The area of the park consists of 5, 50' X 150' lots. The park will be designed specifically for younger children - grassed areas with playground equipment. Your approving recommendations should contain the following points: to recommend preliminary approval of the Navarre plat for 24 residential units based on the finding that the subdivision meets the allowed density use for the LR-lC-1 district and that there is adequate sewer and water service available to the subject area; such approval is subject to the following conditions: 1) Plat road, to be named Wiley Place, is to be a public road (30' pavement, 80' diameter cul de sac, 7 ton cap­ acity) . Obtain new permit from Hennepin County Highway Department if necessary - right turn lane at west end of property is required. 2) Holding Pond designated as an outlet with 15' easement designation for storm sewer wetwork. City to require a flowage and conservation easement over retention pond. M.C.W.D. must review this proposal. 3) Developer must submit grading, planting and erosion con­ trol plans. 4) Developer is responsible for extension of sewer and water service to each unit. 5) Dedicate 7' of additional right of way on County Road 15, Dedicate 15' of additional right of way on Blaine Avenue. Dedicate 5' for walkway. Dedicate drainage easements over entire pond area. 6) Developer to submit copy of proposed Homeowners Association Articles of Incorporation bylaws and protective coven­ ants providing for common ownership and maintenance of pond and walking outlots. Ericson, 1620 Shadywood Rd - Conditional Use Permit Mr. Ericson is applying for a conditional use permit to do repairs on his pagota, which is within 75' of the lake. The assessor's fair market value on this structure is $2,457. This is under what is stated in ordinance no. 31.106. 31.106. Any lawful non-conforming use of land not involving a structure, any lawful non-conforming use involving a structure with an assessor's fair market value upon the ef­ fective date of this zoning code of three thousand dollars (3,000) or less, may be continued for a period of thirty-six (36) months after the effective da^e this zoning code, whereupon such non-conforming use shall cease, unless brought into conformity with the zoning code. (ord. 172, 12-19-74, effective 1-1-75) Although it is under the $3,000 limit the structure is in very good shape. Mr. Ericson was attempting to repair the foundation when he was stopped by the City. Please refer to section 31.103. 31.103. Nothing in this Zoning Code shall prevent the placing of a structure in safe condition when said structure is de­ clared unsafe by the Building Ispector, providing the neces­ sary repairs shall not constitute more than 50 percent of the fair market value of such structure. Structure shall include such accessory features attached to the structure or located anywhere on the land, such as signs, marquees, monuments. Mabusth June 10, 1981 #614 David Myhre, 2590 Casco Point Road Preliminary Svibdivision Staff Update The applicant's surveyor has asked the Planning Commission to reconsider their request to move the lot line further north to allow for an increase in the depth along the required building line width cf 100'. He notes the access road and topography will determine the only building site. At the referenced building site there is approximately 115' of width. In the given lot configuration lot B maintains a 100' width for a 45' depth. Your recommendation of approval should refer to either the current survey dated April 27, 1981, or a revised plan re­ flecting the lot line change based on the following findings: 1) The newly created lot and the remaining homestead lot meet all the standards of the LR-IC zoning district. 2) Adequate sewer and water service for site and stubs available for hook up. and subject to the following conditions 1) Access to both lots shall be via the existing drive­ way - no direct access onto Casco Point Road 2) Lot A must grant an access and utilities easement in favor of Lot B. 3) Lot B is non riparian to Lake Minnetonka. Both have been charged a sewer unit and each a stub available for hook up. Note the sewer easement that runs through the middle of each lot on each of the surveys. Lot 7 has not had the sewer stub designated. Access to the sites will be via the unimproved right of way. The lift station manhole is located .In the middle of the 20' right of way. If approved applicant;; will be responsible for arranging access through Heit property on either east or west side of right of way. nn access from the north through Desplinter driveway within 20' right of way may be the best approach to both sites. Remember the Desplinter application for lots 4 and 5 to the north of the subject property. The ap­ plicant was responsible for submitting road grading and drainage plans and to enter into a hold harmless agreement with the City for road work prior to issuance of a building