The following members were present: Chairman Hammerel, Adauns, Goetten, Jabbour, McDonald, Rovegno, and Frahm. Jeanne Mabusth represented the City staff. ATTENDANCE 7:30 P.M. Gordon Coffin and Fred Herfurth were present for the Dayton application. Mabusth noted the affidavit of publication and the certificate of mailing. There was no one present to address the application. BRUCE DAYTON 550 Long Lake Rd. Subdivision #594 7:30-7:35 p.m. Mabusth reviewed the changes in the access road requested by the applicant. The request was to improve the road up to the most northern lot's (lot 6) driveway and a cul-de-sac would be con­ structed abutting at most northern outlot, Outlot C. The Planning Commission questioned the affects on future development of larger parcels. Staff advised that the public works coordinator could sees no use of the 1 acre parcel offered Dayton to the City for road purposes, "in addition'staff advised that the criteria used by the Park Commission for potential park properties would not be satisfied by this 1 acre parcel. Adams moved to approve the 6 lot residential plat subject to the following conditions: Private road to be designated as a 50* wide road outlot. The road to be improved up to the drive way of Lot 6 and a cul-de-sac installed at the end of that road. The road shall be a gravel, 5 ton capacity road with a finished width of 20* to 22* width. 2) Lot 6*s septic area is to be protected during period of construction. 3) Park Dedication Fee of $1,200.00 for 6 lots §200.00 To leave out any consideration of the one acre parcel offered for city use. Vote: Ayes (7), Nays (0). Mrs. Nancy Danielson, Ronald and Ruth MacLeod were present. Mabusth noted the affidavit of publication and certificate of mailing. Staff reviewed the request of the City to re­ require a 15 foot wide outlot along the western and northern portions of the property designating half of the existing road. Staff also noted the major drainage way and wet lands along the southern portions of the property. Applicant was advised that a new preliminary plan would have to be submitted designating the following: 15* wide road outlot 2) Drainage way and wetlands to the south of the property. 3) Area of each lot exclusive of the road and wet lands area. Hammerel moved to table the Laurent subdivision application pending receipt of the adjusted pre­ liminary plans. Motion seconded by Adams. Vote: Ayes (7), Nays (0) . No one was present in the audience to address the Allenburg subdivision. Mabusth noted the affidavit of publication and the certificate of mailing. Mabusth advised that she had talked to the Wolsfelds concerning the 2 residential units on a substandard lot. Mrs. Wolsfeld stated that she and her husband would comply with the ordinances and that the garage apartment would cease being rented in June 1981. Allenburg noted that the Wolsfelds were interested in using the garage as a guest house. Mabusth advised that the same or­ dinances would apply. Staff noted that this vrould be a plat and that the preliminary plans for this plat should be submitted by the applicant before this body could recommend approval. The Planning Commission asked staff to contact the Wolsfelds to advise them of the affects of the proposed sub­ division and their request to use garage apartment as a guest house. Page 2 JOHN L. Motion seconded by Adams. Vote; Ayes (7), Nays (0). Judd Ringer, Conrad Schmidt, and Pat Meyers re­ presenting the staff of Parkview were present. Mabusth noted the affidavit of publication and the certificate of mailing. JUDD RINGER 2280 Wayzata Blvd. Subdivision #595 Ringer reviewed the application for those who were in attendance. He wishes to divide his 57 acre parcel into 2 lots, the one 28 acres lot is to be used by the Parkview Corporation as a 24- bed in-patient treatment center. 8:25 - 9:40 p.m. The following residents and interested parties were present to address the application; Wendy Sarles of 15 Westwood Drive; George Johnson of 879 North Brown Rd.; Chuch Peterson of 277 Westonka Drive; Bill Hutchions of 900 Willow Driver- Bill Wear of 2160 Willow Drive; Pat Mastny of 61 Brown Rd.; Bernie Cox of 1020 W. Willow Driver- Marge Humphry, Peggy Tutle, Jo and Alan Hur, Sally Murphy, Fred Herfurth, Bonnie Hallson, and Mr. and Mrs. Phil Fettig of 960 Willow Drive.'It ; The following questions were raised by the audience: What would the Orono School's responsibility be in regard to supplying educational needs for patients? Who would pay for the cost of treatment? Will the patients be coming from the inner city of specifically the western suburbs? Would the center use the Dickey Lake at some future date? Increase in traffic will cause serious problems for an already overburdened traffic intersection? What kinds of security will the institution use to control the coming and goings of the adolescent patients? How many staff people do they plan to have at the facility specifically at night? Many questioned the type of treatment used in Parkview's treatment of patients specifically the verbal abuse expressed by some present. Some questioned the pollution of the lake to the north as a result of no sewer and the size of the proposed facility. i I >MV*^rr^' .;,: /■;"; 0 s', »s,.',; PLANNING COMMISSION MINUTES Of MANCH 2, 1981 Page 4 V Residents questioned this type of use in this area and is it needed? Are sewer and better roads required to serve the facility? Why does the Parkview staff feel that a psychiatrist on the staff is not necessary? Should a quasi commercial use be allowed in a rural residential area where there is no sewer? The Parkview staff responses are as follows: The school districts of each patient would be res> ponsible for paying for the educational needs. Parents through hospitalization or private corporations would pay for the cost of treatment for each patient. It