STAFF UPDATE
1. City Attorney's response to the following points:
a) Does City have the right to vacate park land dedicated in
a formal plat? Mr. Malkerson states there is no problem
emd to proceed with consideration of the application as
proposed.
b) How does City distribute ownership of vacated lands?
In this case because of the location of the City road
(Park Drive), the benefiting properties will be lots that
abut the specific area to be vacated.
2.Report from Police Chief - nuisance reports in the subject area.
The police have no record of any complaint calls related to
incidents of noise, dirt bikes, etc. -* only stray dogs - dogs -
dogs.
3. Response from neighbors
I expect the hearing will be well attended by neighbors. The
consensus seems to be that the City should not give up park land
used by neighborhood children - keep the motorized vehicles out
with prohibiting signs
Staff Recommendation: Table application pending study by the Park
Commission. The Commission should respond to the feasibility of
recreational neighborhood park in that location.

Gentlemen.
I would like the city of Orono to consider ceding to me the property directly
adjacent to mine. This property is currently owned by the city of Orono.
The reasons for this request are twofold:
1) The property has become a real eyesore. Automobiles, motorcycles
and go carts are continually racing through this property. The
noise created by these vehicles is annoying to all nearby residents.
2) The city of Orono does not maintain the property. As a result, the
property is overgrown with weeds and debris.
The advantages to the city are many:
1) This property would be put back on the tax roles.
2)The appearance of this area would be vastly improved by the property
owner.
No further requests for lawn care, maintenance or police coverage
will be necessary. ( The police have indicated that the parks are
posted "off limits" for motorized vehicles.)
There are no plans for future use of this property; the city of Orono
and Hennepin County have both been contacted concerning any future
plans for use of this area.
I have spent a considerable amount of money remodeling and upgrading my
home and property at 1345 North Arm Drive. I feel that the present condition
and appearance of this property detracts from the appearance of my home and
nearby homes.

I am sorry to report, I could find no factual doci^entation of the

that the dredging was done in the night whil> the property was in the
process of being subdivided.
Recommendation:
If approved, your recommendation should consider the following points:
1 Building permit issued to be of a permanent or temporary duration.

dredged at some future time.
Type of construction - parallel to shore? dock limited to one
boat. Size of boat should be considered and a limit set.

ReBtrictiona and Covenants
1, This conveyance la made subject to the following covenants and
restrictions, which shall run with the land and be binding upon and
inure to the benefit of the parties hereto, their heJrs, executors,
adnlnistrators, successors and assigna, until Dec. 1998, at which
tloe, said covenants shall be automatically extended for successive
periods of tan (10) years, unless by a vote of the. then owners of ,
the plots in "Forest Arms'* it is agreed to change the said covenants
in Wnole or in part, and restrictions shall terminate.

2, All lots or parts thereof in "Forest Arms" shall be known and de
scribed as residential plots. No structures shall be erected, altered,
placed or permitted to remain on any plot other than one detached!
single family dwelling, and a private garage, and any other outbuild
ings incidental to and consistent with residential use of the plot.

3. No structure shall be erected on any lot having a ground floor
square foot area, exclusive of garage or unheated porch, of leos than
1700 square feet, in the case of a 1-atory structure.
In the case of structures of one and one-half stories or two stales,
the ground floor square foot area may be not more than 20^ or 40p,
respectively, smaller than the above sot forth requirements. For pur
poses of these restrictions a one and one-half slcry house is defined
as one having finished rooms on the second floor or having a basement
substantially exposed on one or more sides having finished rooms there
in and finished on the exterior with material other thqn exposed con
crete block, whether painted or not, to match the other exterior treat
ments of said structure. Provided, however, that the parties mentioned
in Paragraph 5 hereof mqy Waive this requirement if, in their option,
the proposed structure is of a \quality and exterior appoaranco which
confosin to the plan of development of the area and to the existing
structures therein.

tent or other building of a temporary character shall be placed or
erected on the premises. All structures shall be completely finished
on the exterior within one year after commencement of the excavation

elevation thereof in relation to the grade of the public street serving

Forest Arms, Inc., Carol Sue Dongoske, Scott Dongoske, all of Mound,
Minnesota, or by a committee appointed by them. Without in any way
limiting the generality of the foregoing, similarity to an existing
house on above premises shall oe grounds for disapproval, such committee
must meet within a ten day period.
6, No sod, soil, sand or gravel shall be sold or removed from said
premises except for the purpose of excavating for the construction or
alteration of a residence on said premises thereto or for the proper

SUBJECT; #550 H. R. Johnston, 925 Willow Drive South - LAND TRADE
Staff has advised Mr. Johnston that before he presents a plan to
subdivide the newly acquired Hendel property that a proposed land
trade with the City be resolved. The applicant has asked the City
to consider trading a parcel of land (see Exhibit A, Parcel A) for
City owned property (Parcel B) approximately a one acre parcel
located at the west edge of the Hendel property. The acquisition, of
Parcel B, the remainder of the land peninsula, will afford a more
"efficient" platting of the subject property. The public works
staff advises that Parcel B is landlocked via a western approach.
The City does not use the property.
John Gerhardson states the City is waiting for the M.W.C.C. to
determine what portion of the French Lake facility will be retained.
As of this date, we have heard nothing from the M.W.C.C.
STAFF UPDATE - APRIL 16, 1980
In a rare moment of confusion, at the end of the meeting, we forgot
that an action vote was required for the H.R. Johnston's proposal.
I believe there was a general consensus of approval of the land trade.
Staff will bring the application to Council for review at their
April 28, 1980 meeting noting that the M.W.C.C. has not yet determined
what portion of the sewer facility will be retained. In your approval,
you are approving only of a potential land trade between a resident
and the City. The applicant is to provide the legal descriptions for
the two newly created parcels.

