Tealwood Townhouse Project, Long Lake - Tim Adams # MINUTES OF A PLANNING COMMISSION MEETING HELD ON MAY 21, 1979 1*.^-S , The Planning Comniissibn met on the above date. Present were the following members: Chairman Wilson, Jabbour, Hannah, McDonald, Hammerel, Frahm Mabusth represented the City staff, Jo Ellen Hurr represented the Council. Wilson announced the Public Meeting. Mabusth stated she had the Affidavit of Publication and of Mailing, Applicant was not present. No public comments were heard. All requirements ^oon met, Frahm moved to recommend approval of the metes and bounds division of Ann Niforopulos Motion seconded by Hammerel. Vote: Ayes (7), Nays (0), Motion passed unanimously. ATTENDANCE 7:30 P.M. ANN NIFOROPULOS 250 Old Crystal Bay Rd. SUBDIVISION Public Info. Meeting 7:30 P.M. - 7:36 P.M. (#472) O Wilson announced the Public Meeting. Mabusth stated she had the Affidavit of Publication and Certificate of Mailing, Applicant was present. Also present were Mr. and Mrs. Whelan, 2435 Scotch Pine Lane, who had no objections to the proposed subdivision. Mabusth entered into the record a letter from Mr. and Mrs. Luke, 2465 No. Shore Dr. who did not have any objections to the proposed subdivision. Hannah questioned if the septic requirements were met. Mabusth stated they were met which resulted in the smaller lot being increased to 3.12 + acres. It was noted that the western lot line was not completely defined. Ms. Gluek felt this was an oversight of the surveyor. Main discussion was regarding the completion of this lot line, with the following alternatives being mentioned: 1) move lot line straight north, 2) follow the 930 contour line, or 3) run a straight line or a series of straight lines over to the easterly boundary roughly following the wetland area. (#474) ■■ ■m ,m mmM m: ■ • y' * pi- m o MINUTES OF A PLANNING COMMISSION MEETING HELD ON MAY 21, 1979 Page 2 Hannah moved to recommend approval of the subdivision contingent upon: 1.Prior to Council action, a continuation of the western lot line as determined by owner and surveyor subject to 3.12 + dry acres to accommodate the septic requirements. 2. Payment of park dedication fee. 3. Conservation easement for the wetlands. 4. Plat road to be designated as an outlot. Motion seconded by McDonald. Vote: Ayes (7), Nays (0). Motion passed unanimously. Due to staff error, the applicants and neighbors were not present. Adams moved to table the application until the June 11, 1979 meeting. Motion seconded by Hannah. Vote: Ayes (7), Nays (0). Motion passed unanimously. Applicant was not present. Staff finds no real problems with the subdivision except that the corridor does not allow access to Lot 3. Staff requests a 50' road outlot. A Public Information Meeting is scheduled for June 11, 1979. Mr. and ^hrs. Whalen and several neighbors were present.^ Mabusth inquired if any Commission members recalled the purpose of the utility easement. Although no one could remember the purpose, the consensus of the Commission and staff was that it could possibly have been for a road easement. Consensus of the Planning Commission was that there would not be a problem with vacating the utility easement. L.J. WHALEN 2435 Scotch Pine Lane VARIANCE/UTILITY VAC. Work Session (#478) Cont. The pool will require a front yard setback variance. Original request was a 25' setback, but it is^now 30*-31* setback which is a variance 19*-20'. There is no problem with hardcover anil the pool does comply with the 26' wetland setback. The majority of the neighbors present were in favor of the variance request, however, Mr. Samuel Marfield (2455 Scotch Pine Lane), was opposed. Present with Mr. Marfield was Mr. John Shardlow (Howard Dahlgren Associates) who has reviewed this request in regards to any effects this application would have on the Marfield property. Mr. Marfield felt that the pool should either be built in the Whalen's backyard |;^o variances would be needed or Scotch Pine Lane should be vacated which would also permit the pool to be constructed without any need for a variance. Mr. Whalen stated that a backyard location for the pool was not desirable as it is the only treed area on the lot, is narrow, and is accessible only to the garage and livingroom. Both Mr. Whalen and Mr. Marfield presented letters clarifying their positions which were given to the Commission members and staff. Applicant is to stake the pool so the septic inspector can make a site inspection- to determine if there is any interference with the septic drainfield. The application will be on the agenda of the Planning Commission Meeting of June 11, 1979 at which time a Public Hearing will be held on the utility easement vacation. 1 IL ■ ■ V.. . ir^; j J m minutes of a planning commission meeting held on may 21, 1979 Page 4 Mr, and Mrs. Williams were present. This item has been scheduled as a work session as staff felt the request was similar to the Watson application (#462) with common ownership the main issue. A policy determination decision which is before the Council at the next meeting could possibly affect this application, therefore, staff felt it should be processsed in this manner. Wilson stated that he did not see this as the same as the Watson application as there is plenty of land available in this application. Mr. and Mrs. Williams stated that they had purchased these lots filter there h?d been a variance granted making them a buildable lot in 1969, THOMAS WILLIAMS 455 Park Lane VARIANCE Work Session (#480) r, Staff was instructed to check the Council Minutes to verify the variance approval. This item will be on the agenda for the June 11, 1979 meeting. 'v** ^ :■ Applicant was not present. The consensus of the Planning Commission was that they would have problems approving Plan A and the applicant should proceed with Plan B. Picture of building (design, height, signs, etc.) 3. Drainage plans (calculate hardcover, volume of runoff and potential storage capacity of pond). It was stated that a driveway permit would be required from Hennepin County Highway Department. She stated she had contacted them and was informed that they anticipated no problems but suggested the access be as far south as possible. Frahro questioned the status of vacant land located at 2650 Tonkawa Road and asked staff to check it out. A Public InforL^tion Meeting has been scheduled for June 11, 1979. Van Eeckhout was present. The wetlands are presently shown as an outlot. Lot lines must be drawn through wetlands and designated by a drainage easement. Some of the lots do not meet the 200' lot width requirement. The plan will have to be revised to meet this requirement. Septic testing need to be done. Hannah moved to approve the Minutes as submitted. Motion seconded by Adams. Vote: Ayes (7), Nays (0) .