is possible that Dickey Lake would be used at a future date. The patients would be coming from the western suburbs only. In regard to traffic concerns the 24 patients do not come and go, only during the special feunily group sessions would there be additional traffic and that would only be at night. During the day, there would be a staff of 11 and at night there would be 1 RN and 2 nursing assistants. The type of treatment by Parkview is similar to that practiced at other treatment centers. Such treatment i new and constantly being reviewed and reevaluated. The soil and septic testing will allow for an on site system to serve the 24 patients and staff members. There will be adequate area given 28 acres for increase septic demand and expansion. It is in the opinion of the treatment center that the need is great for the western suburbs. The Planning Commission determined that if this ap­ plication is formalized that a study of the impact on the land, existing roads and demand for sewer be reviewed. Planning Commission felt the scope of the project might lead into additional expansion in the future and asked the applicant, that if he is granted a Conditional Use Permit, would he agree to a restriction of some kind - such as a deed restriction limiting him to a specific number of patients in the future, as one way to control the growth of the operation. The application will be brought to Council on April 13, 1981, to determine the scope of the application to be filed if Mr. Ringer plans to continue. i • IV''i ■V:- 5?^ PLANNING COMMISSION MINUTES OF MARCH 2, 1981 Page 5 The Planning Commission would advise that the application involve most certainly a subdivision and a Conditional Use Permit under Section 34.823 and that there is no need to amend the zoning ordinance to include a chemical dep- endancy treatment center, as the proposed use falls well within the definition of those already permitted. ! i- < The applicant was not present. Mabusth reviewed the subdivision for the new members. Revegno moved to apprc ^ vj vht' 2 lot subdivision of the First National Bank of Navarre subject to the findings and conditions sited in the staff re­ solution. Motion seconded by H2unmerel. Vote: Ayes (7), Nays (0). FIRST NATIONAL BANK OF NAVARRE 2465 Shadywood Rd. Final Subdivision #491 Fred Hintze and Bob Skinner were present. Mabusth noted again that there was no specific parking re­ quirements for this type of restaurant and asked for a recommendation from the Planning cd^ission. The Planning Commission advised that 5 parking stalls Permit on the west side of the building adequate to serve #600 the proposed restaurant. It was noted that drive- in establishments require 1 stall per 15 sf of floor area and that restaurants serving liquor require 1 stall per 80 sf of piO?Tic floor area. The total are of the entire operation including kitchen and public floor area is 324 sf. Ad2uns moved to approve the Conditional Use Permit for Fred Hintze and Bob Skinner and noted in the absence of specific directions from the zoning code concerning the parking requirements for this type of restaurant, we recommend a minimum of 5 parking stalls with the understanding that overflow parking stalls are available to the rear of the building. The signs of the proposed restaurant must conform to the sign ordinance. BOB SKINNER FRED HINTZE 3416 Shoreline Dr. Conditional Use Motion seconded by Gloria McDonald Nays (0). Vote: Ayes (7), The applicant was present. Mabusth explained that since the meeting of February 2, 1981, one of the three lots making up the required 10 acres of land had been sold. In addition, Kroger advised that the remaining 8 acres would simply be used as a nursery. The sales part of his operation will be conducted at another site, not located in Orono. Rovegno moved to deny the Conditional Use Permit of Jerome D. Kroger finding that a Conditional Use Permit to grow trees is not necessary if the on site sales of trees is not planned. JEROME D. Vote: Ayes (6), Nays (1). Minority opinion-McDonald said we should acknowledge the Conditional Use Permit application and grant it as such. It is a commercial use on a residential piece of property not a quasi commercial. The applicant was present. Mabusth explained that a setback variance is required for the proposed horse barn 30 x 45'. The barn has been located at the most central location, a 28* setback is required on both side yards. The Planning Commission also noted that the applicant requires an area variance for 2 horse?. The required area for 2 horses is 4 acres and the subject lot has 3.9 acres. Hammerel moved to approve the variance application of Judyne Hassel with the understanding that 3.9 acres could not support more than two horses based on the following hardships: 1) No additional land available JUDYNE HASSEL 2550 Sixth Ave. N< Variance ^ #604 2) Existing lot width and subject to the condition that the applicant submit written proof of neighboring property owners on east and west that they do not object. Motion seconded by Jabbour. Vote: Ayes (7), Nays (0). The applicant was present. Tom Jacobs presented the DOROTHY PORCIER application. Jacobs noted the application is the 4780 North Arm same one reviewed and approved by Council in June of Drive West 1977. The Planning Commission discussed the question Variance of requiring the applicant to submit proof of contract: #605 with an agency to clean up the debris on lot. The Planning Commission decided this could best be enforced by staff during the construction period. Jabbour moved to approve the renewed variance ap­ plication of Dorothy Forcier based on the following hardhships; 1) Small lot restricted by 2 acre minimum standards. 2) Location of house on lot and subject to the following conditions: 1) Applicant is responsible for clearing the debris stored on property. ipr- ■ • ■ V.
