Olson, Village Planner DATE:July 29, 1980 SUBJECT: #570 William Mernik, 2715 Kelly Avenue - SUBDIVISION This proposed subdivision would divide the existing 3^ acre parcel into two lots: Lot 1, non-riparian, IH acres, and Lot 2, riparian, with existing house and 2 acres. Access for Lot 2 would be by private easement through Lot 1. Access to both lots is over a privately maintained driveway in a City alley. There is a low ponding area near the west-center of the property with the dividing line running through it. Pilling or alteration of this area would likely add to existing flooding problems in the Walters Port Area. Mr. Mernik does not intend to change this area at all and has been agreeable to providing a conservation easement to the City. The property is served with both sewer and water. The sewer project was not assessed on a unit basis. Two water units were assessed. Both utilities are on easements across the width of the property. Staff recommends preliminary plat approval for a tvo lot division meeting all lot area and lot width requirements, subject to the following conditions: 1. 2. *3. *4. 5. 6. Only the lakeward lot (2) will be riparian. The inland lot (1) will be non-riparian, and wictout dockage or lake access rights. • The subdivider to provide a topographical survey of the drainage area, locating the culverts and the extent of the existing pond, which area will then be shown on the plat as a dedicated "drainage easement". The subdivider to provide a survey to locate the existing sewer and water mains and will provide a dedicated "utility easement" on the plat. Creation of all private road and utility easements necessary to provide access from the public right-of-v7ay to lakeward Lot 2. Olson, Village Planner DATE:July 29, 1980 SUBJECT:#576 Robert & Joanne Mortenson, 3280 Waterto%m Road CONDITIONAL USE PERMIT This application is made to allow construction and operation of a limited commercial greenhouse on residential property in the RR-IB 2-acre district. The Mortenson’s application #560 for 1204 Arbor Street was denied by the Council on July 28, 1980 because of concerns about that particular neighborhood. I have enclosed a copy of Resolution No. 1167 for your review. This proposal is for the same use as proposed with application #560 but the lot is twice as large, is heavily wooded and has direct access onto a designated collector street. The proposed greenhouse location is all but invisible from adjoining lots and conforms to all required RR-lB setbacks. There is a small corner of wetlands on the far northern edge of the property that should not affect this use. Because this is a similar application, you may feel comfortable in acting at the first meeting rather than having a separate work session. Conditional uses include those uses generally not suitable in a particular zoning district, but which may under some circumstances be suitable. When such circumstances exist, a conditional use permit may be granted. Conditions may be applied to issuance of the permit and a periodic review of the permit siay be required. The permit shall be issued for a particular use and not for a particular person or firm. Because of their unusual characteristics, conditional uses require consideration so they may be located properly with respect to the objectives of the Zoning Code and with respect to their effects on purrounding properties. In order to achieve these purposes, the City Cpuncil is empowered to grant and to deny applications for conditional use permits and to impose reasonable conditions upon the granting of these permits. WHEREAS, the City Council has reviewed the application; the recommendations of staff and the Planning Comnission; and comments by the applicants. PAGE_/of ^ ■WJ City of ORONO ItoRONO' L - ‘ RESOLUTION OF THE CITY COUNCIL NO. 1167_ _ _ _ _ NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Orono hereby denies said conditional use permit application based upon the following findings of fact: 1. The property is located in the RR-IB rural residential use district, which district requires at least 2.0 acres of land for each residential dwelling. This property consists of four separate tax parcels which if coajbined would total 3.7 acres. 2. The surrounding neighborhood consists of a historic cluster of residential dwellings located on lots of 1/3 to 1/2 acre each, which density is greater than that permitted in the Zoning Code and is greater than that proposed in the city's Comprehensive Land Use Plan. 3. The purpose of the 2-acre minimum zoning requirements is to eliminate the need for sanitary sewer service and other extension of costly urban services into the rural area.i 4. The historic density of the Arbor Street neighborhood already has raised questions concerning the ultimate probability of .having to extend se%#er and/or other urban services into the area to alleviate problems associated with urban type density. 5. Addition of a commercial greenhouse operation on property already containing a dwelling %K>uld increase the effective use density of the neighborhood. 6. Commercial greenhouses are generally considered suitable quasi-agricultural uses of land located in the rural area where sufficient open space provides ample room for expansion, storage, equipment, and separation from other strictly residential properties. 7. The existing residential use of this property is compatible with the residential character of the Arbor Street neighborhood. 8. Creation of a new commercial use on this property would not be compatible with the residential character nf the Arbor Street neighborhood and %rould be adverse to the property values of nearby residential lots. 9. Access to this property is via Arbor Street, a narrow 18* wide residential access street not suitable for truck traffic or for excessive automobile traffic.
