Mabusth represented the City staff.
Applicant was not present. The conditions of
preliminary approval have been met. There was some
discussion regarding exterior fthetic improvements,
however, these would be handled with the Conditional
Use Permit application. Hammerel moved to reco^end
approval of the subdivision in accordance with the
resolution prepared by staff (see Page 1 )•
seconded by Hannah. Vote: Ayes (7), Nays (0).
Motion passed unanimously.

This item was discussed at 9:30 P.M. when Mr. Oliver OLIVER
was present. Mabusth explained the request. Also
present was a neighbor Mr. Taylor who #458*
to the rebuilding of the guest house, xn he was #458
in favor of multiple dwellings in the area. Mabusth
staLd that she had a telephone call from Alden Pu^ey
of 3926 Cherry Avenue who did oppose the gues
because the house is in the process of
aoi the future use could change. Mr. Oliver then stated
that he has taken the house off the market. He furt
stated that he is aware that the unit can only be used
for personal use and not as a rental unit.
Hannah moved to recommend approval of the conditional
use permit to reconstruct the guest house, consisten
with the past structure, but conditioned upon use o y
as a guest house and not a rental unit subject to th
reapplication at the time of sale of the _
VoteT Ayes (5), Nays (2). Opposed: Hurr - ^at
kitchen facilities should not be permitted and wa®
concerned with only one sewer unit being assessed to
the property. Wilson - felt the specific use of the
guest house had not been shown and he was not convinced
the property would not be sold.

RESOLUTION NO.
A RESOLUTION APPROVING THE PLAT OF
TOURANGEAU ADDITION
i-WHEREAS, the City of Orono is a municipal corporation
organized and existing under the laws of the State of Minnesota; and
WHEREAS, the City Council of the City of Orono has adopted
subdf'-v Ision regulations for the orderly, economic and safe development
of land within the City; and
WHEREAS, the City Council has considered the application
for a subdivision plat by A. J, Tourangeau, the subdivider; and
WHEREAS, the subdivider has completed all requirements of
the platting regulations of the City, including:
1, Dedication on the plat of drainage and utility easements.
2. Execution of a Developer ’s Agreement providing for
installation of curbing, fencing and building improvements
prior to reoccupancy of the service station at
1960 Shoreline Drive, or prior to October 15, 1979,
whichever occurs first.
3. Legal combination for tax purposes of lots 7-14 and
20, Ora Park, Lake Minnetonka, as one residential parcel.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the
City of Orono hereby approves the plat of Tourangeau Addition, Hennepin
County, Minnesota; subject to the following conditions:
The aforesaid plat shall be filed with the Hennepin
County Recorder ’s Office on or before October 3, 1979
together with a certified original copy of this Resolution.
The approval granted by this Resolution shall expire if the plat has
not been filed by the date specified above. In that event, it will
be necessary to file a new application with the City of Orono for
subdivision review.

This Item was heard later when Mr. Wear was present.
Adams questioned the exterior finishing of the
building as to compliance with the B-1 zoning
requirements. Mr. Wear stated that the exterior was
going to remain as it was with the exception
adding a few windows and doors. The blocks are
waterproofed and ^h:. Wear stated he was really against
painting, however, he may in a couple of years paint
the exterior beige.
Hurr moved to recommend approval of the conditional
use permit for general office space pending building
inspector's approval of plans and installation of the
sprinkler system. Motion seconded by Adams.
Vote: Ayes (7), Nays (0).. Motion passed unanimously.
Mrs. Cici and representatives of the church were
present. It was suggested that the church and/or
Mrs. Cici should check with the highway department
regarding the possibility of obtaining traffic
signs warning the traffic of the church/day care
center. There was further discussion of the one
joint application versus two applications. The
Church expressed their wish to process the
application jointly. They stated they were aware
a new application would have to be made if the
church denomination changes and further stated
that the license of Mrs. Cici could not be
transferred so if the operation of the day care
changed a new application would also have to
be submitted to the City.
Hurr moved to recommend approval of the joint
conditional use permit of tLo Reorganized Church
of Jesus Christ of the Latter Day Saints and the
Busy Beaver Day Care Center conditioned upon
approval of the State Welfare Department, State
Fire Marshall (letter of March 9, 1979), and the
Orono Building Inspector (eight items listed in
his memo of March 19, 1979). Motion seconded
by Hammerel. Vote: Ayes (7), Nays (0).
Motion passed unanimously.

Frahm moved to recotmiend approval of the request for

Hurr questioned whether this should be acted on
separately or if it should be processed as a part

McDonald opposed the request because she felt the
grading and filling within 75' of the lakeshore h
not been properly addressed and she was opposed to
the seawall.
Hurr abstained as she felt it should be processed
as a part of the marina license application.
Mr. Anmerman was present. He Indicated

Mabusth stated that several neighbors had calle

It was stated that if the garage was constructed
only 3* from the property line a one~hour firewall
vould have to he constructed and the construction
cost would increase greatly. In further discussion,
Mr. Ammerman was asked if he would be willing to
place the garage 5' from the property line and he
agreed that would be acceptable.
Hannah moved to approve the variance application
for a 5* side yard setback contingent on the
exterior storage code being reviewed before
issuance of the building permit and at final inspection
compliance with the zoning code requirements for
exterior storage.' Motion seconded by Adams.
Vote: Ayes (7), Nays (0). Motion passed unanimously.
Mr. Rennebohm and his contractor, Mr. Hirsch,
were present. This property is part of the
Lawrence Plat which was approved in April, 1978.
No problems with wetlands were noted at that
time, however, the wetlands are quite extensive.
The original request was for a 20* variance to
the rear setback, but staff is now requesting a
30* variance so as not to interfere with the
alternate drainfield.
Hurr moved to approve the 30* variance request
to a 20* rear setback considering the primary
and alternate drainfield locations but expressing
concern for the lack of two acres dry buildable
land. Motion seconded by Hannah. Vote: Ayes (7),
Nays (0). Motion passed unanimously.
