In addition does this ordinance also make a distinction between a non conforming structure and a non conforming use. 31.110. Apply to''U8es" Only. The non-conforming use provisions of the Zoning Code apply only to the use to which land and buildings are put, and do not apply to situations where location or height of structures, lot size or other factors not Involving the use of the premises prevent strict conformance with the requirements of the Zoning Code. Where, however, such a situation existed legally under the prior applicable lav, the Council will not unreasonably require strict compliance and will generally look with favor on granting of a variance under 32.300ff. It is this section that gives Council broader discretionary power In dealing with existing principle structures located within setback areas, on substandard lots, etc. The City does not recognize these principle structures as non conforming uses/structures. A boat house with similar ^setback problems although seemingly a compatible residential use becomes a non conforming use/structure by it accessory c^sslflcatlon. Council's policy on lakeshore accessory structures Is a fair and reasonable use of Its "police power". The City controls encrouchlng principle structures by setback, area, width and hardcore standards, never by designating them nonconforming uses—the City would have to rent Court space. As to the distinction between structure and use - there Is none. An •accessory structure becomes a non conforming use/structure because It docs not meet the standards of the district. The non conforming structure althou^ a permitted, compatible residential use, such as a boat house,lakeshore cabin (accessory to principle structure such as Seifert Case) Is considered a non conforming use. 1980 Update of Cloutier File a) Scheller letter dated June 25, Review of facts 1- Construction begun without permit Scope of original permit - boat house at ground Fee based on following: a-Cost of Material b-Work done by owner c-Ground level boat house (30* x 20'), capped off with a deck. 2- 3- K' • Jaiinne Zoning idnlnlstrator of City of Orono. fti or about May 3^19^ I was notified of construction being done on the property of Cortlen ^outier of 2h80 Casco Point Rd« No perait had been issued by the inspector at this time* When I arrived at the scene* the blodc^fork had alreqdy collapsed due to Hilly early back fill, rain the night before and non oonforming (8) eight inch blocks* When I talked to Cloutier about the coUaj-sed structure and failure to get a building perait* he stated to me that it was a y ground level boathouse* and that the material cost would not exceeed $500*00( ^ive hundred Dollars). I went to several of the neighbors* among them Wilbur and Kaurine ^‘ndersen at 3555 fVederick St* and they said they would have no objection to a ground level boat house* With this I issued a pvnoit # 2495 for $500.00 ( Five hundred Dollars) In materials at a fee of |5*00( five dollars)* When the concrete BLook work was finished* eos^rising ofl2 inch Elock* and the boat house was capped off, I cheeked it out and assumed that it was coaqjlete as per our agre inent with Kr. tSLoutier* the rate of fee for permit paid^and the negotiation I had with the Neighbors Former ^Uilding Inspector Notarized! June 24, i960 Jeenne Kabusth Zonln£ Conan* Adn* Orono City Hall Crystal Bay, Hi.55331 The Qrcno Building inspeeter, Mike Scheller, stopped at our home abotth May 1, 1971* He informed us of a boat house going up on the Cloutier property at about 2480 Casco. pt.Rd* He stated that it mss to be of cement block construction and to be widerground and capped off with a deck. He asked if we wouldhare any objection to a structure such as this* Both Maurine and I questioned him about the former attempt at this construction, not having blocks up to code and the failure to obtain a permit. Mr. Scheller stated that the new construction would be brought to code and that a permit could be Issued if there was not any neighborhood objection* We agreed to allow the constructlan as stated above and within the limits and validity of the permit whitdi was to be issued for five hundred dollars* When the oement blocks were capped off at ground level and tho deck (and/or roof)boards were nailed down, sy understanding was that it was complete as per agreement with Mr. Scheller and within the full limits of the permit.
