The following members were present: Chairman Hurr^ Frahm, and Jabbour. Jeanne Mabusth represented the City staff. ATTENDANCE 4:10. PM James Rivers was present. There was no one in the audience to address the application. Staff review­ ed the applicable conditions of the rezoning agree­ ment that pertains to the annual license review. Council determined that the following conditions would be best enforced through the annual marina license review: WINDWARD MARINE 1981 Marina License Conditional Use Permit for overflow parking on west side of Parcels 4 and 5, specifically on east side of the western parcels. Setback variances for marina docks a) setback variance for north side of comnercial dock on Tanager Lake from residential pro­ perty (Parcel 5) b) setback variance for north side of commercial dock on Browns Bay from residential property. required 40' proposed 20* variance 20' or 50% The committee questioned Rivers in regard to the temporary sanitary facilities, tentative date of hook up to sewer, physical improvements proposed on property and completion of landscaping. Rivers stated that he planned to use satellite facilities or as in previous years and would ihook up to the sewer as soon as its available. The proposed landscaping would be completed within 30 days of the hook up to sewer. The only physical improve­ ments planned for the property this year would be the bathrooms to be installed in marina building. Hurr moved to table action on the 1981 marina license application of Sailors World pending receipt of the following in for-?', at ion from the applicant and staff: 'I Applicant to submit a plan designating the existing and proposed landscaping, location of satellite and proposed gas tanks. Staff to report: a) significance of a "district mooring area" - al­ lowed setbacks, grandfather question b) update by Fire Marshall c) L.M.C.D's review concerning slips 25, 26, 27 extending beyond 200' setback line. d) report on material used in dock construction by building inspector. Motion seconded by Jabbour. Vote: Ayes (3), Nays (0). Larry Hork and Bruce Douglas, applicant's attorney, NORTH SHORE MARINA were present. Members were concerned that no action 1981 Marina Licens had been taken on the 1980 Marina license application. The committee agreed that action be taken on last year's license application before they can consider the current application. Hurr moved to deny the 1980 Marina license application si^ject to the findings that substantiate the many violations of both City and L.M.C.D. ordinances. Motion seconded by Jabbour. Vote: Ayes (3), Nays (0). Douglas asked that the committee reconsider the motion because of the many unanswered questions that remain concerning North Shore Marina. Committee stated that they are just a recommending body and that Council need not accept the recommendation. Hork and Douglas stated that "grandfather credit" should be considered for marinas long in operation. Douglas questioned the legal definition of dock use area.
