The following members were present; Chairman Hammerel, Jabbour, McDonald, Goetten, and Adams arrived at 7:40. Mabusth represented the City staff. Richard Raiche was present. Mabusth noted the certi ficate of mailing and the affidavit of publication. No one was present in the audience for the applica tion. Jabbour was concerned with the septic system and the high water. Raiche noted that he would remove the gravel road prior to final subdivision approval and new road constructed along west edge of the property. Goetten motioned to approve the application subject to the following conditions; 1) Private driveway to serve all three lots, no direct access for Lot 1 to Watertown Rd. 2) Removal of existing road down center of property. Developer’s agreement will be required if improve ments not completed prior to final plat approval. 3) City to acquire road and utilities easement over driveway outlet. 4) All disturbed area to be seeded within 10 days of grading completion. 5) Payment of park dedication tee in amount of $600.00 $200.00 for each lot. McDonald moved to second. Vote; Ayes (4), Nays (0). Mr. and Mrs. Strong were present. Mabusth noted the certificate of mailing and the affidavit of publica tion. Mo one was present in the audience to address this application. Jabbour questioned the maximum width of the proposed driveway and hoped that a minimum of 14 ft. from the lot line could be maintained because of the proximity of wet lands. In reality, the road serves two lots to the rear of the property and therefore could main tain the standards of a private driveway. This road would never be used as a proposed through road. He would recommend limiting the width of the road out lot to 30 ft. with the normal cul de sac of 100 ft. McDonald asked Strong to describe what was taking place the day the site inspector made a site inspec tion. Strong stated that this was an attempt to clear the drainfield lines, but that he would check with the site inspector on questions he had concerning the existing septic system. Strong approving a setback variance to the wet lands of 26 ft. for the proposed road outlot based on the hardship of the location of the wetlands blocking access to rear of the property and subject to the following conditions: n 4 1) Road out lot B to be no more than 30 ft. width and to have a finished road service not to exceed a 14 ft. width located along at the most southern locationr 2) Driveway to be constructed to private driveway standards. * ;S 3) Out lot A to be determined a non-buildable lot and to be owned by lot 2. ii i 4) Dedication of 33 ft. for Brown Road or County Rd. 146. 5) Flowage and conservation easement of the 1.3 acres over wetlands. a i 6) All access to these lots via plat road. 7) Payment of the Park Dedication Fee of $400.00; $200.00 for each lot. 8) Adequate protection of wet lands provided during con struction of road. 9) Septic Inspector to approve existing septic before final plat approval. rs Jabbour moved to second. Vote: Ayes (5), Nays (0). Mr. Bredeson was present. Planning Commission ad vised Mr. Bredeson that the plans for the house were too ambitious for this size lot. They noted this at their first meeting. They cautioned the applicant as to limiting the hardcover. ROBERT G. BREDESON 1410 Rest Point Rd. Variance #607 Bredeson asked for clarification and to give specific direction as to allowed amound of hardcover for his proposal. Jabbour recommended the following standards: 1) House to be located 25 ft. from cul de sac, 10 ft. from north property line, and to be limited to a maximum of 2800 sq. ft hardcover Hammerel moved to table the application pending receipt of a revised plan from the applicant. There was no one in the audience to address this application. Goetten question the applicant as to the slab con necting the old constnjction to the garage. Davis stated that they were not certain as to what their plans are for the slab. Mabusth advised that their was no hardcover problems for the property. JACK DAVIS 1345 Vine Place Variance #610 Jabbour moved to approve the street setback variance of 20 ft. for Jack Davis finding that their was an existing foundation for the rebuilt garage that will suit in less disturbance of the land or property and that the garages location appears to be consistent with the pattern of development of the surrounding neigh borhood and subject to the following conditions; 1) Garage doors access away from the road side. 2) The building inspector review status of remaining dlab with the final plans of the applicant. Adams moved to second. Vote: Ayes (5), Nays (0). Mr. and Mrs. Weiss were present and there v;as no one in the audience to address the application. Mrs. Weiss noted that they did not have legal access of<f S public road and that they wish to construct a garage and create a new access off Shadywood Road. Mabusth advised that if they were to meet the letter of the code the proposed garage' would use up the remainder of the front yard. She advised that the County would never approve backing on to Shady- wood Road and that at least 30 ft. of turnaround v/ou ■'have to be provided on the property. The side yard of 10 ft. would have to be maintained for the new garage because of the proximity of the accessory buildings on the south property line. Hammerel moved to grant a variance of 22 ft. for the Donald Weiss application based on the size of the lot and location of the house and subject to following conditions; 1) Garage being located 30 ft. off of Shadyv/ood Road rj.ght of way. iO ft. off of side property line. Access to the property approved by the Hennepin County Highway Department. Z) 3) Goetten moved to second. Vote; Ayes (5), Nays (0). i ♦: i ■ r. k DONALD H. t*7EISS 2245 Shadywood Rd, Variance #612 i MINUTES OF THE PLANNING COMMISSION MEETING OF MAY 4, 1981 Page 4 Mr. Jeff Watson, Mr. Evans attorney, was present. iMabusth noted the application involves a request to release a portion of a flowage easement not really involved in wetlands. In the original plat of the Stielow Addition the wet lands was incorrectily judged to involve a more extensive area of the pro perty. Staff has restaked the wetlands area for t\ia surveyor. A public hearing has been scheduled for June 1st. Mabusth will seek the a-vvi e of the city attorney as to the best method to achieve the vacation. The code's fence standards should distinguish between the densly populated lakeshore ares and the rural area of Orono. All agreed that retaining walls and fences should be dealt separately with in the or dinance. A fence or wall should be considered a structure if footings are required. The code should be quite specific as to prohibiting petroleum base (or any other harmful chemicals) treated woods within the O'75' setback of the lake- shore. The Planning Commission unanimously agreed that no fence should be allowed: 1) Within 0-75' of lakeshore 2) If house is set closer than *75' or farther then 75’ from lakeshore - a fence could be constructed at the average setback line determined by the prin ciple structure of each adjacent lot. Lakeshore lots would be allowed fences at a maximum height of 6' - degree of opaqueness need not be con sidered as long as the fence meets the proper setback. The Planning Commission voted 3 to 2 against any need for fences around swimming pools and stated that staff would be the better judge. Minority of 2 felt that fences were necessary in densly populated areas of the City. Hammerel moved to approve the minutes of April 17, 1981. Goetten seconded. Meeting adjourned at 9:55. A.H.
