A special meeting of the Planning Commission was held
on the above date. The purpose of the meeting was to
prepare amendments for specific sections of the fence
ordinance (draft #4). Present were the following
members: Chairman Wilson, Hammerel, and Jabbour.
Mabusth represented the staff.
The main concern of the group in attendance was the
restrictive nature of the proposed fence ordinance.
Members cautioned that if Council approves the
existing ordinance, it will alienate the majority
of the community. What little input members have
received has all been negative! The committee notes
there will be an increase in variance applications;
the ordinance is too lengthy and impossible to enforce.
The committee will recommend to the Planning Commission
that a joint meeting be scheduled for the Planning
Commission to present their concerns and proposed
amendments to the Council.
The following are proposed amendments that the
Committee adopted for discussion and approval by the
Planning Commission at the January 28, 1980 meeting:
Amend Section 38.971
Omit the following:
a) "any yard except Lakeshore Yards"
b) 1. Privacy fencing - "entire paragraph"
Add the following:
b) 1. Privacy fencing - Side Yards. Privacy fencing
not to exceed 6.0 feet in height may be erected
in any side yard along the property line. The
allowed lineal feet of fencing may not exceed
the width of the lot, measured through the front
line of the house and may not exceed the principal
structure's setback for the zoning district.
Exception: Lakeshore lots - Privacy fencing may
extend along the side property line to a point
equal to the front line of the nearest house to
the lakeshore. Privacy fencing may not extend
into the 75' lakeshore setback area.
