Zoning Administrator io fesr- Q February 2, 1979 SUBJECT: lAD Development, 405 Oxford Street Subdivision SKETCH PLAN REVIEW The applicant proposes dividing Lot 1, Block 1, Stielow's Addition, a four acre lot, into two lots*. Mr. Stlelow had included the lot division in his original plat, but because of septic difficulties causing delay in final plat approval, he decided against the division. The septic difficulties involved a mound system design for original Lot 1 that would meet the approval of both septic inspector and City engineer. I understand that a mound system has received staff approval. Both proposed lots meet the septic requirements. Entrance - Both lots to be served by plat road - location of entrance subject to staff approval. Wetlands -Wetlands involvement for both lots must be determined and a new conservation and flowage easement may be required. Lot requirements - Lot dimensions have not been given. Staff unable to determine if variance is needed. It appears that the necessary 200' of shoreline is available. PLANNING COMMISSION MEETING - FEBRUARY 12, 1979 Planning Commission gave conceptual approval to the 2-lot plat proposed by the LAD Development Company and set a Public Information Meeting for March 12, 1979 at 7:30 P.M. Staff was asked to check the original Stielow plat file for additional information on flood plain and wetlands involvement for Block 1, Lot 1. The Planning Commission sited the difficulties of policing the renting of such guest house/apartments uses in residential neighborhoods. Is this use compatible in a 1/2 acre zoning district? The property was charged for one sewer unit. The City records show that the taxes for 1978 were not paid. The records show charges for a storage unit above garage not an appartment. Conditional Uses; Granting of Permit. They were unfortunate to inherit' ah existing non-conforming situation v;hich v;as never before brought to the attention of the staff, Searles moved, Welsh seconded, to approve the variance for Wayne Peterson, 1359 Park Drive, per the Planning Commission recommendation of August 2, 1976, Motion, Ayes (4) - Nays (0). Page 2 VARIANCE 1359 Park Drive (Continued) Henry Muhich, Building & Zoning Administrator, stated that Michael Curtis, 4200 North Shore Drive, now resides in a home which is located on a lot that does not meet the code requirements of 1 acre area and 140* lot width. He is ' requesting approval of a variance to add to the existing structure. The existing lot contains 11,000 sq, ft. and is 46* wide at the location of the house. This lot is therefore 32,560 sq. ft. short of the required lot width. The proposed addition would not conflict with the required setbacks. Planning Commission Meeting - August 2, 1976 The Commission recommended approval of this variance because the proposed addition would be replacing the substandard lean-to portion of the house, and it would in no way encroach on the existing setbacks. Paurus moved, Massengale seconded, to approve the variance for Michael Curtis, 4200 North Shore Drive, per the Planning Commission Minutes. Motion, Ayes (4) - Nays (0). VARIANCE 4200 North Shore Drive Henry Muhich, Building 6 Zoning Administrator, stated that Fred Ryan, 1345 North Arm Drive, is requesting approval of an addition between his house and garage. Although I have no building plans yet, he informs me that the setback between the structures would be only 4*. This would require a variance of 6* as our ordinance requires 10* between structures. This would not create a problem as we could treat the garage as an attached garage and require the necessary one hour fire wall in the garage to provide an adequate fire separation between structures. VARIANCE 1345 North Arm Drive (Continued) ORONO COUNCIL MEETING HELD AUGUST 9, 1976 Page 3 The existing garage extends over the lot line onto VARIANCE **^j*r®! Therefore, I would recommend 1345 North Arm Drive condition that the 5>s lots and the (Continued) ,.street be combined into one parcel, A sub­ division would then be required before any future proposal for additional building sites could be approved by Council, Planning Commission Meeting - August 2, 1976 The Zoning Administrator presented the building plans to the Commission, Mr, Ryan was present to explain his plans for this addition. The Planning Commission recommended approval subject to providing fire separation as required by the State Code and the combination of all the individual parcels and vacated street. The subject of the vacated street should be referred to the Attorney to resolve its actual status. Searles^moved, Massengale seconded, to approve the variance for Fred Ryan, 1345 North Arm Drive, as per the Planning Commission minutes of August 2, sxibject to verifying that all properties are part of vacation. Motion, Ayes (4) - Nays (0), Henry Muhich, Building & Zoning Administrator, stated that Travis Smith, 1945 Eagerness Point Road, originally obtained a building permit to construct a dwelling as located on the original survey. Either the owner or contractor changed this proposed location to the opposite corner. VThen we made our first footing inspection, the ^®obing ^ appeared to be set bac)c the necessary 30*. Without the proper engineering instruments, impossible to measure the horizontal distance over mounds of dirt and into 4* or 5* excavations. Since the building has been framed