Meeting of November 17, 1980 INFORMATION ITEMS ■M 8. The Planning Commission Meeting of December 15, 1980 is cancelled. Council has postponed their regularly scheduled meeting for December 8, 1980 to Wednesday, December 17, 1980. Planning Commission's first meeting of 1981 will be Monday, January 19, 1981. 9. Joint Meeting of Council/Planning Commission is Wednesday, ^ January 7, 1981. The following members were present; Chairman Hammerel, Goetten, Jabbour, Frahm,. McDonald and Rovegno. Mabusth represented the City staff. Gary Lindgren, the applicant, was present. Rovegno advised him that the septic testing areas for the proposed on site systems occupied the most desirable building sites. Lindgren said he was aware of their location and stated he could see no problem at this time. Planning Commission advised that additional septic testing would be required if the house location became a problem. Rovegno questioned the size of the right of way d0SX9nati0d for W0St Branch Road. Staff oxplainod th0 width of these right of ways are determined by the Hennepin County Highway Department and that at the time of platting, the City would acquire the additional right of way now rather than share in the paying for it some time in the future. Staff noted that the preliminary plans did not designate the wetlands on the eastern lot. It would appear that the wetlands is located at the 935 elevation but this would be reviewed by the engineer. Hammerel moved to recommend approval of the preliminary plat of the Lindgren Properties based on the following findings: 1. Sufficient area for two lot plat, required 2 acres minimum of contiguous dry buildable land - 10 acres in each lot. 2. Satisfactory drainfield sites and septic design for each lot. 3. Plat is not riparian to Lake Minnetonka. 4. Approved access for both lots by Hennepin County Highway Department meeting all safety standards. and subject to the following conditions: , Flowage and Conservation Easement over entire wetlands area. 2. Dedication of additional right of way for West Branch Road - total of 40' from centerline. Dedication of drainage and utility easements. Motion seconded by Jabbour. Vote: Tvycs (6), Nays (0). Motion passed unanimously. Wilbur Anderson and the applicant were present. Cloutier explained that he was not prepared because he never received a written follow up advising him of his options of action. The Zoning Administrator noted for the record the letter of 11-12-80 and copy of Planning Commission minutes of 9-22-80 sent to the applicant reviewing the alternatives. Cloutier stated he must have misplaced the notification. The alternatives were once again reviewed for the applicant. They advised that if he chose to go with the original proposal, the Planning Commission would not change their original recommendation to deny. A new proposal for a relocated ^;vxest house and retention of one level boat house would require a new review. Rovegno questioned if applicant would have to apply for a new conditional use permit. Staff advised that this would be considered another variation of the original application. Mr. Anderson was concerned that Planning Commission would have to delay action again. He asked for assurance that the lakeshore setback for the proposed guest house would be determined by the existing structures in the neighborhood. Anderson was advised that this was part of the normal review and that the applicant would also be informed of the ordinance requirements. Rovegno moved to table action on the conditional use permit application of Cortlen Cloutier until the Planning Commission meeting of January 19, 1981 at which time the Planning Commission will act on either the original proposal or a new proposal accompanied by the following: 1. CORTLEN CLOUTIER 2480 Casco Point Road CONDITIONAL USE PERMIT VARIANCE (#555) Cont. / SR It Road 3 PERMIT SUBDIVISION (#589) Work Session The applicant was not present. New members questioned K. MCCL^Y certain conditions of the Stubbs Bay Marina Rezoning 3445 Bayside Road Agreement. Most of the concerns dealt with the extent of the variances necessary in an LR-IA zoning district. The Chairman advised that these were minimal compared to the violations cited against the marina operation. This agreement was the result of many compromises on the part of the property owner and the City and that concerns raised by this body will never change conditions of that agreement. Staff advised that the Commission should review the proposed plan to see if additional information is needed to complete review. Staff will require septic testing for gray water system. Access road should be designated for three residential units to be consistent with City's policy. A public hearing is scheduled for January 19, 1981 at 7:30 P.M. The applicant was not present. Staff advised that the applicants were required.by a rezoning agreement to complete a subdivision for the subject property. The ur.approved division occurred when the original owner sold a portion of the lot without the required City approval. A public hearing has been scheduled for January 19, 1981 at 7:45 P.M. JAMES P. RIVERS 1440 Shoreline Drive SUBDIVISION (#590) Work Session S*5 Section 31 SUBDIVISION (#591) The City of Orono proposes selling a three acre parcel “^oject of land to the DNR to be used as a parking lot. The Ringe Route project parking lot will be available to the usep of the Luce Line. The subdivision will be a metes and bounds division of a total 30 acre parcel lots. The 3 acre lot is substandard for the RR-lA zoning district. Planning Commission asked stap to check with DNR for plans that may be available for the proposed parking lot. Motion seconded by Goetten. Vote: Ayes (6), Nays (0).’ Motion passed unanimously. Joint Planning Commission and Council meeting is scheduled for January 7, 1981 at 7:30 P.M.
