MINUTES OF A PLANNING COMMISSION MEETING HELD OH DECEMBER 10, 1979
The Planning Commission met on the above date. Present
were the following members: Chairman Wilson, Frahm,
Hammerel, Hannah, Jabbour and McDonald. Mabusth,
Olson and Gaffron represented the City staff.
Chairman Wilson announced the Public Hearing. Mabusth
stated she had the Affidavit of Publication. Olson
reviewed Council * s original request and directives for
amending the fence ordinance. Planning Commission was
to make recommendations for changes or additions for
Council's review.
Mrs. George Garske, 1265 Shoreline Drive, the only
member in the audience to address the fence ordinance,
presented photographs of her lakeshore property to
the Commission. She stated that the new ordinance
would prevent her from putting up a 6* privacy fence
along her side property line to block the site and
noise of the neighbor's dogs. The neighbors have
a dog run located 8' from their side property line.
The Planner commented that with the new ordinance
she could construct such a fence as long as it was
set 10' from her side property line.
Ad€nns arrived.
McDonald was concerned that non-conforming existing
fences or walls would be permitted to remain in place.
She reflected on the condition and type of fences or
walls constructed by the commercial marinas. She
questioned the City's ability to enforce the conditions
set forth in the agreements entered into by the marina
owners with the City.
Wilson questioned the taking of property owner's rights
by not allowing them to construct a privacy fence of 6*
on their own property.
Due to another public hearing, the following discussion
was continued after the public portion of the meeting.
Jabbour felt that the requirement of 20% opaqueness
was unrealistic and recommended adjusting this standard
to allow the construction of traditional wooden fences.
Adams felt that more than screening should be required
for dumpsters.

P' .nning Commission approved of the concept of natural
plantings to satisfy screening requirements. They
would also approve of a combination of screening and
fencing in commercial districts.
Section 38.958 Non-Conforming Fences was reviewed.
Planning Commission felt that if the maintenance and
repair portion was enforced, this would have the
negative effect of discouraging the upkeep of such
non-conformihg fences. They recommended changing
this section of the ordinance.
Adams made a motion confirming basic agreement with
the third draft of the fence ordinance. They would
recommend the following considerations:
1. Planning Commission is in favor of natural wood
fences of a 6* heighc in all rear and side yards.
They recommend 3*s' fences within the 75* lakeshore
setback area.
Rewrite section on non-conforming fences in
regard to maintenance of existing fences.
Reevaluate the setback distance for pools
that require fences.
Motion seconded by Hammerel. Vote: Ayes (6y,
Nays (1). Motion passed.
Jabbour felt that if the changes xequested by
the Planning Commission were acted on, we are not
changing anything from the existing ordinance.
Chairman Wilson announced the Public Hearing. Mabusth
stated she had the Affidavit of Publication. The
Planning Commission was in general agreement with
the draft although no motion was made. Their comments
are summarized as follows:
1. Ordinance should take into consideration the
question of the height of the accessory structure
in relation to the side or rear yard setback.
2. Clarify accessory structures and accessory
buildings question in ordinance.
Clarify the hardcover question in relation to
accessory structures.

Wilson questioned the need for Section 31.381 Docks
and Piers. Olson stated that this would be the first
time an ordinance of the City designated docks, piers,
etc. as accessory structures requiring building permits.
He also felt that this procedure was an excellent
opportunity to introduce the resident to the current
ordinances that govern lakeshore use.

Mr. Olson was present. Mabusth reviewed the subdivision ROBERT S. OLSON
for the Planning Commission because of the time lapse 4665 Bayside Road
sxnce preliminary approval and because of the new members. FINAL SUBDIVISION
Adams questioned the condition of the barn and the (Resolution)
applicant*s plan for future development of the property, §443
The applicant stated it was to be used as a hobby farm
and there were no plans to develop the property.
Hammerel moved to recommend final approval of the
Bayview Farms plat subject to the conditions cited in
the staff resolution (Page 3A & 3B). Motion seconded by
-^Frahm. Vote: Ayes (7) , Nays (0) . Motion passed
unanimously.
Mrs. George Steiner and her son Bruce were present.
Mabusth reviewed the lot line changes requested by
the Planning Commission. Adams restated his concern
that all lots were not being served by the plat road.
Two lots are to have access from Willowbrook Road.
The applicant was advised that the Public Works Director
would review the access locations. The County Highway
Department would review the existing access location
for serving a six lot plat. Planning Commission gave
conceptual approval to the Steiner, sketch plan.
Mabusth advised the applicant that preliminary review
would take place when the topographic map and soils
map are submitted to the City.

A RESOLUTION APPROVING THE PLAT OF
BAr/IEW FARMS

Ife;;:
WHEREAS, i:he City of Orono is a municipal corporation
organized and existing under the laws of the State of Minnesota; and
WHEREAS, the City Council of the City of Orono has adopted
subdivision regulations for the orderly, economic and safe development
of land within the City; and
WHEREAS, the City Council has considered the application
for a subdivision plat by Robert S. Olson, the subdivider; and

WHEREAS, the subdivider has completed all requirements of
the platting regulations of the City, including:
Dedication of drainage and utility easements on the plat.
Dedication on the plat of rights of way for public streets
and roads, shown as County Road No. 84.
Dedication to the City of a Flowage and Conservation Easement
(Exhibit A) providing for limitations on the use of wetlands
and/or drainageways described therein.
r NOW, THEREFORE, BE IT RESOLVED, that the City Council of
the City of Orono hereby approves the plat of Bayview Farms, Hennepin
County, Minnesota; subject to the following conditions:
This plat approval also includes approval of setback
variances for the barn on Lot 2, Block 1 and the shed on
Lot 1, Block 1 which do not meet current required setbacks
from property lines. Existing setbacks not to be further
reduced: 30 ft. rear setback for shed; 10 ft. front,
side and 66 ft. west: side setback for barn.•
The aforesaid plat shall be filed with the Hennepin County
Recorder's Office on or before June 11, 1980 together with
a certified original copy of this Resolution and an
executed copy of Exhibit A as noted above.

The approval granted by this Resolution shall expire if the plat has
not been filed by the date specified above. In that event, it ,