in, Mr, Larry Shaw, a neighbor, has turned in a complaint of encroachment on the rear lot line. We requested a new survey from the Smiths which they submitted on July 7, 1976. The new survey does confirm the allegation of encroachment. Since learning of this, the Smiths have submitted an application for a variance from the rear yard setback requirement. The location of the house as built is 26'8" from the rear lot line which is 3*4" short of the required 30* setback requirement. This parcel is one of the two resulting from the replatting of Fagerness Green Subdivision which was approved December 10, 1973. Please note the shaded shoreline area across the street from the subject property as shown on the enclosed copy of the Fagerness Green Subdivision. This shoreline area was evidently not included in this plat. Motion - Ayes (8), Nays (0). Mr Peterson explained to the Planning Coirmission that he had purdiased this property about 1 year ago. He under- sto^ there were misunderstandings, but felt that the problems had been solved. The Peterson's purchased this property in good faith. Pesek moved. Van 1,'est seconded, to approve this variance because it is after the fact and the pool has been tliere for the past three years. Pesek felt that this was not a violation by the Peterson’s idio purchased the property only one year ago. They were unfortunate to inherit an existing non-confonning situation w)iich was never before brought to the attention of staff. Motion - Ayes (8), Nays (0)T Mr. Curtis ivas in attendance and presented pictures of his property. Van Nest moved, Guthrie seconded, to recoinmend approval subject to providing fire separations as r^^r^ by the State Code and the combinaticjn of all the ^dividual parcels and vacated street. Mrs. Smith explained to the Conmission that at the start of the construction they instructed the contractor not to disturb the trees that were on the property in order to build the house. The l^ation of the house was then moved over to avoid removing the trees. The inspector was never informed of the change in lcx:atian. Larry Shaw, a neighbor to ^e north of the Smith’s was also present at the meeting. He expressed his disappointment with the building of this u *1* n*cntioned that he conplained several times to Uie building inspector regarding the building location. Smith’s home blocks his view of the lake. The Planning Commission felt that the only question here was the rear yard setback as the new sideyard setback requirements. Grant applied for by the City of Orono two years ago. The present Federal Demonstration Project and the previously applied for F.A.U. Grant are entirely different routes that, if approved by the two agencies, would require some City funding, F.A.U^ ($120,000, F.D.P, $37,500) which v;ould have to be supported by a mill levy. B CONTINUING LAND USE STUDY The Council's attention has been focused on the Stubbs Bay Marina site because of Mr. Johnson's requests for early study and policy decisions. Completion of the 73-1 sewer project. 2. Relocation and actual construction of a revised MWCC interceptor. 3. Completion of the HUD flood plain stu-y. 4. Revisions to the on-site code and institution of the inspection program. 5. A major change in attitude of the EPA and PCA regarding on-site waste treatment including possible funding sources. 6. A staff change in Zoning and Engineering, 7. For the first year building was used for storage and car repair which was basically the same for many years prior to my purchasing the building. Our use was a small section, the office and tool equipment. We also used the basement. The 2nd year the storage (Lake Van & Storage) moved out along with the car repair. We continued doing R & D with small molding of parts. During this time effort was put into the building and grounds due to the extreme run down condition. All junk cars removed, 3 truckloads of debris from a dump that was started in the rear of the building, weeds cut down plus painting the building. Also stopped people from filling in the wet land behind the building. We do not intend to change anything in .the future, but only use and continue what we've been doing for the last 3 years. The improvements are tremendous over what it used to be. We intend to change the outside decor to fit in more with the community, sketch attached. Olson - 2 -February 19, 1979 One of the biggest factors that has developed since we took over was to help reduce the vandalism. Because of the junk cars and repair kids were roaming around and breaking in. Rather than fight this we joined with a few of the neighborhood boys and gave them odd jobs, clean up. This really helped. We will continue this to help the young people become more active in the area. Also by having someone (2) in the building after hours really helped in curtailing the vandalism. Presently it is up to 12 PM. Because we are a very small company we only expect approximately 7-8 people, 4-5/day and 2-3/night. It is a very quiet operation with nothing on the outside of the building. Parking to amount to approximately 5 cars, some which will be parked in back, weather permitting. We have daily UPS with approximately 1 truck/week . We feel very strongly that we’ve really helped the community; not only cleaning up + helping the young people, but to restore decaying property and put a pride in our work. They request