MINUTES OF A PLANNING COMMISSION MEETING HELD ON JULY 23, 1979
The Planning Commission met on the above date.
Present were the following members: Chairman
Wilson, McDonald, Jabbour, Frahm, Adams and Hannah.
Hammerel arrived at 7:40 P.M. Mabusth represented
the City staff.
Wilson announced the Public Information Meeting.
Hannah vacated his seat for this application as
Bob Mitchell, applicant's representative, is also
his attorney. Mabusth stated she had the Affidavit
of Publication and Certificate of Mailing. Kathy
Gagne represented the applicant. The new plan does
certify that all structures meet the required
setbacks, although the bam cannot be used for
animals as that use would require a 150' setback
instead of the 50' setback shown. The guest house
will be handled under a separate conditional use
permit. No public comments were heard. General
consensus of the Planning Commission was that a
park dedication fee should be paid.
Frahm moved to recommend approval of the subdivision
siibject to a Flowage and Conservation Easement,
payment of a park dedication fee, and conditioned
upon the bam not being used for animals. Motion
seconded by Adams. Vote: Ayes (6), Vacated Seat
Nays (0). Motion passed.

Due to Mr. Zitzloff not being present at this time,
the item was tabled until later in the meeting
and was heard at the end of the action items.
Mr. Katcher, applicant, and Mr. Duehn, property
owner, were present. Staff has determined that
a conditional use permit is the proper application.
Ih:. Duehn operated ^an auto body shop for many years
until his health declined about a year ago. Since
then KK 6e Kompany has leased the building and
approximately 50' X 150' of land for a boat repair
business and Mr. Duehn has begm to store boats
on the eastern part of his property behind his
house.

The 'eneral consensus of the Planning Comnission was
the.,, the boat repair was the same type of use as
the auto body and was a cleaner, better operation.
Mr. Jeff Johnson. 1145 Loma Linda, was present.
He had no objection to the operation; his only
request was that a fence be placed between his
and Mr. Duehn's property to definitely separate
them. Planning Commission felt the number and
size u£ the boats being stored should be specified.

Wilson moved to recommend approval of the Conditional
Use Permit subject to the following conditions:

Fence to be constructed along rear lot line
(east line of property).
Boat storage, other than that serviced by the
garage, will be limited to no more than 20
boats on the property at one time.
No boats to be stored higher than bank on north
side of property.
Car repair permitted during winter months
(Oct. 1 through March 31). Repair to be carried
on inside the facility - no car permitted to be
parked outside, and
Subject to yearly review upon complaints by neighbors
or at staff request.

Motion passed unanimously.
Mr. and Mrs. Smerling were present. Mabusth entered
into the record that the Minnehaha Creek Watershed
District will not require a permit for the
construction of the wall provided that: 1) the
construction is above the 931.5 contour line,
2) wetlands are not involved, and 3) there are
no changes in the shoreline. No public comments
were heard.

Frahm moved to recommend approval of the Conditional
Use Permit for the retaining wall and refilling a
portion of the bank in accordance with plans
submitted contingent on completion by September 15, 1979
Motion seconded by Hammerel. Vote: Ayes (7), Nays (0).
Motion passed unanimously.

Mr. Wear was present. Mabusth entered into the
record a letter from Mr. Sidney Rebers who stated
that he could not attend the meeting and asked
that the variance request be postponed. The
consensus of the Planning Commission was that
Mr. Rebers had time to review the plans prior to
the meeting and since he had talked to Je5i-;:t»;
Mabusth on Friday and did not state any specific
objection, if possible, they would act on the
request and Mr. Rebers could appear before the
Council if he wished. Jhr. Wear is requesting
a 5* side setback variance and a 9' height
variance for this particular sign, however, he
feels he also will need an increase in the 200 s.f.
total signage allowed. He feels that the building
has three front sides and not one which sets the
200 s.f. requirement. At this point the Planning
Commission felt that the signage should be
presented as a total package (both highway sign
and all building signs) so that some definite
amount of signage can be determined.
Adams moved to table this application until a
complete signage plan can be submitted (both
highway sign and all proposed building signs)
showing size, graphics, landscaping, etc.
Motion seconded by Jabbour. Vote: Ayes (7),
Nays (0) . Motion passed unanimously.

fhr. Zitzloff was present. Frahm again vacated his
seat as he is a resident of the area and has
concerns regarding the drainage problems of this
area. The access will now be a shared access
with the gas station and has been approved by
Hennepin County. Signing has not been submitted
but code permits 175 s.f. Parking requirements
have been met.

Adams moved to recommend approval of the Conditional
Use Permit based on the retail/office space footage
shown and 39 parking spaces subject to;
1)

Developer to obtain permit from M.C.W.D.
Developer to obtain permit from Hennepin County
Highway Department for work within right-of-way.
Staff approval of landscaping plans similar to
those reviewed by the Planning Commission.
Staff approval of signage consistent with the
ordinances.
5) Approval of drainage proposal for this, property
and working out with Hennepin County the
drainage problems.
6) Shared access to west with gas station (13'
either side).
Motion seconded by Jabbour. Vote: Ayes (6),
Vacated Seat (1), Nays (0). Motion passed.
Polly Patch represented the applicant. It was
questioned whether or not a Flowage and Conservation
^sement would be necessary with this subdivision.
Staff will check into this before the next meeting.
Planning Commission gave conceptual approval and
noted that a Public Information Meeting will be
held on August 13, 1979.
Mr. Pearce was present. The majority of the
discussion was regarding the applicant's wish to
use a metes and bounds division even though the
subdivision includes a private roadway and a
residential structure does not lie within subject
property which indicates the need for formal
platting. Septic testing will be required for
the 10-acre lot due to the amount of wetlands
involved. The septic inspector does not see
a problem with the slope. Planning Commission
gave conceptual approval of the proposed plat
although the question of formal platting/metes
and bounds division has not been resolved.

Mr. Owens and a representative of Brauer & Assoc,
were present. The length of the cul-de-sac will
require a variance as code allows 500' and the
applicant is proposing 1,000' in length. It was
noted that Lot 9 cannot meet the setback
requirements as shown. In regards to the length
of the cul-de-sac Planning Commission requested
an overall view to consider if there were any
other access routes. They gave conceptual approval
of the plat contingent upon septic testing.
Mr. Guthrie was present. Planning Commission gave
conceptual approval of the proposed plat and noted
a Public Information Meeting was to be held on
August .13, 1979.
Hannah moved to recommend approval of the Minutes
as submitted. Motion seconded by Jabbour.
Vote: Ayes (6), Nays (0). Motion passed
unanimously.
