Mabusth, Zoning Administrator DATE:February 14, 1980 SUBJECT: #538 Carol Moore, 4701 West Branch Road - SUBDIVISION WORK SESSION Zoning District RR-IB Subdivision - 2 lot plat, total acreage 11.153 Acres Staff has recommended a platting for the two lot division proposed by the Williaun B. Moores. They were advised of the additional expenses involved in a metes and bounds division with lengthy legal descriptions for wetlands and lot configurations such as the one proposed. The Moores want the newly created lot to abut the public road. The City has no problem with lot alignments of this kind in fact it is preferred. Access - access for both lots will be off West Branch Road. Lot 2 will grant a driveway and utilities easement in favor of Lot 1. Applicant should be advised that the City has granted preliminary approval to the Valek plat just to the south of the subject property. A public road coming from the south could provide access to Lot 2. We would recommend increasing the access corridor from 25' to at least 30’. Wetlands - there is approximately 1 to l*s acres of wetlands. We will require a flowage and conservation easement. The wetlands will involve both lots - plan shows only lot I's involvement. Lot Specifications - each lot meets the standards of the RR-IB zoning district. The animal barn is located 150' from the lot line. Septic Testing - Septic testing will be required for the 4.236 acre lot. The existing system on Lot 1 will be inspected by the On-Site Systems Manager and additional area for septic expansion will be reviewed. Dedications required on the plat: 1. Dedication of right of way for VJest Branch Road (Cty. Rd. 15). 2. Dedication of right of way for Highview Lane. 3. Present were the following members: Chairman Hammerel, Adams, Frahm, Hannah, McDonald and Wilson. Mabusth represented the City staff. The Chairman asked that all action items be postponed until agenda items involving the public were reviewed. ATTENDANCE 7:30 P.M. The work session for the Carol Moore Subdivision was introduced. Mabusth reviewed the changes in the application since the staff memo was written. Richard Hawkinson, the abutting property owner to the east, has joined in the subdivision application. The plat will now consist of a four lot division with a private road designated by a 50' road outlot. There is a designated wetland of approximately 2+ acres that we will require a flowage and conservation easement over. Planning Commission questioned the need to acquire future road right-of-way to the southern lot line. Wilson noted before a determination could be reached, a plan showing the existing and unimproved roads in the surrounding neighborhood would have to be reviewed. Staff will submit plan for the Planning Commission meeting of March 17, 1980. Staff was asked to recheck the ordinances to see if a setback variance for the animal barn from the east lot line of Lot 2 is required. The applicants were advised to have the agent responsible for the septic testing on the subdivision to contact the on-site systems memager. Planning Commission called for a Ptiblic Information Meeting on March 17, 1980. CAROL MOORE 4701 W. Branch Road SUBDIVISION Work Session (#538) Planning Commission reviewed the telephone poll taken of each member giving unanimous approval to the rezoning application of James McCleary. The property will be rezoned to LR-lA, Lakeshore Residential, 2-acre minimvun lot size. McCleary will continue with a limited marina operation for the 1980 season. Wilson moved to recommend approval of the McCleary rezoning agreement. Motion seconded by Hammerel. Vote: Ayes (6), Nays (0). Motion passed unanimously. We reviewed the above plat and found it acceptable with consideration of these conditions; - The 1976 Hennepin County Transportation System Study (HCTSS) recommends future municipal jurisdiction for the portion of CSAH 151 from CSAH 19 south intersection to CSAH 19 north intersection. The existing 40 ft. of right of way is enough for any future Hennepin County upgrading of CSAH 151. The existing access point on the east property line fails by 130 -ft. to meet tne 570 ft. minimum sight distance for 45 mph to the drivers right. Since this access exists it can remain open as a driveway but any upgrading to street standards will be denied by Hennepin County until the hill east of the access is cut down. A good street access is at the top of this hill. i Any new access onto a County road or revision of existing access requires an approved Hennepin County entrance permit. Mabusth, Zoning Administrator March 14, 1980 SUBJECT: #541 Ministers Life Development Company 1484 Shoreline Drive - SUBDIVISION Staff Update - March 10, 1980 As an information item, the Council reviewed the proposed plat for the Halpin Estate. Council was in complete agreement; the existing access serve the prop>osed plat. They questioned the extent of the dedication requested by the County and reflected on the unfair burden placed on a