Mabusth DATE:May 15, 1981 SUBJECT:#616 Parkview Center, Conditional Use Permit Zoning District - RR-IB Area - 28 acres Application - Conditional Use Permit - Ordinance 34.823 Ordinance 34.823 notes only two standards for consideration in this review: 1.All buildings located 100 feet from any lot line abutting a residential district. Review the enclosed site plan. The old farm house and shed on west side of lot are to be remov’c^d. The barn located 115 feet from property line does nor meet the required 150 feet standard for animal barns. A condition of approval must note this barn may never house animals if lot line remains at 115 foot setback. 2.Required 600 square feet of lot area for each person. The maximum number of persons to be accomodated by this facility is 42. The patient/area ratio at maximum level use would be 1 to 29, 040 square feet. Review of site plan !• Detailed park plan must be submitted designating total number of stalls meeting 9'x20* standard. Per Ordinance 38.308 Hospitals Required 1 stall for each 3 beds 14 stalls for primary use ? additional stalls for emplr 'ee parking B) Loading berths 38.401 Standard 25' x 12' 1 required and designated on plan 2.Landscape Plan A) Hiking paths and walkways designated B) Planting proposed and existing - specifically buffer planting along residential lines. 3.Proposed use of all accessary structures on site - Plans for additional structures on site. Jacobs DATE:May 14, 1981 SUBJECT; Donald H. Weiss, 2245 Shadywood Road Variance - #611 Mrs. Weiss has asked to come back to Planning Commission to review the side setback on her garage. She is asking for a 5' setback from the side lot line. This variance would be 50% of what is required. My recommendation is that the structure maintain the 10' setback, for the following reasons; 1) The neighboring property has a structure close to the lot line, which would result in a possible fire hazard. 2) There is no actual hardship to allow a variance. ■ H NSTRUCrlOHS: 1. 2. Normally, permits are never issued on properties undergoing division until final approva because lot lines (setbacks) may change or the division may never be pursued. The proposed house is 25' off the existing side property line and 65* off the proposed side line. Without completion of the plat, and with this house location, original Lot 4 would have only the alternate drainfield site available. Page 14 SUBDIVISION 555/575 Oxford Road (Continued) Because Mr. Klitzke currently owns both lots, I |j feel comfortable in recommending that the house construction can proceed if the lots are lega y on Lot 5 until the rearrangement is completed. The application expired over a year ago. A sketch plan review was applied for in October of 1980 in which the applicant proposed a P.R.D. of 20 units providing access to 4 single family units off Blaine Avenue. Council denied this request. Hussman has filed a formal application with the City for the same plan proposed in 1979 allowing for 24 residential units arranged as twinhomes on individual lots for an overall density of 2.59 dwellings per acre including the street, or 3.15 dwellings per acre excluding the street. The plat road, 30' paved ’-»idth with a 50' right-of-way will be public because of the ■’ewer and water service. All proposed structures meet the setback reauirements of the zoning district. All of the detailed engineering plans for the road, sewer and water construction and drainage improvements submitted with the original plat are approved, on file and valid for this current application. The City will acquire a Flowage and Conservation easement over the ponding area. The Park Commission recommended against a neighborhood park for the plat because of the proximity of Daniels Park on Lyric Avenue.
