ATTENDANCE 7:30 P.M. The zoning Administrator asked that discussion on this item be postponed until the applicant, Frea Herfurth arrived. FRED HERFURTH 560 Old Long Lake R< FINAL SUBDIVISION (#511) Steve Wilson, applicant's attorney, and Mark is approved and that Planning Commission may act on the preliminary subdivision. Wilson reviewed the reasons for Lot 4 lacking the necessary area requirement as follows: H.R. JOHNSTON 925 Willow Dr SUBDIVISION (#582) So. • i 4 1. In the original subdivision, the Gifford lot required additional drainfield area from Johnston lot. The developer included the drainfield by creating a jog in the lot line, but Council wanted a straight line thereby taking more dry buildable area from the Johnston lot. 2. Feasible or logical position of plat road created even more of a loss. Location of road saved many trees and alleviated need to fill in steep slopes. Plat road outlot could have been placed closer to 930 contour. .3 acres of Lot 4 was’now located on north side of roa • Total dry buildable area for Lot 4 is 1.92 acres. Lot 2's septic area. Gronberg reviewed a topographic map that designated this limited drainfield area for the western lots. He noted that wetlands setback, high water level at 930 elevation and steep slope severely limits drainfield construction for Lots 1, 2 and 3. JwiT Jl i 11 #. MINUTES OF A PLANNING COMMISSION MEETING HELD ON NOVEMBER 3, 1980 - PAGE 2 Planning Commission noted staff's concern for Lot 1,Block 3 and the need to protect the drainfield area at time the road is removed. Frahm moved to recomiaend approval of H.R. Johnston's six lot plat allowing the area variances for Lot 4, Block 1 based on the following findings: H.R. JOHNSTON 925 Willow Dr. So. SUBDIVISION (#582) cont. 1. 2. 3. City has agreed to sell 1.2 acre site. On-Site Manager has approved standard trench system for all 5 undeveloped lots and each satisfies area standards for alternate drainfields. Plat represents satisfactory density ratio of six lots to 16 dry buildable acres. Lot 4 consists of 1.6 acres of contiguous dry buildable requiring a variance based on the following hardships: K a) Moving lot lines will severely limit drainfield area for Lot 2, Block 1. b) Present location of road has rendered certain areas of dry buildable land useless. Location of road has saved many mature trees and limited amounts of fill. City's requiring a straight line defining mutual lot line between Gifford and Johnston lot caused existing area deficiency. If line was drawn just to take in drainfield area, lot 4 would have the required area. c) d) Motion seconded by Rovegno. Vote: Ayes (4), Nays (0) Motion passed unanimously. James Henninger and Richard Speeter were present. Mabusth reviewed the comments of the district limnologist. He reports there was no adverse impact on the lake when the culvert was removed but neither will it affect quality of the water within the lagoon. Control of erosion will cut down on the siltation problem in the lagoon and limit frequency of dredging. SPEETER/HENNINGER 659 Mtka. Highlands Ln COND. USE PERMIT (#586) Planning Commission advised applicants of the City's position concerning dredging of the lake and it's policy to limit dredging whenever possible because of the environmentally harmful effects on the lake. If application is approved Council may limit dock use to island area and refuse a fe request to dredge lagoon area. Applicants acknowledged the Planning Commission's forewarning and stated they would wait for some time in the future to plead their case fof dredging. Rovegno moved to recommend approval of the Speeter/Henninger application to construct a permanent bridge across newly created channel subject to the following conditions: SPEETER/HENNINGER 659 Mtka. Highlands Ln. COND. USE PERMIT (#586) Cont. Both applicants to continue docking on main lake of North Arm. Speeter must acquire permanent access easement via Henninger property for dock access. City to require rip rap at mouth of culvert to prevent further erosion and siltation. Applicants should be advised that once permanent dock access has been secured, historically applications of this type requesting dredging may not be approved by the City. Motion seconded by Goetten. Vote: Ayes (4), Nays (0). Motion passed unanimously. 1. 2. 3. 4. i Bruce Hepp, Russell Baumgardner and John Hannah -iT BRUCE HEPP were present. Hepp stated that of the many plans 2605 W. Lafayette Road presented to the Planning Commission, he feels the SUBDIVISION ^st acceptable is the original "horizontal” division. (#545) Work Session He notes that one lot does ’not abut lakeshore, but feels he has right to riparian access based on excessive amount of lakeshore (265* on main lake and 140'+ on lagoon). Planning Commission discussed the question of the lagoon area shoreline and if it could be considered for riparian credit. A brief review was made of previous applications dealing with this issue. 1. Hannah variance and conditional use permit application ~ subject lagoon required 75' setback, same as lakeshore. Ministers Life - riparian outlot created on basis of 1,420 feet of total shoreline or 236.6' average frontage for each lot. m MINUTES OF A PLANNING COMMISSION MEETING HELD ON NOVEMBER 3, 1980 - PAGE 4 Staff questioned if navigability had any bearing on shoreline credit. Planning Coimnission stated that some of the shoreline credited on the Tanager Lake side for the Green Trees Plat was not navigable. Staff stated that a dock of 100' or more could have been constructed in the questionable area and become accessible to boats. Planning Commission all agreed that the lagoon shoreline can be applied for riparian credit and they advised the application that this can be achieved by a walkway easement not to exceed 10' in width and both lots to share a dock with each lot allowed a maximum of 2 boats either moored or stored. Planning Commission advised Hepp that they would be prepared to act on his 2 lot riparian plat at their November 17, 1980 meeting. O Gary Lindgren was present. Lindgren proposes a plat of two lots from a total of 20 acres. Staff advised that septic testing for the two lots would be required because of the marginal soils and extensive wetlands. Staff advised that a Public Information Meeting would be scheduled for December 1, 1980. The applicant was not present. Frahm moved to table the application. Motion seconded by Goetten. Vote: Ayes (4), Nays (0). Motion passed unanimously. Jabbour moved to table the final subdivision approval pending resolution of the following concerns: 1.Original application was based on two lot subdivision; this division contains three lots. 2.Proposed road is not acceptable for a three lot plat - a cul-de-sac should be provided at three lot density. 3.Park fee is not accurate for a three lot plat; two newly created lots require $200.00 ($100.00 for each 5+ acre lot).
