The plans have not been changed from the original proposal. Review of Items to be considered: Peview of access road by John Gerhardson, Public Works Coordinator 2. 3. Drainage approved as presented on Engineer's plan for plat road. Access road to be determined (private vs public). They scheduled a Public Information Meeting for May 7, 1979. STAFF UPDATE - APRIL 30, 1979 Our office has not received the soils report or the septic test report for each of the four lots. Preliminary approval cannot be given until the staff has had the opportunity to review the septic report. Please review the Engineer's letter of April 20, 1979. Zoning Administrator J1 M it DATE:November 1, 1978 SUBJECT:#435 - Richard Perry, Jr., 440 Willow Drive Variance & Conditional Use Permit Variance - Side Yard Setback (Zoning District RR-IB) Mr. Perry plans to construct a 22' X 24' garage five feet (5') from the southern lot line. The hardship claims arf> narrow lot width (82.5') and extreme grade of slope from middle of lot to the western lot line. Conditional Use Permit - Work Session The applicant proposes filling shaded area on diagram with an estimated 200 wublc yards of clean fill creating a level area for driveway, lawn and plant5.ngs. Hardship claims are extreme slope and hazardous driveway conditions In winter months. Staff recommends the applicant furnish an engineering report noting existing grade and proposed grades after fill, the effects on wetlands to the west and drainage area to be reviewed by the City Engineer. PLANNING COMMISSION MEETING - NOVEMBER 13. 1978 (Variance Request Only) Planning Commission recommended approval of Richard Perry's variance application for a 5* side yard setback. The applicant stated that it would be impossible to make the necessary turn for entering the garage If the building could not be located closer to the side lot line. The hardship claims were the narrow lot width and extreme grade of slope to west of lot. Planning Commission requested Council action on the variance application at the November 14, 1978 meeting because of the Inclement weather. PLANNING COMMISSION MEETING - NOVEMBER 13. 1978 (Conditional Use Permit) Work Session - Mr. Perry reviewed the proposed filling project along the western edge of his property and estimated that he had filled 100 cubic yards without a permit. The Building Inspector Issued a stop work order and required 50 cubic yards be removed from the fill area. Planning Commission requests an engineering plan for the project consisting of existing grade, proposed grade, amounts of fill, and City Engineer to study the effects on local flowage district. I November 1, 1978 Richard Perry, Jr, 440 Willow Drive Variance & Conditional Use Permit Page 2 #435 STAFF NOTE - APRIL 30, 1979 Staff regrets the delay in bringing this application back for action but an evaluation of the site by the City engineer could not be ^de until this past week. He recommends ditching to alleviate a ponding area caused by the fill. Staff locates the ponding area on the applicant's property. Mr. Perry has stated that he plans to correct the problem with additional fill and grading. He plans to fill in the same area with an additional 50 to 70 cubic yards of fill. We foresee no problem as long as the existing drainageway along Willow Drive is not affected. Mr. Perry has been informed by the MCWD that a permit will not be necessary for this application. The following points should be covered in your recommendation: 1.Set limit on additional fill to be allowed - Example - 70 cubic yards (7 dump truck loads) 2.Proposed grading to remove ponding area to be reviewed by staff on site with applicant. 3.Hay bales to be placed inraedlately to prevent silting and to remain until project is completed. 4, Set completion date for project, sometime this early sumner and require an Inspection by staff. % ✓ I I : I I i * / February 13# 1979 #435 City of Orono P«0. Willow Drire Long Lake, MN 55356 In regards to the concern about the wetlands area lying west of the Perry property, I have analyzed the filling to be done by Hr. Perry on his land. Prior to the filling, runoff from his land entered a ditch along Willow Drive, drained under his driveway through a culvert, and ttien continued through • culvert under Willow Drive to the wetlands west of his property. His proposed fill ing will not alter this pattern of drainage since the ditch and culverts will remain undisturbed. Because of the proxiaiity to the wetlands, this filling was also looked at in regards to the Minnehaha Creek Watershed Dis trict requirements. Since this filled area will be replanted with grass and trees, not hardcover, the runoff factor will re main the same as that prior to the filling. Thus the quantity of runoff wi|;l not be changed. To prevent silt from entexdng the wetlands, a oovpl9 of hay bales should be placed in the ditch during filling until the grass cover is established. If any questions arise, please contact me. The fill Is presently blocking