The Planning Commission should decide if the access easements (or just the one serving the Hannah house) should be subtracted from lot area. What should the City's position be in the matter of three lots being served by 40 lineal feet of public road assigned to a single residential lot. Planning Commission should be advised as to history of the access drive serving the Hannah house. A vertical subdivision is out of the question. The City cannot encourage the obvious gerrymandering of lot lines to create riparian lots. Planning Commission questioned whether a riparian outlet could be created as in a recently approved plat based on the approximate 300 lineal feet of lakeshore. In the referenced plat, the developer could have created riparian lots without gerrymandering lot lines; this does not hold true in this case. Please review the enclosed survey designating the required lakeshore setback from the lagoon and the access easements along south side of property and the location of the driveway serving applicant's house. Staff recommends tabling the application pending receipt of a preliminary subdivision designating the following: 1. all structures and setbacks 2. access easements (noting width for each) 3. proposed house site meeting all required setbacks 4. area of each lot (Planning Commission to decide what should be subtracted from overall area) IT !il ; 1 if rV». f? DePAUW Vice Preiideni April 28, 1980 **■0: The City of Orono Planning Commission ana Council RE: BRUCE HEPP PROPOSED SUBDIVISION OF LOTS 9 & 10 SHORE HILLS The undersigned are opposed to the proposed subdivision of Lots 9 and 10 for the following reasons: 1.Lot 9 has 40' of frontage on Lafayette Road. If this proposed sub­ division were allowed it would mean that three single family residences would be using driveways fronting on a 40' lot. 2.I understand that Mr. Hepp's proposal calls for the inclusion of lakeshore which would mean that we would have a seriously gerrymandered lot line to allow lakeshore to be attached to the proposed subdivision. 3.Almost all of the lots in Shore Hills, at one time or another, had or have now, a deed restriction providing that only one single family dwelling be built on a lot. It is obvious that the intent of the developer and the buyers of those lots were, that the area would remain devoted to large lots with only one house per lot. 4.The Hepp property has only one sewer and water assessment. If the intent of the Council were to allow higher density in this area, it would have provided sewer and water at an earlier date for more connections. 5.Lafayette Bay is an environmentally sensitive bay and additional population pressure would only add to this problem. 6.If this subdivision were granted it would set a precedent for sub­ division on other lots in the area. There are presently two or three lots on Lafayette Road which could be subdivided into additional lots. If the Council were to allow this subdivision we would then want the Council to go on record that it would allow additional lot subdivision in the area along the same lines granted to Mr. Hepp. 7. We believe that a subdivision of Mr. Hepp's lot would not be in the best interests of preserving the integrity of the existing neighborhood. Seifert, 1856 Shadywood Road - VARIANCE Mr, Pearson's comments are factually correct. Staff did not relay the trouble with the one neighbor on the south side because he preferred to handle it on his own. The neighbor's privacy fence sustained damage in two sections. The fence is located on the property line in such a manner that the damage could only have resulted with the use of the Seifert driveway. When the neighbor first attempted to inform Seifert of the damage, Seifert refused to assume any responsibility. It appears the neighbors have siuc,:Li reached a mutually beneficial agreement. I have been advised by the City Attorney that the Planning Commission had every right to demand removal of the lakeshore rental unit - in fact, you could have asked for all three to be removed. The fact that staff did not suggest such conditions in their review of the variance application does not mean that the Planning Commission is limited in their review. This is our joint but independent roles. Staff reports the facts, findings and at times will "suggest" a recommendation. The Planning Commission is an independent reviewing body, your dialogue may very well demand a more encompassing recommendation. For the record, I think the following questions should be asked: 1. Is Dr. Seifert a full time resident at 1856 Shadywood? 2. Who is responsible for the rental units when he is absent? 3.Since the main house and lakeshore rental unit use the paved area to be removed for parking and turnaround , how does he plan to provide a parking area for rental unit and turnaround ability. Remember a gravel driveway is considered hardcover. Planning Commission should review application and attorney's comments to determine if there are additional questions to be asked. Staff Recommendation - If the variance application is approved, the applicant must enter into a formal agreement with the City containing the following conditions: 1. Schedule "Phasing Out" of rental units a) Lakeshore unit - demolition permit must be obtained one year from date of signing agreement. b) Two Shadywood cabins - to be removed no sooner than five years from date of agreement but removal to be complete seven years from date of agreement.
