Olson, Village Planner DATE:Septenber 19, 1978 SUBJECT: Mrs. Wyatt Moe, 1220 Loma Linda Proposed Culvert John Gerhardson and I have been discussing this proposal with Mrs. Moe for some time. In essence, she would like to extend an existing culvert to the lake. This Involves engineering review by the City and the Watershed; hence our request for an engineering design submittal. The proposal would also involve construction and filling within the lakeshore setback area; hence this Informal request for your opinion. Before engineering costs are Invested, Mrs. Moe would like to know whether or not you would consider this application. I stress that staff cannot review or issue any reconmendatlons until engineering data is submitted. The culvert should outlet at the normal elevation of the lake and rip-rap should be placed at the outlet. 2. The SMnhole could be constructed as a sump to collect de bris if there is a poasibility of san^or gravel collecting. 3. The owner ahould provide a 5 foot easement on either aide of the pipe if the line will drain property owned by any one other than Moe. If you have any questions, please contact this office. Mabusth stated she had the Affidavit of Publication and Certificate of Mailing. Mr. Moore was present for Mr. Chapman. Mabusth entered into the record two letters from neighbors: Letter from W, H. Nicholls, dated 11-27-78, whose main concern was setting a precedent of approving substandard subdivisions, and letter from Byron McCulla^, dated 12-1-78, who had "no objection to the proposed division of property so long as access to both lots is provided from County Road 19 and located within the boundaries of Mr. Chapman's property". He also enclosed a photocopy of the release of the 15' easement along Mr. Breustedt's property which was filed 10-10-78. Mrs. Hrobel was present, however, her main interest was seeing the actual proposal and,when asked if she had any comoents, stated she had no particular position regarding this division. The main concern of the Planning Comnission was setting a precedent of approving a subdivision of substandard lot area. It was stated that the 95X lot area does not take into consideration the driveway. The lot is assessed one sewer unit. Wilson moved to deny the application on the grounds that there is not sufficient area for two lots and no hardship has been sho«m. Motion seconded by Frahm. Vote: Ayes (5), Nays (1) Hurr was opposed to the motion as she felt the application should have been tabled until a study of the lot sizes in the area could be done. Motion passed.
