Present were the following members: Chairman Hammerel, McDonald, Adams, Jabbour, Frahm, Hannah and Wilson. Mabusth represented the City staff. ATTENDANCE Hammerel announced the Public Information Meeting. Mabusth stated she had the Affidavit of Publication and Certificate of Mailing. Mrs. Mertz was present Also present was William Waldron, 1880 Fox Street, who was in favor of the subdivision. E. T. MERTZ 1820 Fox Street SUBDIVISION Public Info. Meeting 7:30 P.M.-7:32 P.M. (#557) Wilson moved to recommend approval of the two lot plat as it complies with all Orono Ordinances contingent upon the following: 1. 2. Payment of a park fee for Lot 1 of S200. All new septic installation to conform with the On-Site Manager's report and recommended septic design of consultant. Curb cut on Fox Street for Lot I's driveway subject to Public Works Coordinator’s review. Motion seconded by Ad2uns. Vote: Ayes (7) , Nays (0) . Motion passed unanimously. 3. Mr. Klitzke was present. Mabusth statgH that there was no change in the orj^g^nal drainage easements in fit-.ielows Addition and that the Flowage and Easement is stiii in effect. OREN KLITZKE 555/575 Oxford Rd. FINAL SUBDIVinON (#482) All COTditions of final plat approval have been met. Adams moved to recommend approval of the lot lino realignment to accommodate the new house location of Mr. Klitzke and to provide adequate area for the two lots to meet the septic ordinance requirements. Motion was seconded by Wilson. Vote: Ayes (7), Nays (0). Motion passed unanimously. Mr. Brooks was not present. Septic testing has been done and the On-Site Systems Manager recommends approval. OF ORONO C ■ hdJ City of ORONO RESOLUTION OF THE CITY COUNCIL NO. 1157_ _ _ _ _ _ A RESOLUTION APPROVING THE PLAT OF KLITZKE ADDITION WHEREIAS, the City of Orono is a municipal corporation organized and existing under the laws of the State of Minnesota; and # WHEREAS, the City Council of the City of Orono has adopted subdivision regulations for the orderly, economic and safe development of land within the City; and WHEREAS, the City Council has considered the application for a subdivision plat by Loren Klitzke, the subdivider; and WHEREAS, the subdivider has completed all requirements of the platting regulations of the City, including: 1. 2. Dedication of drainage and utility easements. Dedication on the plat of a drainage easement over a drainageway in Lot 1 and over the marsh area along the shoreline of Lot 1 and Lot 2. 3. Payment to the City for legal and engineering fees in the amount of $50.00. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Orono hereby approves the plat of Klitzke Addition, Hennepin County, Minnesota; subject to the following conditions: 1. 2. 3. The aforesaid plat shall be filed with the Hennepin County Recorder's Office on or before December 30, 1980 together with a certified original copy of this Resolution. Lot 1 has had a drainfield site tested and approved for installation of a shallow trench drainfield according to Ordinance No. 210, which site must be reserved for said purpose. An alternate site has been designated and requires mound system. The originally approved drainfield site for Lot 2, Klitzke Addition, formerly Lot 5, Stielow Addition, will not be effected by the subdivision. McQjusth DATE:May 29, 1981 SUBJECT:#618 Rex Welsh, 650 North Arm Drive Conditional Use Permit Zoning District - LR-IB Application - Conditional Use Permit for dredging - not maintenance dredging Mr. Welsh would like to construct a dock on his lakeshore but finds he does not have navigable waters at that location. Please review the enclosed Council minutes of 10-10-78 and the Zoning Administrator's memo for a setback variance application for the Welsh's to permit construction of his new home. Note the lines that refer to his proposed dock that the City would not recommend dredging, shoreline alteration, decks or retaining walls on the steep bank. To my knowledge the Council has not approved a request for new dredging under any circumstance. The west portion of the area to be dredged is typical of the lakeshore environment this Council will fight to protect. Planning Commission may take the compromise position of granting a dock lenght variance for a given lenght over 100' where it reaches a 4' navigable depth. Malkerson May 12, 1981 Recent Special Use Permit Case On March 13, 1981, in the case C. R. Investments versus Village of Shoreview, the Minnesota Supreme Court reversed the decision of a District Court which District Court had upheld the denial of a special use permit. The Court found that a City Council's denial of a special use permit (authorized to be granted at the Council's discretion) for construction of multiple housing was arbitrary and capricious when the denial was based on reasons which either had no factual basis or were not legally sufficient because it was unrelated to public health, safety, or welfare. The contrary findings and ruling of the District Court is to be given no weight by the Appellate Court. The "vague concerns" expressed by neighbors and council members at a public hearing about lack of buffering between single and multiple dwellings, traffic, property values, and density did not supply an adequate factual basis for denial. Although usually, the Supreme Court rules on behalf of the City in conditional use permit cases, this case shows clearly that the City Council, Planning Commission and city staff must do a good job in ensuring that there is enough evidence in the record of substance to justify denial. Vague references for reasons for denial will not be sufficient. It may mean in the future that the City will need to retain an appraiser to justify a finding of diminution in value, or else require that the objecting property owners in the neighborhood provide that sort of evidence at their expense, I enclose a copy of the case for your review. ‘i BDM/jd cc: Walter R.