Mr. Hepp proposes a plat of his 2.8 acres into two lots. Unfortunately,

Subdivit: ton: Two lot plat
Mr. Brooks proposes a plat of two lots. The total area equals
7-3/4 acres. Upon an inspection of the site you realize the lot
configuration is feasible given the existing pattern of neigh^rhood
development. The proposed building area for Lot 2 will position
the new structure in a more secluded location. If we were to ask
for a horizontal split, the lakeside lot would place the new home
close to the wetlands and at the lowest point of the property.
The lot has sufficient area to allow this type of division. Note
the shoreline for each lot meets the 200' requirement.
Septic Testing - Testing will be required for Lot 2. The septic
system will be inspected at the existing house and testing for
additional area for alternate system.
Riparian - Lot 1 and 2 will be riparian to Lydiard Lake - both have
the required 200' of lakeshore.
Lot configuration - both houses meet the required 200' along front
line of house. Existing structures meet setback of zoning district.
Wetlands - City to require a flowage and conservation easement over
wetlands.
Access - Lot 2 abutts Lydiard Road (private driveway) . Lou •. will
use existing driveway. Lot 2 will be required to grant a p"xvate
driveway easement to Lot 1.

Total Area: 1.8 acres
Mr. Harter proposes a two lot plat of his 1.8 acres located on North
Shore Drive. In 1972, Mr. Harter proposed a vertical lot split
in which each lot had a width of 75'- both lots riparian to Lake
Minnetonka (see Exhibit 1). The City denied the application as it
did not meet the performance standards of the district. In 1976,
a Phillip Dykstra of 3080 North Shore Drive (2 lots north of subject
property - see plat map) proposed a two lot plat of 2.2 acres. This
plat (see Exhibit 2) met all of the performance standards of the
district. Council reluctantly approved the plat over the complaints
and misgivings of the neighboring property owners.
Review of Current Plat
The new proposal meets the majority of the performance standards.
Tract A is to be riparian to Lsif® Jlinnetonka. Lots have a width of
150', the zoning district requi.t*® 140'. The lots are each under
the area requirement for one acre minimum. The neighbors still
appear to be in opposition and threaten to follow suit with similar
proposals (see Exhibit 3 & 4).
Staff recommends denial of the proposed subdivision based on the findings
that the area requirement cannot be met and to refuse to set a precedent
that would encourage neighbors to plat substandard properties.

years now and have enjoyed the low density of houses in tha immediate area.
‘iVe have strongly disapproved the recent construction of a new dewlling now
located on North Shore Dr. (between us and the bridge) These double long
lots were not to be allowed buildings erected so as to congest or spoil the
setting along the Drive,saisd the Council a few years ago,and now we have a
house there., I have received many unfavorable comments about it,. All persons

Regular Meeting of the Planning Cominission,
October 2, 1972
The Planning Commission met on the above date
with the following members present: Chair
man Poisson, Elliott, Hays, Kokesh, Ryerse,
Searles, and Van Nest. Absent: Gasch,
Kullberg, and Nicholls.
Poisson moved, Elliott seconded, that the
Minutes of the Regular fleeting of September 18,
1972, be approved. Motion, Ayes (7) - Nays (0).
Eberhardt Construction - Lot size and width
variance. Lot 4, Vern Mar Manor. Members
studied the plat map of the area. Brought out
was:

Lot is about one-third acre, 95* X ISO*.
This is the last vacant lot in this sub
division.
It is serviced by sewer and has a water
unit assessment.
A building permit was issued by the staff
when they were assured that the engineer
from the company had everything in order.
The footings are poured and the project
has a stop order on it at the present.
An adjacent neighbor, James Lassek, objected
to filling so much of the lot with a rambler.
He thought a two-story house of smaller size
would be more appealing on this sized lot.
He was assured the setbacks were met.
Searles moved, Poisson seconded, that the
neighbor and contractor should try to come to
an agreement and the secretary should contact
the Village Attorney for a legal opinion.
Motion, Ayes (7) - Nays (0).
Phillip Greenly, attorney for Kenneth Harter,
presented letters he had received from adjacent
neighbors to show compliance with the Planning
Commission's recommendation of a prior meeting
that they be contacted. Most were neutral to
favorable. One was neutral to cold. In the

similar to the approved preliminary plan. The
park dedication fee has not been paid as yet.

stated that Hr. Phillip Dykstra, 3080 North Shore
Drive, IS requesting approval of a subdivision of
his property consisting of 2.22 acres into two
parcels each of which would exceed the minimum
lot size of one acre. Both parcels would exceed
the minimum lot width requirement of 140'
Following completion of the 73-1 sewer project,
this property was assessed for two units. Both
properties would require private easements - one
for access to the road and the other for access to the lake.
Planning Commission Meeting — December 3, 1975
Due to ^e area having long, deep lots, the
Commission expressed concern as to public
opinion of the possibility of another row of
houses in the neighborhood. The Commission
directed that a public hearing be held on

Result of the public hearing: 1. All the people
present and three letters were against the proposal

Commission agreed to defer decisions until
alternatives can be reviewed with the Council
