New Application Form for Variance and Subdivision Applications -m- f: r C I MINUTES OF A PLANNING COMMISSION MEETING HELD ON FEBRUARY 12, 1979 The Planning Commission met on the above date. Present were the following members: Chairman Wilson, Hurr, McDonald, Hannah, Frahm and Hammerel. Mabusth represented the City staff. Due to the effort and time being spent on the Stubbs Bay Area Study, the joint meeting is being rescheduled for March 15, 1979. Hammerel announced he would be out of town on that date. Wilson announced the Public Hearing on the Wayzata Country Club application. Mabusth stated she had the Affidavit of Publication and Certificate of Mailing. Mr. Oberhauser was present. It was again stated that it is a joint project with Wayzata (8 units in Orono and 4 in Wayzata). Also present were John and Roxie Powers, 85 Ferndale Green, and John Engelmann, 70 Ferndale Green. Oberhauser gave a presentation (including sketches of the proposed units) and gave some background as to the status of the project in Wayzata. Main points were: -Access from the main entrance of Wayzata Country Club. -Land will be owned by the Country Club with a ground lease for the condominiums. -Underground parking (2 stalls per unit) and a visitors parking area are proposed. -Overall height of the units would not exceed 30'. -Sewer and water will be provided by Wayzata. -Regarding the Wayzata Planning Commission's position on the project, Mr. Oberhauser stated their main concern was setting a precedent along the Freeway strip. It is not conducive to PRD development according to Wayzata ordinances. The residents present felt the proposal was a nice plan; their main concern was that the access be off Highway 12. They also requested a legal opinion on using golf course land as open space. Wilson moved to table the application pending tunication with Wayzata. Motion seconded by H^nahr Vote: Ayes (6), Nays (0). Motion passed unanimously. Mr. Chapman was present. He has requested reconsideration of the denial action taken by the Planning Conmission on December 11, 1978. Staff noted that a comparison of the adjoining properties had been included in the packet. The main concern was setting a precedev^t of allowing a subdivision of substandard lot area. Planning Commission encouraged;and Mr. Chapman was willing; to try to obtain the necessary acreage from his neighbor to accomplish the 2-acre requirement of the district. Hannah moved to table this request until Mr. Chapman has the opportunity to investigate this possibility with his neighbor. Motion seconded by Hammerel. Vote: Ayes (6), Nays (0). Motion passed tmanimously. Mr. Valek was present. It was noted that all buildings are not indicated on the survey. The side yard setbacks for Block 1, Lot 4, and Block 2, Lot 4 were shown as 10* and must be corrected to 35*. A Public Meeting is scheduled for February 26, 1979. Mabusth entered into the record the City engineer's recommendations as outlined in his letter of February 2, 197?: Culvert should outlet at the normal elevation of the lake and rip rap should be placed at the outlet. The manhole could be constructed as a sump to collect debris if there is a possibility of sand or gravel collecting. The owner should provide a 5* easement on either side of the pipe if the line will drain property owned by anyone other than Moe. Mrs. Moe had reservations regarding the 5' easement since they are installing, maintaining and paying for the complete project. This item will be an action item on the Febrtiary 26, 1979 agenda. Mr. Kempf was present. There is no problem providing sewer to a lot on Loma Linda. An accurate survey is needed to determine total area (there was some division, not a horizontal division, should be pursued. Mr. Johnson represented LAD Development. This lot was originally going to be subdivided as a part of Stielow's Addition but due to the septic require­ ments and time limitations of the developer it was not done. The septic requirements can now be met and will be presented at the next meeting. Planning Commission requested that staff check the original Stielow Subdivision records for additional information regarding the flood plain and wetlands involved on this property.
