Chairman Hammerel, McDonald, Jabbour, Adams, Goetten, Frahm arrived at 8:00, and Revegno arrived at 8:50. Jeanne Mabusth re­ presented the City staff. The applicant was not present. Staff read the notifi­ cation that Planning Commission would act on his ap­ plication at this meeting whether he was present or not. Revegno moved to deny the PRD subdivision of Daryle L. Uphoff creating four condominium units based on the following findings: 1) Density standards are not met. 2) Preliminary plans are deficient because they do not designate a 50 ft. private road outlot and cul-de-sac. 3) The subdivision does not reflect the intent of the PRD ordinance. 4) The resubdivision negates all conditions of approval of the previous subdivisions. Goetten seconded. Vote: Ayes (7), Nays (0). Mr. Verne Hubbell was present. Staff reviewed the en­ gineers report noting the suggested improvements for the site. Goetten moved to approve the Conditional Use Permit based on the engineer's following recommendations: DARYLE UPHOFF 2497-99,2501-03 Kelly Ave. Preliminary Subdivision #568 8:50-9:00 MI A T7T i 1 VERNE HUBBELL 3340 Watertown Conditional Use Permit #597 8:05-8:10 1) All fill to be moved out of the wetlands to a dis­ tance of 26'. At completion the entire fill area must be 26' from defined wetland. 2) All concrete chunks and rock buried to allow adequate maintenance. 3) The remaining fill area to be graded such that no slope exceeds 4:1. 4) Entire disturbed area to be reseeded. 5) riay bales placed and staked along edge of wetlands - to remain in place until ground cover has taken hold — City Inspector to make final inspection. r I - - ■m,.. The Planning Commission mem- JOHN ALLENBERG bers asked Allenberg to review the status of the access to 1920 Sixth Ave^ the property. Allenberg stated that it vculd be through North a 10 year lease and that a fence will be constructed at a location on that access drive beyond his use area. Goetten and Hammerel both questioned the safety and phy­ sical condition of: the road and daily access to a home site. Preliminary Subdivision #592 8:10-8:20 4 Allenberg noted that he would be working with the DNR if there was any need to improve it. He did not feel the access was unsafe. McDonald asked if the Wolsfelds had been notified of the question of 2 residencies on 1 lot or Parcel B, and in addition the guest house use would not be allowed. Staff and Allenberg both noted for the record that the Wolsfelds agreed to these conditions. Hammerel moved to approve metes and bound? subdivision and lot line rearrahgement based on the following ^ findings: 1) Subdivision does not create a new lot. 2) The residential lot. Parcel A, contains 2 plus acres of dry buildable land and satisfies the area and width re­ quirements for RR-IB Zoning District. and subject to the following conditions: 1)Parcel A recognized as a single family residential lot - garage apartment may not be used as a dwelling unit. Subject structure may only be used as on accessory structures to the principle structure. Before a building permit is issued to Allenberg, he must submit proof of combination of Parcel B with lot 1, Block 1 Wolsfelds Woods Addition and copy of lease that confirms access to site. Jabbour moved to second. Vote: Ayes (6), Nays (0). John L. Laurent was present. McDonald questioned the area of dry buildable . on Lot 2. Staff noted that the revised preliminary plans was exclusive of wet lands area and road out lot. Staff also advised that Gaffron could see no problem given the soils conditions with locating a suitable on-site septic system on both sites. JOHN LAURENT 625 North Ferndale Rd. Frahm moved to approve the application of John i» Laurent subject to the following conditions: 1) Lots 1 and 2 share common access via 46' corridor. 2) Lot 2 grant an access and utilities easement in favor of Lot 1. 3) Septic test information must be submitted and reviewed prior to Council action on preliminary plat. If such results involve changes in lot lines, the plat will be l3)^ought back to the Planning Commission for review. 4) Flowage and conservation easement over the designated wetlands. 5) underlying road and utilities easement acquired by City over outlet A. 6) Park dedication fee in amount of $400, $200 for each lot. Goetten moved to second. Vote: Ayes (6), Nays (0). Mr. Robert Bredeson was present and there were no other members in the audience to address this application. Goetten questioned why the applicant was tearing down .7.^^ p.n«; the house that seemed in good condition. Bredeson stated 7:30-8.05 that the house was over 50 years old and had severe structural problems that needed correcting• The cost of repair would be comparable to constructing a new house. Staff noted that the applicant seeks direction from the Planning Commission regarding more desired setback variances. The Planning Commission is being asked to determine a recommended building envelope. Hammerel asked how this could be an action item if they do not have the final site plan. Staff advised that this could easily be tabled if the Planning Commission required the final plan. Jabbour felt that several of the proposed houses present­ ed by the applicant were much to ambitious for the lot. He advised Bredeson that the new plan must take into con­ sideration the question of excessive hard cover. The Planning Commission then selected one of the smaller sized house diagrams pre­ sented by Bredeson. Jabbour no+-ed the following recommended building en velope for che lot: 40 ft. lakeshore setback 10 ft. from the north side of the property 25 ft. from cul-de-sac or street Jabbour moved to table the variance application of Robert Bredeson subject to his submitting a revised plan noting these conditions. Hammerel moved to second# Vote: Ayes (6), Nays (03. Mike and Tim Mehner and Glenn Hubbard of the Union Oil Company were present. There was no on in the audience to address this application. The applicant stated that they propose to buy the service station from Union Oil and to operate a full service station. Staff noted that the Marina committee would review the fuel dock and boat towing service at there April 22nd meeting. MIKE MEHNER 3398 North Shore Dr. Conditional Use Permit #608 8:25-8:40 McDonald noted that it has been a year since the service station use was discontinued and that we must address this point in the review. Hubbard noted the cimount of investment and physical improve ments placed into the service station and that the economy had created problems in meeting the year deadline. r'‘ Planning Commission then noted the public support and comments from other residents who wanted a service sta­ tion back in that area. Hammerel noted the existing landscapijag would have to be upgraded.and that much of the original plantings were dead. Adams moved to approve the Conditional Use Permit of Mike Mehner for a full-service station in ggfl^ideration of the lapse in time of more than a year of that specific use based on the condition of economy and the public support of that use arid subject to the condition that the Ian scaping be upgraded.
