Conditional Use Permit #597 7:45 - 8:30 m PLANNING COMMISSION MINUTES OF MARCH 16, 1981 The site appeared to be In operation for quite a few years. It appeared that the majority of the drainage was to the rear of the property and neighboring properties have sustained no damage. Cook would recommend removal of the fill In the designated wetland area and removal of concrete blocks itnd large rocks to allow for proper ma1ntev;*»^*e. Side of fill area to be graded to 4:1 slope. Hay bales to be placed along edge of the wetlands to prevent sedimentation. Hubbell stated the operation has been going on for 15 years. Jabbour moved to table the Conditional Use Permit subject to the review of the City Engineer's report at the April 6th meet­ ing of the Planning Commission. Motion was seconded by Goetten. Vote Ayes (6), Nays (0) Mr. and Mrs. Pugh were present. No one else was present to address application. Staff advised that the application re­ quired a lot width variance because In affect we are dealing with a new home. Staff noted that the setback of the exist­ ing houses are all set back farther than the 75ft. setback and therefore, an average setback determination is necessary, an average lakeshore setback for the lakeshore deck and an average setback for the principle structure. The purpose of all Is to protect the lakeshore view of the existing homes. Jabboup moved to approve the lot area and lot width variance of De Ell Pugh subject to the finding that the property has been accessed for sewer, there Is an existing structure and there was no additional land available and subject to the following condltions; 1. The removal of the garage by the road. 2. Must connect to City Sewer 3.Proposed principal must meet average lakeshore setback of adjacent prIncIpAl structure. Page 2 CON'T. The subject accessory deck may not be enclosed. 6. New survey will be required for building permit to verify these setbacks. Motion was seconded by Goetten. Vote Ayes (6) Nays (0). Nelson was present, no one else present to address application. Mabusth noted that ordinance requires the Planning Commission to review and make recommendations to council on all Commercial Building Plans. She reviewed Building Inspector's review of the preliminary building plans, there were no major problems. The Planning Commission asked staff to review final site plan for the Office Building Project approved in January. Planning Commission raised questions concerning code requirements for various features proposed for the building. Staff advised the entire project will meet code standards. Frahm still voiced concern that the existing sewer and drainage problems have not been properly addressed. Adams moved to approve the preliminary building plans for Nelson-Creer Office Complex subject to the report of the bullding official. Motions seconded by Rovegno. Vote Ayes (5), Nays (1) Frahm noted that drainage and sewer facilities are still inadequate in the area and his position on this application is consistent with his previous position.