permit. Both lots have hardcover problems because of the driveway lengths. Both have been charged a sewer unit and each a stub available for hook up. Note the sewer easement that runs through the middle of each lot on each of the surveys. Lot 7 has not had the sewer stub designated. Access to the sites will bo via the unimproved right of way. The lift station manhole is located in the middle of the 20' right of way. If approved applicants will be responsible for arranging access through Heit property on either east or west side of right of way. An access from the north through Desplinter driveway within 20' right of way may be the best approacn to both sites. Remember the Desplinter application for lots 4 and 5 to the north of the subject property. The ap­ plicant was responsible for submitting road grading and drainage plans and to enter into a hold harmless agreement with the City for road work prior to issuance of a building permit. Both lots have hardcover problems because of the driveway lengths. The problem posed is similar to the considerations and findings made in the recent Nunnally review. The best soils on the parcel for waste treatment do occur near the proposed treatment center buildings, which might allow for a standard drainfield system rather than the sewage treat­ ment mounds which would likely be required for individual homes due to slowly permeable soils and high water tables on the site. Olson DATE:June 9, 1981 SUBJECT:#615 Ringer Subdivision #616 Parkview Treatment Center, Purposes This memo is in response to your request of May 26, 1981 re garding technical review of these proposals. Background The proposal is to subdivide 55+ acres into 2 or 3 large tracts, one of which (size 28 acres) may be used for a chemical depen­ dency treatment center having a maximum projected size of 42 beds. Staffing would be 1 per 3 patients for 2 shifts and 1 per 10 patients overnight. Other considerations include visitors and deliverymen. The alternative is platting of the 28 acres for residential home- sites. Because of soil and watertable problems, Mr. Gaffron ad­ vises that the maximum residential division would likely be 10 homes. The subject is comparison of these two possible developments. Basic Land Use The land is zoned for residential developments as a permitted use. The Council has determined that the Parkview proposal does qualify for review as a Conditional Use in this district per 34.823. Planning Commission and Council should recall that to deny a Conditional Use Permit, vary detailed findings have to made that the proposal is directly and demonstrably adverse to the public health and safety. The record must contain facts to support such a finding. Use Density Parkview currently proposes an ultimate main structure of about 12.000 square feet. An existing 3,000 sq.ft, barn is likely to remain. Also possible are scattered out buildings for ser- ivce purposes. Parking would probably oe for 25-30 cars totaling 10.000 sq ft. Therefore, it should be assumed that there would be 25,000 - 30,000 sq ft of hardcover, plus driveways. Assume 1 acre total of 28 » 3.5% hardcover. A typical rural Orono home might include the house (3000 sq ft), an outbuilding (1000 sq ft) and driveways for about 10,000 sq ft out of 2 acres • 11.5% hardcover. Common planning principles calculate residential trips per day (one way auto movements) as 8 to 12 TPD/residence or 2.7 to 3.5 TPD/person x 3.5 persons/household = 9.5 to 12 TPD/residence. Therefore, assume 10 TPD/residence = 100 TPD for 10 homes. Estimated Parkview TPD is calculated as follows: Staff: 14 per shift x 2 = 28 4 per night shift = 4 3?/day x 2 62 TPD Visitors: 1 per patient/day = 42 x 2 Patients: arrival/departure (est) = 84 TPD = 2 TPD Deliveries: food/laundry/ repairs; est 15/day = 30 TPD 180 TPD Comparison is 180 or 200 TPD Parkview vs 100 TPD residential. At 200 TPD, this is equivalent to 20+ residences. Normally this level of useage would require access on a publicly maintained street, not via a private outlot. Lake Use The Ringer property includes about 700 ft of shoreline on Dickey Lake, which is about 1/6 of the total shoreline. Seven residences plus 2 other vacant tracts also abut the shore. Zoning District lake frontage requirements are 200 ft/residence. The existing residences average 250-300 ft of shoreline each, although 2 parcels have only 50 ft each. The Ringer property if residentially developed would therefore likely have at most 3 riparian lots, each of which would be al­ lowed 1 dock and up to 4 boats (LMCD Lake Minnetonka spec's). Parkview lake use should this be limited to not more than the same level of useage, which could be up to 12 boats. Dickey's Lake is entirely private. There is no existing public access even though it is classified as public waters. As part of the subdivision, we should carefully consider platting of a fire lane or other limited access trail. . ! vf -....S'C!. -S. » aSamm^ai ■=r! #615 Ringer Subdivision #616 Parkview Treatment Center Page 3 Security Chief Kilbo has addressed this matter. The proposed facility is located far from existing residences. In some respects, problems with outside persons (such a burglary of the premises) should be less than the residential risk because the facility will be oc­ cupied and staffed 24 hours per day whereas rural residences are frequently unoccuppied. Fire Protection Parkview would be classified as a type I-l institutional occupancy. All construction must be type 1 hour fire resistive (for a 12,000 sf facility located where proposed). Fire alarm and fire sprinkler systems are required. The sprinkler is a costly item here because there is no municipal water available. A reservoir or tank will be required unless a water connection is made to the Long Lake system. Fire and emergency access should be provided by good design of the road and parking areas, which should be a condition of any approval. This level of protection is generally higher than provided in^ single family residences because the risk, particularly the life- safety risk, is more severe. It is also likely that more fire runs will be generated including false-alarm calls. Subdivision Design My personal feeling and recommendation is that the May 7, 1981 preliminary plat should not be approved as drawn. Access to the Parkview site is not well developed. There is no cul de sac on the proposed outlet. There is no indication of plans for access to or use of the front strip of land along highway 12. These issues should be finalized at the Planning Commission level before taking a revised or clarified plat to the Council. Traffic issues seem paramount. I have concluded a site analysis of possible access points shown on attached drawing #1. Consis­ tent with our CMP and with MnDOT criteria, direct access onto highway 12 should be strictly limited. Two excellent locations are available directly acress from existing Tamarack and Brim- hall Avenues. The existing dr/. eway location to this site has reasonable visibility but should not be upgraded at its present location because of conflicts with the opposing streets. Almost any location along Willow Drive is a good access point, except within 200-300 ft of highway 12. ZM #615 Ringer Subdivision #616 Parkview Treatment Center Page 4 The Rebers property will also be developed sometime. Considera­ tion must be given now to any need for interrelating access be­ tween the Ringer and Rebers parcels, particularly because Reber has very limited access locations available. Brown Road has 1 good and 3 fair locations dictated by sight distance on the rolling profile. Highway 12 has very poor access to the Reber land because of a hill and curve. Drawings 2-5 attached suggest some designs for alternative ac­ cessing to the Ringer and Rebers properties. In all cases, the suggested road location is different than on the proposed May 7, 1981, drawing. Note that all suggestions separate Park- view (and Ringer lab?) traffic from residential traffic, which is not done on the existing proposal except by unacceptable mul­ tiple direct access onto highway 12. Future Changes The proposed Parkview facilities are all clustered in one area of the 28 acres site. Future economic or social changes may affect long term operation of the facility as proposed. If the 28 acres site remains zoned RR—IB residential, the poten­ tial remians for future subdivision into 2 acre lots, either of all or a portion of the site. Even with open space easements, there may be future pressure to subdivide off several lots while retaining this principle use, or at the time this use might be converted into something else. One cannot foresee every possibility. However, permanent cisions such as platting approvals and road locations must take into account these concerns, and must allow flexibility to meet unseen future changes. My professional recommendation is to revise this proposed sub­ division as follow^: Reguire a road system that will reasonably serve all future development of the land abutting highway 12 via limited, well-located "street" accesses instead of direct curb-cuts. Consider the implications, location and design of a new public street to serve the Parkview (and other non-single family residential) uses as dictated by the high TPD traffic count. Note, public streets are often more desireable for mainten­ ance if looped or thru design rather than cul de sac. Consider allowing for future interconnection with roads in the Rebers property. i letime. The police do not feel Parkview is any significant problem to them. I am concerned at the young age level of patients, in respect to the runa%#ay problem that might put more load on the department. In regards to problems with the treatment center, several of our officers stated that they did not know it existed. A check of our files shows no problems and I recall no negative conments. 