Meeting of March 12, 1979 13. Meeting of April 2, 1979 •i.-. L r f- minutes of a planning commission meeting held on APRIL 9, 1979 The Planning Commission met on the above date. Present were the following members: Chairman Wilson, Hamraerel, Hurr, Hannah, McDonald and Adams. Mabusth* represented the City staff. Wilson announced the public meeting. Mabusth stated she had the Affidavit of Publication and Certificate of Mailing. No public comments were heard. Hurr questioned whether the plat met the requirement of 200 width at the building site. Although there are no designated wetlands on the property, the Hennepin Soils Department is reviewing the plat for 2-acres dry buildable. Hurr moved to table the application with question regarding compliance cf the plat with the 200* width requirement and receipt of the soils report verifying 2-acres dry buildable land. Adams seconded motion. Vote: Ayes ^6), Nays (0). Motion passed unanimously. Wilson announced the public meeting. Mabusth stated she had the Affidavit of Publication and Certificate of Mailing. Mr. Hoppe and his representative, fhr. Hassel, were present. No public comments were heard. All setbacks can be met and no problems with the soils is anticipated. Mabusth stated that the applicant should make the access application to the Hennepin County Highway Department. Most of the discussion was regarding the road requirements. The applicant was concerned with maintaining the quality of the existing road and stated that if the road was widened the filtration system would have to be removed. He was also concerned about the value of patching. There was some discussion regarding cul-de-sac versus turnaround. Hurr moved to recommend preliminary approval of the five lot plat subject to: 1. Developer enter into a Conservation and Flowage Easement with the City, Plat road to be reviewed by the City Engineer upon receipt of County's report on entrance requirements with a recommendation to try to maintain the feeling of the existing driveway and contingent on cul-de-sac meeting safety requirements. Mabusth stated she had the Affidavit of Publication and Certificate of Mailing, Mr. Lindsay was present. No public comments were heard. There was quite a lot of discussion regarding how the subdivision affected the joint use dock. It was decided that a joint dock (extending 25') would have less impact on the lagoon than single docks. It was also noted that by the zoning code only two single docks would be permitted, therefore, the joint dock was also more beneficial to the developer. The joint use dock license has already been issued by the City, but the applicant has not heard from the I21CD as yet. Hammerel moved to recommend approv.il of the preliminary subdivision contingent on: 1. Developer enter into a Conservation and Flowage Easement with the City. 2. Joint dock to remain serving all three lots because it is a lesser impact on the lagoon. 3. Recognize the duplex on Lot 3 as a legal non-conforming use Hurr seconded motion. Vote: Ayes (5), Nays: (0), Abstained (1) Hannah: He abstained because he is presently involved in pending litigation in Orono where some of the elements in this matter may be similar. mJAMES LINDSAY 2505 Kelly Avenu SUBDIVISION Public Info. Mabusth explained the changes reflected in the new plan, and stated that all three lots meet the zoning requirements of the district. Setbacks are not indicated on the survey, but the*:e appears to be adequate area and variances should not be necessary. Lot 1 will access directly off Bayside and Lots 2 and 3 will share the driveway. Adams questioned the merits of the City taking an underlying easement on a substandard road right of way. In discussion regarding future development of Lot 1 in relation to the road requirements, Hammerel stated that the topography of the land would prohibit much development The County is in the process of reviewing the access. Payment of Park Dedication Fee, Permit from Hennepin County Highway Department for access road. Approval of drainage plans by MCWD. Access to lot 2 will be over lot 3 of at least 30' width. Hammerel seconded motion. Vote: Ayes (6), Nays (0). At the end of the meeting, Hannah moved to table the application as the applicant was still not present to answer questions. Motion seconded by Hurr. Vote: Ayes (^5), Nays (0), ^McDonald had left earlier.) WAYZATA COUNTRY CLUB 200 Wayzata Blvd. SUBDIVISION/REZONINGi VARIANCE (#440) .•s Mr. and Mrs. Watson were present. Mr. Watson stated their reasons for the request, referred to their letter of March 6, 1979 and showed several photos of the lot. They also presented a petition (see Page 4A) with neighbors signatures supporting their request. It was stated that many lots in the area are smaller than this proposed lot. The property is sewered and has always been a separate tax parcel. ROBERT WATSON 2785 Shadywood Road ! VARIANCE (#462) Wilson moved to recommend approval of the variance for lot area and width on the hardship of no other land being available, the length of ownership, and reliance that it was a buildable lot when purchased, contingent on: 1. Staff checking if there would be a sewer assessment requirement. 2. No building variances will be granted. Motion seconded by Hannah. Vote: Ayes (5), Nays (0), Abstained (1) Hurr: Feels need for clarification of policy concerning common ownership of substandard lots. This action is not consistent with my understanding of the law - this lot lacks 140* width (103* lakeshore) but is somewhat consistent with the neighborhood. The Planning Commission has not been consistent in this area with variances for lot sizes, for example: Chapman (#428) with 117* lakeshore and just under one acre. The main concern was the traffic that would be generated by this project. McDonald requested staff to get a reconmendation from the police department. It was a general feeling that the four single family residences as a buffer would be a good idea. The main discussion was if an area within the development would be used as a playground. The general concensus was it could be an asset to the development. The Park Commission has been asked for their input regarding this issue. The road will be developed as a public road. Planning 'Commission gave conceptual approval as submitted with the possible addition of a playground vrithin the development and called for a public meeting on April 23, 1979. McDonald left. Mr. Johnston and Mr. Her fur th were present. It was stated that the existing garage would need a variance. The applicant was made aware of the 26* wetlands setback. Mabusth requested that the 16* access easement as shown be vacated and moved further south. Mr, Johnston was agreeable with this change. This application has been sent to Hennepin Soils Department for their review. A Public Information Meeting has been scheduled for April 23, 1979. HUSSMAN INVST. CO. 3660 Shoreline Dr. P.R.D. (/M47) y.-> Mr. Petersen was present. The road is now shown as a 20* outlot serving three lots. Staff feels a "T" would probably be the best solution for emergency vehicles. The applicant did not have any definite plans for "Outlot A" on the plans. Planning Commission requested that some decisions be made regarding the use of the Outlot by the next meeting April 23, 1979 when a public information meeting will be held. Planning Commission did state that if the plat was approved, no building variances would be granted for Lots 2 & 3. The application is being reviewed by Hennepin Soils Department. \m 10:05 P.M. Motion passed unanimously. 1979 APPROVAL OF MINUTES March 12, 1979 Page 4, Aramerman, Paragraph 2, amend the motion by adding: S "issuance of building permit and at final inspection compliance with the zoning code requirements for exterior storage."
