Box 66 Crystal Bay, Minnesota 55323 Re:Northerly Lot (Lot 30) of former Richard Lorge residence 2697 Casco Point Road Dear Ms. Mabusth: It is my understanding that Lot 3 is the lot that Lorge is now selling, for which someone will probably be applying for a building perrhit. This lot is outlined in red on the enclosed map. Lorge lived until recently in the house located on Lot 4 and his property included both Lots 3 and 4« I live on Lot 5 at 2715 Casco Point Road which my wife bought in 1972. Consequently, I am familiar with water drainage and flooding problems that exist on these three lots and on Lot 6 to the south, which is the residence of Raoul Schander, 2745 Casco Point Road. The areas which are subject to flooding and standing water during the spring thaw and after heavy rains are approximately located as circled in blue. Notice that the largest area is covering portions of both Lots 3 and 4. There is also a smaller area along the northeasterly line of Lot 5 (my lot) and another small area along the northeasterly line of Lot 6 (Schander's lot). The green colored line shows the approximate location of a drain pipe which is about 2 or 3 feet underground. As shown, it runs from the low areas of Lots 3 and 4 across Lot 5, and along the northeasterly line of Lot 5 to Lake Minnetonka. There are openings or small catch basins k Ms. Jeanne Mabusth -2-September 9, 1980 leading to this drain pipe which are located near the center of Lot 4, on the line between Lots 4 and 5, and near the northeasterly line of Lot 6, There may also be one in Lot 3. This drain pipe does net work very well and is probably clogged with debris or broken. Consequently, during the spring thaws there is often standing water in these locations for a week or two. Heavy rains in the summer often result in standing water for one or two days and sometimes more. The area where there is the largest amount of flooding, and where standing water remains the longest, is in the largest area located in Lots 3 and 4. Therefore, I feel that any construction on Lot 3 which would change the topography of the land, or change the surface of the land (such as a surfaced driveway) would decrease the water holding capability of this large area in Lots 3 and 4. This would obviously increase the drainage onto Lots 5 and 6 and increase the flooding problems on those lots. I would request that any building permit given for Lot 3 include a require­ ment for, or be made contingent upon adequate storm drainage being constructed from this flood area on Lots 3 and 4 so that this water not flow through or over Lots 5 and 6. The area is in R-ID zone, half-acre, 100* width and is serviced and assessed for water * ;»d sewer. The lot does not meet the acreage or width requirements. It has roughly 18,000 sq, ft. and the width at the building line would be approximately 75’. Mr. Ogland owns the site to the north having a residence on two acres. The properties to the south have approximately the same size as the subject property. He states he will obtain permission from the neighbor adjacent to him to the south. Lofrano*s property stops at the railroad oroperty line but his site sketch indicates that the railroad is an easement that comes way onto his property. Our concern here is if there is really n want to establish less than half-acre an area that still has undeveloped land? Another factor that must be considered is the two-story building almost against the Property line which will have an effect on property in terms of blocking view and w«tch is more urban in character than what we might like to accept. After on-site inspection, we determined the property only marginal to bear the several hundred thousand dollar structure contemplated. The logic for this opinion follows: 1. There is one suitable location for a structure: 2. a. b. c. d. e. Southwest portion is too narrow where it abuts Woodhill Road. Severe grades on the northwest portion would affect building costs substantially and adversely. Eastern portion's view is to Woodhill Country Club dump ground, thus unsuitable. Percolation tests indicate substantial land usage required on east side, as well, to accommodate drain field within code due to extensive clay. Location of present driveway is highly restrictive. Contour of adjacent land prohibits moving it, in addition to affecting aesthetics of present residence. The appropriate building site is at narrowest "neck" of the property, coincidentally its apex. We deem it marginal. a. b. c. d. Contemplated structure will be between 35-50 feet wide, west facing and in excess of 100 feet long, south facing. The fifty foot satback requirement, plus structure, plus access drive leaves virtually no yard capability or buffer zone. We viewed property prior to seasonal foliage. Proposed structure is dangerously close, aesthetically, to present house. Extreme care is necessary to prevent the two structures clashing —— every possible foot that can separate them is vital. Value of present house could be severely affected if new one is "in its lap". Johnston Property On an inspection of the Johnston property with the assessor on 9-8-80, we found that a major roadway had been constructed throughout the entire peninsula including grading and tree cutting on City property at the end of the point. Johnston did this without a permit and without any type of plans. He had talked with staff several times and been advised not to do any work until the City review was completed. He has since received three citations and been advised to get his subdivision application underway. He filed a six lot subdivision application on September 11, 1980, which includes the property he hopes to acquire from the City. Staff advises that if the sale does not take place, that Mr. Johnston be responsible for restoration of the City property. A bond or irrevocable letter of credit should be filed with the City and the applicant enter into a contract (developers agreement) to assure the completion of the restoration no later than July 1, 1981. Although the application proposes office use (allowed in B-1 with a conditional use permit), the project would be subject to the most restrictive standards of B-1. By rezoning property to B-4, applicant benefits with less restrictive standards and the City by approving development of a severely limited site from future B-1 uses having greater parking demands. There is no logical reason to include the sewer line in this zone (the owner would have access to the sewer regardless of zone) . The actx.al zone boundary should include all commercial functions including parlcing, and perhaps should go to the west line of Lot 6. The depth would not need to be 200' as this is obviously flood plain and wetlands. A reasonable straight line comoroinise should be determined through the rezoning process. The conservation and flowage easement should be^ over all designated flood nlain, i.e. over all ^1 land below 935.