drainage on the neighbors property In the trees south and east of the Perry property. PLANNING COMMISSION MEETING - APRIL 23, 1979 Neighbors in attendance noted the plat would involve an incressp in traffic on a road that is badly in need of repairs. They hoped the City was aware that the lake is steadily eroding the road base and wondered if the City had plans of rip rapping lake side. If the City plans to acquire all of Baldur Park Road who will pay for the repair and the new construction of portion intersecting Lots 18, 19, 20 and portion of 21 (lots owned by Theodore Boer, Erling Johnson and Arthur Gunderson)? The Planning Conmission requested that the plat road be moved to the most mid point on peninsula and that standards for a City road be required. In realigning the road, the variance for 75’ lakeshore setback is minimized Lot 2 will have a corridor or lip running to the cul-de-sac to satisfy ordinance requirements. STAFF NOTE - APRIL 30, 1979 Staff was asked to check the legal access issue with the attorney. If the City plans to make the remainder of Baldur Park Road a public road, then the access issue will be resolved by the City. -If the roadway is to remain private, then the developer will be responsible for resolving legal access. The new plan meets the requirements set by the Planning Commission. Staff reconmends preliminary approval of plat subject to the following conditions being resolved: 1. Wetlands - applicant enter into a Conservation and Flowage Easement Agreement with the City. 4. Soils overlay map will not be available until the meeting night. Width, length and placement of road easement to western property line from cul-de-sac to be determined. a) width - Planning Commission requires a 50' easement b) length: 1. cul-de-sac at original garage site 2. cul-de-sac at Lot 2's driveway further west 3. cul-de-sac at edge of west property line c) placement - Planning Commission requires 26' from wetlands STAFF NOTE - MAY 1. 1979 The Planning Commission Chairman and staff have agreed to bring a late entry, the H.R. Johnston appl'*cation, to the May 7, 1979 meeting because of a very brief agenda. His enclosed letter reviews his position and reference is made to some form of agreement with the Hendel family. I have not received the soils report but that need not hold up preliminary approval of the subdivision. Staff has reviewed the septic test, the inspector finds no serious concerns. His report will be ready for our meeting night. The applicant has^ asked for various considerations that appear to conflict with specific ordinance requirements and current policies. We will review those points sited in the letter: 1. Entrance Location A. Applicant - continue using existing one until fourth house is served. B. Policy - If more than two homes are served a different review standard is applied. City Engineer states driveway should be moved further north. (See letter of April 20, 1979) IL. Cul-de-sac A.Applicant f>.els there is no need for one as long as three or less homes are being served. i B.Current Policy and State Law states that it is every municipality's responsibility to ensure that emergency vehicles can serve each residence. In this case a cul-de-sac may not be the best solution. We will ask the City Engineer to make a recommendation. We have used our present driveway for over 27 years with safety. We believe it is attractive and an asset to the beauty of our property. Tlie lot has not been tested for a secondary drainfield site. Condilit.n and location of the existing systems has not yet been pinpointed; however, the owner thinhs his Sifptic tanks are to the west of the house. U’ell locatic>n, te-nnis court, stcc-p slopes, and hardcovcr/pioperty line setbacks as well as a 75' wetlands setback combine to severely limit future expansion area on tliis lot. Tt is likely that the existing system is partially within proposed Lot 2. I woiild recommend that based on location of the existing system and the need for a useful expansion area, the proposed lot line should be moved to the \jcst. Pending a final determination of the location of the existing system, it may be necessary to change lot configurations slightly to preserve the 2-acre dry buildable requirement. 1 LOT 2 - This lot has been tested and would require a mound system or both the primary and alternate fields, 'fhe testing was done near the proposed easterly lot line which may change. Again, the existing system for Lot 1 may be on Lot 2 and lot line changes may be in order. There appear to be adequate soil typos and useful area for drain field to accommodate various house locations. LOT 3 -Lot has been tested and w , *ld be acceptable for a standard drainfield. The lot is severely limited by wetlands on two sides and in the middle, all requiring 75' setback from drainfield The house location could be a critical factor on this lot. A house located anj’whore except abutting the easterly building setback could severely encroach on the useful drainfield area.
