Preliminary Subdivision Public Hearing • May 4, 1981 Your approving recouanendation should contain the following conditions: 1) Private driveway to serve all three lots, no direct access for Lot 1 to Watertown Rd. 2) Removal of existing road bed down center of property. Developer's agreement will be required if improvements not completed prior to final plat approval. 3) City to acquire road and utilities easement over drive- way outlet. 4) All disturbed areas to be seeded within 10 days of grading completion. 5) Payment of park dedication fee in the amount of $600.00 $200.00 for each lot. Mabusth DATE: April 29, 1981 SUBJECT: #609 Ruxton R. Strong# 420 Brown Rd. South Subdivision Staff Update Staff wishes to respond to questions raised at our last meeting concerning the proposed subdivision. Gaffron states this is no problem since there is ample soils to allow future septic expansion. His memo of April b, 1981, notes concern with the existing system that appeared t be "non conforming." Gaffron reviewed with the applicant the irregularities found on the site. Strong noted it was a met­ hod suggested to clear drainfield lines. Gaffron will make another site inspection? hopefully, I will be able to report his findings at the meeting. The wetland is located 18* from south property line. At that point an 18’ wide road would be located right at the south property line. A variance of 26' from the wetland will be required. There are no setback requirements for roads to property lines. The road will require engineering plans that will determine adequate sizing of culvert for drainage way to the south. If approved, your recommendation should contain the following conditions: 1) Flowage & Conservation easement over the 1.3 acres of wetlands. 2) city to acquire underlying road and utilities easement over Outlot B or A. 3) All access to 3 lots via plat road. 4) Ownership of Outlot A must be decided - Planning Commission may advise applicant to combine this outlot with road out­ lot for benefit of shared ownership. 5) Payment of Park dedication fee in the amount of $400.00 $200.00 for each undeveloped lot. i ♦ %.J b. #609 Ruxton R. Bredeson - Variance Comparison of hardcover Existing house Proposed house 1965 sf (including driveway) 3467 sf a) 440 sf - add to above figure for proposed driveway location b) 250 sf - if driveway located no more than 25' from cul de sac Hardcover - Proposed house 0-75' - 2667 sf 75' - 250' - 800 sf Setback Comparison Proposed house - never closer than recomirended 40' Existing house - 36' on west shoreline Staff Comments 1) House could be relocated closer to cul de sac - 35' recommended. This location would meet front (street) setback standard, protect lakeview of houses to north and be more in keeping with average lakeshore setback requirement for new construction. The house is very ambitious given the size and lakeshore set­ back limitations. If approved the applicant must be made aware that the City will allow no additional accessory hardcover. If there are to be defined walkways, they must be pervious to water such as crushed natural stone. In addition, no other accessory structure will be allov/ed on property - nor to remain. Review of above 1) Move house west to meet 35' setback from cul de sac 2) Ask for removal of any sheds, accessory structures or paved areas on site 3) Any additional improvements on site must be pervious to water Ask applicant to consider a reduction in size of proposed house because you doubt if Council will approve such an ambitious proposal for thii size lot. Those present from the City Council were Norman Paurus, Mary Butler« and Gregg Hannah. Those present from the Planning Commission were John Haromerel, Gloria McDonald, Tom Frahm, Diann Goetten, and George Revegno. Those present from the City Staff were Alan Olson, Tom Jacobs, and Jeanne Mabusth. 7:40 PM Jo Ellen Hurr from the City Council arrived. ATTENDANCE 7:30 PM Alan Olson reviewed the status of comprehensive plan review by the Metropolitan Council. The City has received a letter stating that the review is in pro­ gress and is expected to be completed sometime before June 26, 1981. The City will then have at least two weeks to review the staff comments before our plan tevxewed by the Metro Councils Physical Development Committee. Alan Olson briefly reviewed the status of the recodi­ fication progreun for the Municipal Code and explain­ ed again for the Planning Commission that recodifi- oation was a reorganization of our existing code, and it did not in itself refer to any ordinance changes. However, during that process, we fully intended to make any necessary substantive changes to the ordinances, particularly the zoning ordinances which we were re­ viewing tonight. Any zoning ordinance changes would be adopted at the time of recodification but would be first reviewed at public hearings, as required by law. Agenda item number three was discussed as far as format for reviewing the zoning ordinance revisions. Topics discussed included suggested changes to regul­ ations regarding fences, accessory buildings, and land alteration projects. Items regarding guest houses, and suggested changes in setback standards were not discussed at this meeting. This meeting's purpose was to be a work session round « table discussion on all sides of each issue. No action was taken on any topic. Olson, City Planner DATE:March 25, 1981 SUBJECT:Ordinance Revisions - Fences Existing Regulations 1.Sections 31.433 and 31.434 permit certain fences and walls (along with other items) as "non-encroachments" into required yard areas. No setback is required. 31.433 permits fences not over 3-1/2 ft. high in any yard, or fences not over 6 ft. high along the front lot of the lake frontage lots abutting a major thoroughfare 31.434 permits fences and walls not over 6 ft. above grade in any aide or rear yard. Sections 35.047, 35.282, 35.357 & 35.446 require 6 ft. fencing (or natural screening) in B-1, B-3, B-4 & B-5 zones abutting residential property. Sections 35.501 6 35.551 . squire 6 ft. fences or walls (or landscaping) between gas stations or driveins and residential property. Section 37.100 defines required screening as a solid fence or wall at least 50% opaque. Natural plantings are "in addition to" required fencing. The State Building Code Section 301^2 does not require a building permit for fences 6 ft. high or less. Issues 1. Fences are permitted in lakeshore yards which may adversely affect views. Iliere is no differentiation between the needs of urban and rural neighborhoods. 9.Ordinances should protect against typical complaints (view blockage, spite fences) yet permit maximum flexibility to preserve privacy and to keep public involvement to a minimum. 10.Ordinances should cover "grey areas" with necessary definitions, prohibitions, permissions, etc. 11. Ordinance should be as simple as possible. Ordinance Suggestions 1.Create a separate section to regulate fences, freestanding walls and retaining walls (take these items out of the "non encroachments" section). 2.Make natural planting the primary screening material with fences to be used only in peurticular circumstances, or in addition to natural materials; perhaps by conditional use permits. 3.Regulate permanent "walls" and obtrusive solid or opaque "fencea* more stringently than open fences. 4. 5. Require swimming pool fencing. Prohibit hazardous fencing in urban areas, yet allow barbed wire or electric fencing where horses are permitted in the rural areas. 6.Establish a "fence permit" system to require staff review prior to construction.
