Present were the following members: Chairman Hammerel, Adams, Frahm, Hannah, McDonald and Wilson. Mabusth represented the City staff. ATTENDANCE 7:30 P.M. © The Chairman asked that all action ii.'r.'.s be postponed until agenda items involving the public were reviewed. The work session for the Carol Moore Subdivision was introduced. Mabusth reviewed the changes in the application since the staff memo was written. Richard Hawkinson, the abutting property owner to the east, has joined in the subdivision application. The plat will now consist of a four lot division with a private road designated by a 50' road outlot. There is a designated wetland of approximately 2+ acres that we will require a flowage and conservation easement over. Planning Commission questioned the need to acquire future road right-of-way to the southern lot line. Wilson noted before a determination could be reached, a plan showing the existing and unimproved roads in the surrounding neighborhood would have to be reviewed. Staff will submit plan for the Planning Commission meeting of March 17, 1980. Staff was asked to recheck the ordinances to see if a setback variance for the animal barn from the east lot line of Lot 2 is required. The applicants were advised to have the agent responsible for the septic testing on the subdivision to contact the on-site systems manager. Planning Commission called for a Public Information Meeting on March 17, 1980. CAROL MOORE 4701 W. Branch SUBDIVISION Work Session (#538) Road m. Planning Coiranission reviewed the telephone poll taken of each member giving unanimous approval to the rezoning application of James McCleary. The property will be rezoned to LR-IA, Lakeshore Residential, 2-acre minimum lot size. McCleary will continue with a limited marina operation for the 1980 season. Wilson moved to recommend approval of the McCleary rezoning agreement. Motion seconded by Hammerel. Vote: Ayes (6), Nays (0). Motion passed unanimously. STUBBS BAY REZONING Planning Commission Recommendation © MINUTES OF A PLANNING COMMISSION MEETING HELD ON FEBRUARY 19, 1980 PAGE 2 Adams questioned the increase in restrictions for agricultural accessory structures - referring to Section 31.382. Mabusth noted that the existing ordinance would require variances for such structures as opposed to a conditional use permit. Ad€uns noted that this still would involve a minimum of three meetings and a possible condition of applying for such a permit yearly. Mabusth agreed that a conditional use permit would involve a minimum of three meetings but she doubted if annual review for a permit of this nature would be required. PROPOSED AMENDMJJNTS TO ACCESSORY STRUCTURE ORDINANCE Planning Commission Recommendation Wilson asked for the following sections to be rewritten for clarification: 31.320 Height Restriction a) Storage shall be permitted in attic or loft spaces of one story accessory buildings. This is not clear ** does this mean in this case this structure could exceed 20* if use is made of loft area. 31.342 Lakeshore Yard Setback No accessory building or structure shall be located in any lakeshore yard except for docks and piers pursuant to.Section 31.381. 31.360 Does this mean any lakeshore yard - 100* or 120' lakeshore yard or does this mean the 0-75' lakeshore setback area - this should be specified. Dwelling Use Prohibited No cellar, basement, tent, trailer, recreation vehicle or accessory building shall at any time be used as an occupied dwelling. Should they be included in the section of the ordinance dealinq with accessory structures? Adams questioned how the section will affect non rental quest houses. In consideration of the many comments and questions the Planninq Commission has raised concerninq this proposed ordinance, Hannah moved to request that the Planner, at his convenience, be invited to attend one of the Planninq Commission's reqular meetinqs for an in-depth discussion of the proposed ordinance. Motion seconded by Frahm. Vote: Ayes (6), Nays (0). Motion passed unanimously. The Planninq Commission cited the followinq topics for the City Attorney's outline for joint meetinq sometime in June. 1. Vacations 2. Performance Stsuidards 3. Conflict of Interest 4. Abstentions in Votinq 5. Leqal Liability of Planninq Commission Members 6. Private Property Owner's Riqhts Planninq Commission will add to this list at future meetinqs. Adernis moved to approve the Minutes as submitted. Motion seconded by Frahm. Vote: Ayes (6), Nays (0). Motion passed unanimously. Meetinq adjourned.
