Uphoff, 2497-99, 2501-03 Kelly Avenue Preliminary subdivision Public Hearing Meeting An approving recommendation of this preliminary PRD subdivision creating 4 residential units should consider the following points; 1. 4. 5. 6. The creation of a legal agreement that would define ownership and responsibility for maintenance of grounds, access road, joint dock on Lot 3, Navarre Cove, sewer line maintenance and repair etc. 2, 4 individual water meters and separate billings for each residence. 3. Prohibit any additions to the existing structures. Approve the 20' land corridor along lakeshore side. Prohibit overflow parking on Kelly Avenue - offstreet parking must be furnished on site. Olson DATE:March 11, 1981 SUBJECT: #568 Navarre Cove Subdivision/PRD This proposal dates way back to the original Kelley Avenue subdivision application. Note the Planning Coiuinission minutes of April 10, 1976, where zero lot line duplexes were discussed. The original subdivision #104 created lot #1 with 3,2 acres and one existing, non-conforming duplex. Thereafter, in October 1977, Planning Commission and Council approved Conditional Use Permits for both PRD (3 buildings on the same lot) and duplex credit (2 units in each building). The net density was 6 units on 3.2 acres. In 1979, Subdivision #448 was approved v;here in each separate duplex building was located on a separate lot. Now the applicant wants to combine the 2 north lots into one outlot and create a zero lot line PRD so that each dwelling unit is on a distinct property. Each unit would own 1/4 undivided interest in the common outlot. Lot 3 of Navarre Cove with the non-conforming duplex is not included. As with any non-conforming use, if this duplex is ever destroyed, it can only be replaced with one single family home meeting all current setbacks. This proposal does not increase the number of dwelling units nor does it prevent rental of any unit. It does allow con­ dominium ownership. In one way, it improves zoning compliance over the status quo, to wit: The 1979 subdivision created a lot containing a duplex, which lot did not abut the commercial zone. By recombination into Outlot A, owned in part by the owners of units 3 and 4, that duplex again more closely fits the standards contained in the duplex credit section. Ownership option is the only issue in this proposal. Density was decided in 1977 when the original Conditional Use Permits were issued. The Conmission proceeded to discuss the rezwiing application of the Kelly Avenue Molding Cenpany to doivn cone the 20' x 500* strip of commercial 3-3 area vdthin their residentially zoned tract. Van Nest felt that the City would receive no benefit by leaving it ccmnercial and Pesek agreed, feeling that if it remained cccwnercial it could be m^e into a park­ ing lot or similar use at a future tine. ?*r. Everett Schroeder objected, stating that the present ICeaveny Drug parking lot blacktop was extending into the residential area and the rezoning would only give a benefit to them and not the City. The menfcers felt tliat this was not the situation but requested staff to verify the matter. Mr. Ludwauf of the Kelly Avenue Holding Company stated to fir. Schroeder that it was more of a benefit to them to leave the commercial area status quo in order for them to have better position regarding the zoning provision requiring duplexes to be within 200 ft. of the conmercial area. However, their purpose for the rezoning was to provide a better buffer area from the business district. Van Nest moved, Hosfield seconded, that the rezoning application of the Kelly Avenue flolding Company be tabled until their next regular meeting in order that exact infoxmation regarding encumbrances on the property be clarified, flotion. Ayes (6) - Nays (0). Van Nest moved, Pesek seconded, that the Planning Commission recGomend to the Council conceptual approval of the sub­ division request of the Kelly Avenue Holding Company, but that Lot 2 not be considered buildable until the cottage is removed, ^totion, Ayes (5) - Nays (0) - Abstain (1) IXnlap. Hannah moved. Van Nest seconded, that the Planning Conmission recommend to the Council that the City vacate a four foot STRIP OF Hill Street lying adjacent to the entire extension of the A. T. Staff recommends final subdivision approval of the plat of Tristana Cove, subject to the findings and conditions noted in the staff resolution. Subject to Council's direction, Mr. Ward is working with the Building Official and plans to realign his access drive eliminating the need to park on County Road #19's right of way. My following state­ ment will attempt to summarize Mr. Cook's findings until the meeting night when I will present his written report. The fill site appears to have been operated for a minimum of two years. A comparison can be made of the existing el— .?^.>^ations of the properties to the south to assist in deter­ mining the previous elevations of the subject property. The majority of the surface drainage from the surrounding properties drains towards the wet lands to the rear. Cook would not^ recommend removal of all the fill but suggests that the City require removal of the fill located in the designated wet­ land area. To require the removal of all large foreign objects such as cement block, large pieces of concrete, etc. and to grade the sides of the entire fill area to a 4:1 slope. This slope ratio will attempt to create a more gradual pattern of drainage to the extensive wetland system to north. The current pattern of drainage from the subject site is still predominantly to the wetlands. The Engineer can find no evidence of drainage problems sustained by neighboring property to the south, certainly the 4:1 slope will remove any chance of a future problem. In addition, the cut into the upper bank should also be graded to a 4:1 slope. Hay bales are to be placed along the edges of the wetlands immediately. The disturbed area is to be seeded upon com­ pletion of the necessary grading. The hay bales are to remain in place until the City inspector is assured the ground cover has taken hold. It would be staff's recommendation that the City place Hubbell on notice that if he is found filling without the necessary permits either at this site or any whore else in the City of Orono, now with the full knowledge of the intent of the City's code that he will be tagged, fined and subject to litigation. If your drop through the forty-foot depth of this home is six feet or less you may be able to use this plan.