2. Again, everything I have heard about the treatment center has been positive, and we have encountered no problems. Our detectives have had contact with Pay Myers in referring juvenile persons to him, and they have spoken very positively of their working relationship with the Minnetonka School District and the chemical dependency area. Detective Ivars Upens also expresses his positive feelings about the program and encourages its utilization by the City of Orono. He also advises that the Hennepin County Advisory Committee uses the facilities for their meetings, which has enhanced the overall picture of the program for the participants. 3. We have not had any negative feedback of the center, I apologize for the delay in this matter, and hope that this meets with your needs. Rudd, 1325 Shoreline Drive Conditional Use Permit Mr. Rudd requests a conditional use permit to dredge wide 100' length channel to his existing 100* dock. applicant was asked if the condition arose as a result or the current water level and his response was that the con­ dition has existed for over five years. He contends his boat and his friends' boats have been damaged by large rock in the approach areas to his dock. The application involves the removal of not only large rocks but the removal of 2' to 3' of lake bottom, a total of 533 cubic yards. The existing dock appears to have approximately 3»i of depth. The subject area is located in a centralized collector point of an extensive network of an agricultural drainage tile system coming in from the north east and north west. Through the years of use the tiles were broken and now drain out over the land causing a waterfall Sheean property to the south. The Veon property in the area of the spill out was continuously wet and mucky. Please re­ view applicant's comments enclosed in packet. The pond covers an area 30' x 228' or 6840 sf. The site plan that Veon has sketched is accompanied by photos that are numbered and keyed to the drawing. The photos will be avail­ able at the meeting. Joel Settles, limnologist U.S. Soils Office, advises that the pond appears to meet specifications established by U.S. Soils office for wildlife ponds. He will ask the environmental engineer that specializes in this subject to review the ap­ plication and the site of excavation. Environmentally, he can see no problem. He advises that there are specific criteria that wildlife ponds must meet if they are to be effective. For Example: 1) drainage area must be extensive enough to keep certain level of water 2) slope of banks - must have gradual sloping banks 3) island area Unfortunately, the review can not be completed by Monday night's meeting. Prior to excavation, the area in question contained no small shrubs or bushes, and likewise no reedy vegetation which would provide suitable wildlife habitat. It simply had the shaggy appearance of overgrown grass and served no other purpose than as a breeding reservoir for mosquitos. The excavation has produced a lovely, mirror-like pond which is a pleasure to behold. T have noticed that the location is already being visited by a pair of Canadian geese, as well as the normal assortment of field birds and four-legged beasties. In the creation of this beautiful and habitable pondsite, Mr. and Mrs. Veon have demonstrated a high degree of understanding and appreciation toward the harmonious interworkings of the natural environment. Addition£*lly, they have displayed a high regard for the aesthetic sensibilities of their neighbors through their thoughtful attention to the location and the artistic contouring of the pond site. Larson, Conditional Use Permit Zoning District - LR-lC Application - conditional use permit to construct retaining wall and replace wooden stair structure to lake shore dock The applicant proposes construction of a 40* lono S^s'high retaining wall to prevent further erosion of their lakeshore bank. It would appear that the original house construction so close to the bank created the severe instability. Rip rap is not feasible. The retaining wall is the only method available to control the extensive erosion that is contin­ uously weakening the stairs structure to the lake and even­ tually may cause structural damage to the house. The proposed stairs structure is far too ambitious and must be trimmed down. I suggest that the 6* maximum width stan­ dard for docks be allowed (spaced board construction). The 5' X 12' landing must be trimmed down to 5* x 6'. The new central location of the stairs is no problem. Any additional structure or decking on the surface of the shoreline must be replaced with eitner crushed rock or other permeable material. The replacement of the stairs, the landing 5’ x 6' in con­ sideration of the safety factor and the retaining wall are the only structure that can be considered within the pro­ tective lakeshore setback area. The retaining wall design will be reviewed by the City Engineer.