a Conditional Use Permit to function as a church. At the same time, the applicant requests a permit to lease the building as a Day Care Center. The center will operate from 6:30 A.M. to 6:00 P.M. Monday through Friday and will serve a maximum of thirty (30) pupils. The age of pupils will range from 2-1/2 to 6 years of age. Some will attend for a full 8-hour day and others will be on half-day schedules. Staff has met with the State Fire Marshall at the site. Mr. Hanley and the Orono Building Inspector will submit individual reports on safety standards to be followed. There appeared to be no serious problems for the applicant agreed to make all the necessary structural changes. I have been in contact with Carla Brown of the Department of Public Welfare. She informed me that Mrs. Cici's application is being reviewed and she foresees no problem. Mrs. Brown awaits final determination by Orono of the Conditional Use Permit. Mrs. Cici will have r- get approval from the Department of Health as the center will serve lunch ?nd snacks. She will report on this at the Planning Commission meeting on the 12th of March. Note the limited number of requirements for nursery schools in our Zoning Code (Ordinance No. 34.021). Olson, City Planner March 6, 1979 SUBJECT: North Central Study Area As a continuing part of our comprehensive plan review, I recommend that we next study the area shown on the attached map, generally bounded by Long Lake to the east, Medina to the north, Orono Schools on the west and the BN tracks on the south. There are several reasons which suggest that this area receive detailed analysis before completion of our Comprehensive Plan: 1. The change in MNDOT highway plans for TH12. 2. The pending construction of the Orono "Ring Route" link which may affect traffic on both TH12 and CR6. 3. The relatively new plans of Medina to sewer Medina-Morningside by means of a connection to the existing Orono line in Old Crystal Bay Road. A by-product of this work may include allocation or reallocation of sewer units in this area. 4. This area includes Orono's Industrial enterprises. The two major industries have recently expanded and the City should review their plans for future growth and/or the need for other industries to locate in the area. 5. Application 433 suggests a rezoning for new commercial/industrial uses on land currently unsewered. The feasibility of a sewer extension, or arrangements for connection to the Long Lake System, should be studied This also applies to the existing B-1 area north of TH12 and west of Brown Road which is also unsewered. 6. The land north of TH12 between Willow and Old Crystal Bay Roads is designated for multi-family on the 1974 plan. In view of land use developments, policy changes and the Medina sewer connection, this designation should be reviewed for conformity with current policy. The area is not in Orono*s sewer service area, but it already his some assessments and perhaps could have more. Is multi-family relevant? If so, over what area or what percentage of the area? At what maximum density? Given available, or future, sewer capacity, perhaps the maximum density can occur over only cart of the area. What options are available? March 6, 1979 North Central Study Area Page 2 7, There are several very large tracts of land still completely undeveloped. The City should review and restate current policy to guide any and all development in the coming years. 8. The area includes the new DNR acquisition of Wolsfeld Woods. The effect on Orono and on the immediate neighboring properties should be reviewed. For all these reasons and likely others yet to surface, I believe a review of this area deserves early priority. I recommend the Planning Comnission call a public hearing for residents and affected parties, probably at the first meeting in April. ^ I recommend the Council consider adoption of a moratorium ordinance for the area to prohibit new building permit and new subdivision applications. I see no immediate reason to stop review of any of the applications now pending. Orono has throughout the years been forced to provide sanitary sewer for certain dense areas in the lake area because of failing septic systems that were not maintained properly. There is no question that some of these areas required City sanitary sewers because of severe water table problems. It has been our experience in recent years that the cost to install public sewers has become ver^.^ expensive and in some cases prohibitive. It has also been our experience that of the many septic systems in operation very few are maintained properly, if at all, until a severe problem arises which generates a public outcry for public sewers. For these reasons, the City Co'uncil implemented an inspection program designed-to benefit each homeowner who owns a septic system. The benefits from this $25.00 yearly charge are: 1. Yearly inspection of septic systems 2. A record in the City Hall of the owners system, location and design 3. Availability of personnel when systems fail 4. An assurance that all systems are constructed property, and failing systems are repaired 5. Our last project in 1974 cost the honeowners approxinately $6,500 each. For these reasons, we beliovc that $25.00 per year is a small price to pay to assure that all on-site systems are operating properly or until such tine that City sewer is mandatory.