single developer. They all agreed the proposed realignment with the accompanying increase in speeds would create greater hazards for any access abutting County Road 15. They decided a designated setback area for each lot abutting County Road 15 of approximately 150' %iould prevent any hardships in the future if such a realignment ever takes place. In response to the issue of the riparian outlets on Smiths Bay, they agreed with the Planning Commission that every attempt be made to keep the landscaping intact and not force the developer to sacrifice the proposal because of the riparian issue. Council member Hurr stated she could not approve the sxibdivision if the 200* width of lakeshore frontage was not met. The Mayor noted that the average of lineal footage for each of the six lots is approximately 230 feet. Staff Update - March 11, 1980 The Mayor met with the developer and reviewed the Council's concerns. He discussed the environmental concerns for Smiths Bay and doubted if Council would approve three docks located in such a shallow bay area. He noted an outlot for riparian access could be created for Lot 6 on Tanager Lake side. He suggested that no more than two riparian outlots be created on Smiths Bay. The developer has submitted new plans reflecting these recommendations. Please review the letter from Tom Frahm dated March 13, 1980. Reports still outstanding: 1) Minnehaha Creek Watershed District and 2) Hennepin County Highway Department. If the Planning Commission determines that a recommendation for preliminary approval can be voted on at your March 17, 1980 meeting, your motion should consider the following points: 1. Access road - approve existing access on County Road 15. Engineering plans for plat road to be submitted upon preliminary approval of Council. Plat road shall be designated as an outlot - City to acquire underlying easements for road and utility purposes. Lot 2 to grant a private driveway easement in favor of Lot 3. Mr. Butterfield received his first "formal" Conditional Use Permit in September of 1972 to allow the commercial greenhouse operation and approve the existing buildings. In the succeeding years, he has requested conditional use permits to construct additional greenhouses on his 20 acre site. Council has approved each application and to my knowledge has never set a limit as to the size of the operation. The nursery operation covers approximately a quarter of his property. The City has had no problem with the Butterfield Nursery. All of the proposed structures meet the setbacks of the RR-IA Zoning District. The following items were reviewed in previous applications: 1. packing requirements on site for employees 2. equipment to be stored under cover 3. screening from surrounding residential neighborhood Operation today involves minimal number of employees - part time if^ any - feunily run operation. There is no retailing done on the premises so customer parking considerations are not necessary. Points to be reviewed with this application: 1. Screening - especially for 60' X 190' greenhouse bordering the 2. 3. Luce Line. Topography on east side of lot m-ikes screening most difficult and staff does not feel at this time necessary to address. Limitation on operation - there have been no major changes in the surrounding neighborhood - no signs of increased development. P.C. may not wish to even address this issue, but you should be aware of the need to review this issue with any application involving an intensification of use. McCarthy moved, Butler seconded, that the Council finds that the various buildings, structures and enclosures of glass, plastic or similar material which are used to maintain suitable conditions under which plants may be grown, are in fact "greenhouses" under Section 34.025 of the Village Code and that Mr. Loren Butterfield has and is conducting a commercial greenhouse operation at the premises located at 3925 MVatertowi Road. Tlie Council further finds that the existing use of the open fields for the growing of flowers falls within the definition of a crop farm under Section 30,040 of the Orono Municipal Code. This conditional use permit will be effective when i!r. Butterfield has supplied to the Village Administrator all the information required by the Orono Code and this information is to be furnished by October 1, 1972. Motion, Ayes (4) Ways (0), Mr. William Wear was not present and he was removed from the agenda. Council instructed the Administrator to inform Mr, Wear that * le Council has no information from liim on what his request nay have been and that if he wishes to come before the Council at a future time he must make a new request to be put on the agenda. It is requested that he bring detailed plans of any proposal that he may have. Tne Village Council instructed the Adminis trator to contact Mr. Robert Dongoske and ask him to appear before the Council at its next regular meeting of October 9, 1972, to answer questions regarding his request.
