Present were the following members: Chairman Hammerel, Frahm, Goetten and Rovegno. Mabusth represented the City staff. Robert White and Charles Bellows, attorney for the Woodhill Country Club, were present. Mr. Bellows advised that the trustees have never had an * opportunity to review the variance setback and that there will be a meeting of the trustees on December 4, 1980 at which time the variance will be reviewed. He advised that he would report back to this group once a decision is made. He stated that Woodhill would be most interested in any decision that may affect future development plans for the club's property. The Planning Commission advised Mr. Bellows that they will postpone all actions until they receive input from Woodhill. Frahm asked that in their consideration Woodhill address the possibility of selling a 20' corridor of land abutting the subject property line. Frahm moved to table the application pending report from Woodhill's attorney. He asked Mr. Bellows to have the trustees consider selling 20' corridor to Mr. White. Motion seconded by Hcunmerel. Vote: Ayes (4), Nays (0). Motion passed unanimously. Fred Herfurth represented the Wakefield Farms plat. Rovegno noted that the staff resolution required road to be upgraded upon subdividing. It was his understanding that an additional dwelling would necessitate upgrading. Planning Commission agreed approval could only be based on that condition. Rovegno moved to approve the Wakefield Farms plat subject to staff changing condition that road must be upgraded if an additional dwelling unit is served by plat driveway. Motion seconded by Frahm. Hepp reviewed his final proposal 2605 W. Lafayette Rd. asking for a horizontal division of two lots with SUBDIVISION "full" riparian rights for each lot. Hepp based his (#545) riparian credit on Planning Commission's interpretation of shoreline standard at their last meeting. Staff asked the Commission if shoreline deemed unnavigable could be credited for full ripari.^.; rights. In addition. Planning Commission would also have to recommend approval of a walkway easement through lakeshore lot to afford the necessary access. Rovegno noted that in the subdivision that created the Hannah lot, the City approved a walkway easement through a neighbor's lot to reach his shoreline. Again the Planning Commission cited Council's policy of crediting overall footage of lakeshore for full riparian rights for lots that do not abut the lakeshore. The question of that shoreline being navigable has never been addressed. Planning Commission advised that lagoon areas like this exist throughout the lake area and that a policy determination is needed. This specific lagoon was^ deemed part of Lake Minnetonka by Council and required a 75' setback. In this application Hepp has been asked to meet the same setback. Planning Commission contends that in approving a joint dock concept for the property, Orono's environmental standards would be best served as follows; 1. Retain dock at level of one owner usage - limit ■ of two boats per owner. ^ . 2. Lagoon area would be further protected by requiring an open space easement ~ applicant will be responsible for obtaining open space easement over Hannah's portion of lagoon. Frahm moved to recommend approval of Bruce Hepp's two lot riparian plat based on the following findings; 1. Findings; a) adequate area for two lot subdivision in the LR—IB Zoning District Lot 1 ” 1.6 acres; Lot 2-1 acre b) sufficient sewer and water capacity for Lot 2 c) adequate area of public street providing access for three lots based on following hardships; 1. 2. oul-de-sac lot has limited frontage on public St^lT00llcity encouraged third user of access by creating access easement for Hannah Lot - the repercussions of agreeing to this easement were not made clear to original owner and future buyer (Hepp). ^fllNUTES OP A PLANNING COMMISSION MEETING HELD ON NOVEMBER 17, 1980 - PAGE 3 In consideratipn of la^eshore and riparian credit: City has previously established a 75' setback from lagoon - lagoon is part of Lake Minnetonka (so designated in Hannah conditional use permit and variance application). At present the definition of the lakeshore standard of 140 feet of lakeshore does not distinguish between navigable and unnavigable shoreline nor does it specifically expand on concept of riparian rights. City has previously granted access to Lake Minnetonka via walkway easement as in Hannah subdivision. Planning Commission finds that this property meets requirement for subdivision of property into two riparian lots. As to lot configur­ ation, the Planning Commission believes the hor.’ zontal division with walkway acess and limit of four boats to one dock is environmentally more satisfactory than a vertical division. Conditions of approval: a) Creation of approved joint dock - maximum of two boats either stored, moored or docked for each lot. Walkway easement created in favor of Lot 2 by Lot 1. Open space easement over lagoon area. Driveway and utility easement created in favor of Lot 1 by Lot 2. Park Dedication Fee of $400.00. Common curb cut for two plat lots and Hannah property. Proposed house must be setback a minimum of 10' from each driveway easement - 20' wide easejnent serving Lots 1 & 12 - 14' wide easement serving Hannah property. All structures must be setback 75* from shoreline of lagoon. Motion seconded by Goetten. Vote: Ayes (4), Nays (0). Motion passed unanimously. BRUCE HEPP 2605 W. Lafayette Rd. SUBDIVISION (#545) cont. Planning Commission noted that both lots would be served by a private driveway easement located off a private road 20' in width. Hammerel moved to recommend approval of John Brooks plat subject to the conditions and findings noted in staff resolution. Motion seconded by Goetten. Vote: Ayes (4), Nays (0). Motion passed unanimously. The applicant's representatives were not present. Planning Commission did note that upon preliminary review the following additional information should accompany the site plan: 1. Hardcover calculation to include entire physical plant. 2. Determination of finished area and site plan to reflect total parking required. 3. Drainage plans. ^ Rovegno moved to table application pending receipt of additional information and time for staff to review. Motion seconded by Hammerel. Vote: Ayes Nays (0). Motion passed unanimously. (4) ) JOHN BROOKS 795 North Ferndale Road FINAL SUBDIVISION (#551) FIRST NATIONAL B7UJK OF NAVARRE 2465 Shadywood Road COMMERCIAL SITE PLAN (#491) Mr. Hussman was present. Planning Commission noted the chauiges from the original PRD applied for last year. Applicant stated that unless the interior plat road could be shortened, he could not continue with the new subdivision application. The improvement costs i.ivolved were too great with the original plat. The new plat has 20 units (4 single family dwellings all served by Blaine and 8 duplex units to be served by the plat road). A park area has been designated on this plan and will be referred to the Park Commission for review.
