Review of proposed Fire Code Adoption Ordinance Public Hearing set for July 24, 1979 # MINUTES OF A PLANNING COMMISSION MEETING HELD ON JULY 9, 1979 The Planning Coramission met on the above date. Present were the following members: Chairman Wilson, McDonald, Jabbour, Hammerel, Adams and Frahra. Mabusth represented staff and Hurr was present for the Council. ATTENDANCE 7:30 P.M. Mr. Hussman and Mr. Hansen (Schoell Madson) were present. The majority of discussion was regarding the developer supplying a park area within the development. The general consensus of the Commission was that a development of this density should provide such an area; perhaps a "tot lot" for the smaller children. The applicant stated that tests have indicated there may be a possibility of lessening the size of the pond which could make room for a park area. However, further discussion raised concerns regarding maintenance as this specific P.R.D. will not operate under a homeowner’s association. Staff is satisfied with the plans and feels that the applicant has complied ^ with all staff requests. Hammerel moved to recommend preliminary approval of the P.R.D. based on the following conditions: HUSSMAN INVESTMENT CO. 3660 Shoreline Drive SUBDIVISION (#447) 1. 2. 3. Park dedication fee of $16,800 to be paid to the City before final approval. An escrow fee, determined upon preliminary approval. Final plans must designate the following: 6. 7. 8. 9. 10. 11. a) 7* right-of-way for County Road 15. b) 15* of additional right-of-way for Blaine Avenue. c) Western access (60* width) as designated on preliminary plans dated February 19, 1979, approved by Hennepin County Highway Department. d) 5* drainage and utility easements to be designated around each lot. e) drainage easement to west property line for discharge to Tonka Toys property subject to staff review. f) plat road 50* right-of-way and cul-de-sac to have 50* right-of-way radius. Approve extension of City sewer and water. Plat road to be public. Retention pond to be fenced. Landscaping plans to be reviewed and approved by staff. Two hydrants as specified by Mound Fire Chief. Tot lot be designed 75 X 80 ft. with maintenance being provided by either the owners or the City, which will be determined at a later date. Motion seconded by Adams. Vote: Ayes (5), Nays (0) Vacated Seat (1) Frahm. Frahm vacated his seat for this application as he is a resident of the area and has concerns regarding the drainage problems of this area. Wilson and McDonald requested that the record show that they approved of the proposed development but ^ were not convinced in regards to the requirement of the tot lot due to the concerns regarding maintenance. The subdivision is now for three lots due to septic systeii restrictions. The access road will be moved to the west. Plans have been submitted and are being reviewed by the City engineer. Applicant stated he would remove the existing road concurrent with the construction of the new access. Mr. Raiche was informed that a gravel road would be acceptable with this plat. RICHARD RAICHE 2901 Watertown Road SUBDIVISION (#471) Adams moved to recommend approval of the preliminary plat contingent on the following: 1. 2. o 3. 4. Applicant reach an agreement with the City Engineer for removing the existing road concurrent with construction of the new road. New road will be private road with underlying easement to the City. Plans (drainage, etc.) must be approved by the City Engineer and access location reviewed by the Public Works Director. Septic drainfleld sites must be designated for fill three lots as a basis for approval. Payment of park dedication fee $750.00 ($250/lot). y.r‘ Motion seconded by Hammerel. During discussion Frahm questioned whether the Commission should be requiring complete removal of the road or Just removal of the existing access. l.-ii . sSN-' ‘ E Vote: Ayes (6), Nays (0). m Mr. Safar was present. Mabusth entered into the record a letter from Edward Swanson, owner of property in the Partenwood Area, requesting that Orono not grant any variance in the front yard setback. JACK SAFAR 925 Partenwood Road VARIANCE (#485) -m-T# • MINUTES OF A PUNNING COMMISSION MEETING HELD ON JULY 9. 1979 PAGE 4 Road Mr. Safar presented a site plan. He stated that the house meets all setback requirements but that due to a surveyor’s error of 20' a variance would be required for the wall and canopy. An 18* variance is required for the farthest point of the wall because it is above the 42" height and a 2* variance for the canopy extending into the 35* front yard setback. The wall will be landscaped to soften the effect. Also present were Ma’ind and Gretchen Hurr, 930 Partenwood Road, who were v^pposed to any variance being granted as they contend that tl^ house violates the covenants of Partenwood. They presented pictures of the previous and existing grades. The Commission advised the Hurrs that the City cannot do anything regarding the Partenwood covenants. Mr. Safar stated that he would contact his architect to see if there is a more feasible way to achieve the canopy without the need for a variance or at least as great a variance as now requested. Jabbour moved to deny the wall and canopy as proposed but would be willing to reconsider the cenopy If resubmitted without the well. Motion seconded by Hammerel, Vote: Ayes (5), Nays (I) Wilson Wilson felt the Item should be tabled, he was uncomfortable handling the request piecemeal and felt the alternatives should be considered as a who^e. JACK SAFAR 925 Partenwood Road VARIANCE (#485) Cont. Mr. Foster was present. No public comments were heard. Mr. Foster presented tentative plans for the addition and remodeling. Most discussion was concerning the hardcover variance which was 61%, although it is consistent with the neighborhood. GORDON D. GORDON D. FOSTER 577 Park Lane VARIANCE (#490) Cont. Motion seconded by McDonald. Vote; Nays (1). Frahm was opposed to the hardcover variance and felt that the additional space could be achieved by a second story. Mr. Pope, the architect, was present. Mabusth stated that runoff detention, sedimentation and erosion plans must be submitted for City Engineer's review. Mr. Pope indicated on a site plan the area designated for runoff detention. The first floor will be occupied by the bank and limited office rental area and the second floor will be for office rental. FIRST NATIONAL BANK OF NAVARRE 2465 Shadywood Road BUILDING PLAN REVIEW (#491) Adams moved to recommend approval as submitted conditioned upon submittal and approvrxl of runoff detention, sedimentation and erosion plans. Motion seconded by Hammerel. Vote: Ayes (5), Nays (0), Vacated (1). Frahm vacated his seat as he is a resident of the area and is concerned with drainage problems which already exist in the area. m Mr. Katcher, applicant, and Mr. Duehn, owner, were present. Mabusth stated the building Inspector had made a site inspection and felt this operation is conducted under better supervision than the previous auto repair. Staff feels this use would be the same type of use.
