can be met. After reviewing the variance request and several of the unique characteristics of this plan, we can only conclude that this variance as proposed, is detrimental to Mr. Marfield's interests. Certainly one of the major reasons for this conclusion is the inclusion of a public street in the plat. We noticed with interest that this was the only public street between County Road IS and Bc^'s Point and was clearly over-designed for servicing these three properties. The area in which the Dicon Addition is located is currently zoned for two acre minimum lots with 200 foot minimum lot widths. Although none of the lots in the Dicon Addition conform to the required performance standards, %«e were unable to find any indication that the City intended to vary from the purpose and/or intent of the LR-IA District in approving this plat. Gaffron, Septic System Inspector DATE: February 9, 1979 SUBJECT: Audrey Heiser Property, Lots 4-5-6, Block 2, Hillside Park testing and mapping has been done by Hickock & Associates to identify suitable areas for use as drainfield. s ss.".r.S" use as drainfield due to the proximity of neighboring wells and an field now and one future drainfield for the proposed home. This proposal requires a number of variances from the septic system ordinance: Required Proposed 1, setback variance for drainfield from neighboring wells.75'60' I feel this variance is allowable from a health standpoint since state code requires a minimum 50 setback if the well(s) are over 50 deep. Well to the north is 98' deep, well to the south is (by owner's understanding) about 200' deep. 2 Variance from requirement of 10,000 s.f. dedicated area for drainfield to allow 6,000 s.f. The 6.000 s.f. could be enlarged to about 7.000 s.f. by allowing drainfield up to 10' from property line rather than 20* in the code. PCA standards allow It from property lines. Also note that slopes on the drainfield site range from 16% to OX which is in the maximum range for drainfield. Special design considerations will be needed for the drainfield to ensure no sidehill seepage will occur.
